MAYOR'S REPORT: Mayor Towey reported that he attended several of the meetings attended by other members of Council; he went to the annual Wastewater Board meeting where they discussed sewer rates for 2014; said the Health Department went over policy items that the staff will be working on in coming years; met with other local mayors and Commissioner O'Quinn; went to the City's Finance Committee meeting where the budget and financial direction were discussed; attended the Clean Air meeting where they discussed minor changes in Avista's regulations; went to the well attended south side senior center meeting honoring the region veterans where they had a guest speaker who was a survivor of the Pearl Harbor attack; he also went to the Felts Field "Welcome Home Veterans" ceremony, where the keynote speaker was a nurse who served in Vietnam, and who spoke of the transition from military to civilian life. After briefly explaining the history of the ordinance, Deputy City Attorney Lamb said the ordinance remains substantially unchanged since the administrative report; adding that any penalty would be determined by the prosecuting attorney and set by a judge. Resolution 13 -010 Establishing g ibrM Capital Facility Area — Erik Lamb It was moved by Deputy Mayor Schimmels and seconded to adopt Resolution 13 -010 authorizing Spokane County to include Spokane Valley in the Spokane County Library District capital facility area. Deputy City Attorney Lamb explained that in order for the Library District to put the matter of creating a library capital facilities area and imposing an excess property tax levy on an upcoming ballot, the legislative body of each affected jurisdiction is required to pass a resolution authorizing creation of the capital facility area that includes their city or county; and said if approved, this Resolution would authorize Spokane County to include Spokane Valley in the Spokane County Library District capital facility area. Mr. Lamb added that the Library requested we adopt the resolution, and that this resolution would not constitute a statement for or against the proposed ballot measure, but would only authorize Spokane County to include Spokane Valley in the capital facility area. Human Resources Manager Whitehead explained that in order to conduct business as a self - insured program, AWC (Association of Washington Cities), in compliance with state statutes and rules, requires that each member must approve by resolution, an interlocal agreement authorizing them to participate in the self - insured program. Mr. Whitehead added that with the adoption of the resolution and interlocal, benefit premiums for the City's healthcare plans will not increase in 2014. Towing Regulations — Erik Lamb Deputy City Attorney Lamb introduced Legal Intern Tim Murphy, who explained that the Spokane Valley Police Department has reported incidents were private owners have discovered that they have stolen vehicles abandoned on their lots; and currently if those private owners call for a private impound of vehicles, there is no requirement for the tower to first call the Police Department to determine whether the vehicle is stolen; and as a result, victims of auto theft are further financially victimized by the tower charging impound and storage fees, and said it could have been avoided had the Police Department been notified of the stolen vehicle. Mr. Murphy said staff recommends adding language in our Code that requires private tow operators to first check with the Police before performing an impound. Mr. Murphy noted that staff also recommends amending the penalty provision from being handled by our Code Compliance Department, to a Class 1 civil infraction handled by the Police Department. There were no objections from Council for staff to proceed. 8. SRTC Horizon 2040 Plan — Steve Worlev Senior Engineer Worley explained the history of the SRTC (Spokane Regional Transportation Council) Horizon 2040 Plan, as noted on his November 12, 2013, Request for Council Action form; said comments are due to SRTC by next Monday, and tonight is an opportunity for Council to review the comments and provide feedback. Mr. Worley also distributed copies and explained various pie charts showing the percentage of the $10.86 total billion expenditures, the percentage of programs expenditures, and a more detailed chart showing the percentage of the $10.86 billion expenditures. Mr. Worley said that of these funds, SRTC only manages about 3% of that total, and said he hopes the charts will help give some perspective to the figures. As part of Council's discussion, it was determined that the Sullivan project should come in priority before the Bigelow Project. Concerning the comments as shown on Mr. Worley's Request for Council Action form, Council agreed that focus should be on comment #1 and 92 and not include #3. Mr. Worley said he will draft a letter to send to SRTC conveying that information. 9. Fee Resolution for 2014 — Mark Calhoun Finance Director Calhoun briefed Council on the proposed changes to the Fee Resolution. In response to a question about the change in special events permit fee from $5 to $40, Parks and Recreation Director Stone said that in checking with other entities such as the Washington State Parks, and the City of Spokane, the lowest amount is $40.00, and said Spokane County charges $200; he said this originally came about when the issue of block parties was brought up several years ago; and said that in the last two years, we have only processed one of those events; he said the event must be coordinated with traffic, risk management, and the police department as well as checking back with the entity asking for the permit, to make sure all paperwork and insurance is complete. Mr. Calhoun added that in checking with other entities' fees, virtually every time we are the least expensive fee. Councilmember Grafos asked about changing it to $35 instead of $40. Mayor Towey replied that $40 was reached because of our administrative cost, and said he doesn't want to lose that, especially as long as we are compatible. There were no other comments from Council on the proposed fee changes. 10. Advance Agenda — Mayor Towey There were no suggested changes to the Advance Agenda. He said the Finance Committee selected the Appleway Trail, University to Evergreen, to begin making that familiar to the legislature in 2014, and said that it could be eligible for funding in 2015; he said we received $642,000 from SRTC (Spokane Regional Transportation Council) for that project so we have some matching funds. Mr. Jackson said that after Council reviews the legislative agenda, it will be brought back again for formal adoption consideration. WHEREAS, an application for vacation was filed on July 12, 2013, and was determined complete on August 7, 2013; and WHEREAS, the City Council by Resolution 13 -007 set a public hearing date for September 12, 2013, with the Planning Commission; and WHEREAS, the Planning Commission held a public hearing on September 12, 2013; and WHEREAS, following a hearing, the Planning Commission found that the notice and hearing requirements of the applicable Spokane Valley Municipal Code section 22.140.020 have been met; and WHEREAS, the Planning Commission findings and recommendation have been filed with the City Clerk as part of the public record supporting the vacation; and WHEREAS, none of the property owners abutting the property to be vacated filed a written objection to the proposed vacation with the City Clerk; and WHEREAS, Chapter 22.140 Spokane Valley Municipal Code (SVMC) stipulates City Council shall specify that the vacated portion of the right -of -way shall belong to the property owners of the parcels abutting to the south; that affected utilities have reviewed the vacation and do not require continued easements; that the zoning district designation of the properties adjoining the street shall attach to the vacated property; that a record of survey shall be submitted to the Director of Community Development; and that all direct and indirect costs of title transfer to the vacated street be paid by the proponent or recipient of the transferred property; and WHEREAS, the vacated right -of -way is wholly contained within the parcels stated above and created pursuant to Short Plat SP- 1243 -00 at no public expense; and WHEREAS, the City Council desires to vacate the above right of way pursuant to SVMC 22.140 NOW, THEREFORE, the City Council of the City of Spokane Valley, Spokane County, Washington, do ordain as follows: Section 1. The surrounding property owners are able to access the properties adjacent to the right - of -way from Evergreen Avenue. There are currently no plans for future development of this right -of -way. It is not in use at this time. 5. No public comments have been received regarding the proposed vacation. Spokane County Utilities and Vera Water and Power, have confirmed they have no utilities in the right of way and will not require easements. Avista Utilities requested a ten -foot easement to extend across the northern portion of the vacated right of way but withdrew that requirement in an email dated September 30, 2013. 6. Pursuant to Resolution 07 -009, Policy for Imposing Vacation Charges Pursuant to RCW 35.79.030, the City of Spokane Valley has the authority to charge for vacations in an amount that does not exceed 50% of the full appraised value or for the full amount of the area vacated where the street has been part of a dedicated right of way for over twenty five years or if the property was acquired at public expense. Notwithstanding those provisions, the applicant shall pay the fee only to the extent it exceeds the cost charged by the City to initiate the vacation process. The following facts are relevant to the Council's determination of the amount to charge for the vacation: a. The right of way was dedicated in 2002 through a short plat. b. The right of way was not obtained at public expense. c. The applicant is dedicating right of way to build an emergency access turn- around. d. The difference between the area being vacated and the area being dedicated for the turnaround is considered roughly equivalent. Based on this assessment the City does not seek payment for the vacated right of way. Section 2. Property to be Vacated. Based upon the above findings and in accordance with this Ordinance, the City Council does hereby vacate the street or alley which is incorporated herein by reference, and defined as follows: The west approximately 111 feet of the half - street portion ofAlki Avenue established per Short Plat SP- 1243 -00 as recorded in Book 18 of plats, page 2, lying northerly of Tracts C and D of said plat. Section 3. Division of Property to be Vacated. Pursuant to RCW 35.79.040 and SVMC 22.140.040(C), the vacated portion of the street or alley shall belong to the abutting property owners, one - half to each. The vacated right of way is the south one -half of Alki Avenue and shall belong to the lots abutting to the south, as recorded in the record of survey which shall be created and recorded with the County as required under Section 22.140.090 SVMC. Section 4. Zoning. The zoning designation for the vacated property shall be the designation attached to the adjoining properties as set forth within the respective property or lot lines. The Director of Community Development is authorized to make this notation on the official Zoning Map of the City. Section 5. Conditions of Vacation. The surveyor shall locate at least two monuments on the centerline of the vacated right -of -way with one located at the intersection of the centerline of the vacated right -of -way with each street or right -of -way in accordance with the standards established by the City of Spokane Valley Street Standards. 5. All direct and indirect costs of title transfer of the vacated street from public to private ownership including but not limited to title company charges, copying fees, and recording fees are to be borne by the proponent. The City will not assume any financial responsibility for any direct or indirect costs for the transfer of title. 6. The Garden Office (GO) and Single - Family Residential (R -3) zoning district designation of the properties adjoining the south side of the vacated right of way shall be automatically extended to include the vacation, and all area included in the vacation shall then and henceforth be subject to all regulations of the extended districts. 7. The utility and border easements located adjacent to the vacated right of way are hereby relinquished as part of the vacation. 8. The record of survey and certified copy of the ordinance shall be recorded by the City in the office of the Spokane County Auditor. The ordinance's recording cover page shall reference the recording number of the 2002 plat to tie the dedication and subsequent vacation /easement releases together 9. The dedication of the emergency access turn- around shall be effected through deed by the proponent. The proponent shall prepare the transfer deed and real estate affidavit documents and record them with the Spokane County Auditor's office. 10. All conditions of City Council authorization shall be fully satisfied prior to any transfer of title by the City. Section 6. Closing. Following satisfaction of the above conditions, the City Clerk shall record a certified copy of this Ordinance in the office of the County Auditor, and the City Manager is authorized to execute all necessary documents in order to complete the transfer of the property identified herein. Section 7. Severability. We need to take a gas from Alki and Bannen area and build it in a westerly direction to connect to the east boundary of Lot 2. If the cul de sac stays we are probably okay. If the cul tie sac goes away and the turnaround is the end of the road, we need an 10' easement from the end of the road to the east boundary of lot 2. 1 hope i am understanding all of this because it is not very clear. Planner Marty Palaniuk presented an overview of a street vacation requested by the applicant, Mike Silvey, on behalf of Evergreen and Valleyway, LLC. Mr. Silvey requests the vacation of an unimproved, lialf- width, right -of -way section of Alki Avenue (81 feet in length by 19 feet wide with 50' radius cul -de -sac at the terminus). The vacated cul -de -sac will be replaced through the dedication of an emergency access turn- around. Commissioner Stoy asked if the dedicated area is going to be the fire department hammerhead. Planner Palaniuk stated that the City staff have looked at it and agreed with the vacation and dedication of the hammerhead. He commented that a half cuI -de sac does no good for the fire department; they cannot turn around on a half cul -de -sac, so idea was to get a turnaround hammerhead there. It's not the ideal for the end of Alki but it will be functional to allow emergency vehicles to get in there and get turned around. It also would give the City somewhere to push snow in the winter. Commissioner Anderson asked if you vacate a portion of a street, would the city require the right-of-way to he improved. Mr. Palaniuk stated that the city will require the improvements when the developer gets a building permit for this property. Planning Manager ICuhta stated that the property to the north would be required to dedicate and to Planning Commission Minutes Page 2 of 4 improve a portion of Ilieir property; it appears that they are moving fast to get these areas developed and most likely, there will be many improvements within the next year. X. GOOD OF THE ORDER Commissioner Anderson had a comment on the Spokane Valley Municipal Code, Section 17.80.150 F, which has the two approval criteria's: T. Approval Criteria. The City may approve amendments to this code if it finds that: 1. The proposed amendment is consistent with the applicable provisions of the Comprehensive Plan; acid 2. The proposed amendment bears a substantial relation to public health, safety, welfare, and protection of the environment. He stated that the problem lie has is it says; and between 1 and 2, which mean both the criteria's need to be met to do what it says. Also in sentence 2 it states: bears a substantial relation to public health, safety, welfare, and protection of the environment, Commissioner Anderson does not believe in most cases you can support that sentence. However, there are cases that you could. Commissioner Anderson stated lie is curious why an and verses an or type requirement and can that requirement be changed. Planning Manager Kuhta stated that the basis of zoning is to protect the public health, safety, and welfare. This is a standard clause in the municipal code. Deputy City Attorney Erik Lamb stated our constitutional authority for municipalities to act and to enact zoning regulations, is our police power to protect the public health, safety, and welfare. He continued that in requiring this in an approval criteria were insuring that it is under our constitutional authority. Commissioner Anderson stated he has a tough time using the same paragraph every time, there is no validity to it. XI. Mr. Palaniuk stated it would become City property. Commissioner Anderson asked, if the turii- around is completely built and paved by the applicant? Mr. Palaniuk responded that the applicant wouldn't be required to improve at the time of vacation, but when they develop the parcel, it will be required to be improved. Commissioner Bates stated that the description of the proposal shows a hundred and eleven feet in length and all the other documents show eighty -five in length. Mr. Palaniuk state that there was some question about what that length was. He said he tried to get it to one hundred and eleven but could not get an exact length the turnaround had to be from the engineer. Mr. Palaniuk stated, it's been updated. In the end, the record of survey will have every dimension on it. Commissioner Bates asked Mr. Palaniuk to explain what Item 6 under recommendation means: (The zoning designation of the properties adjoining each side of the street or alley to be vacated shall be automatically extended to the center of such vacation). Mr. Palaniuk stated that in this case they are vacating a half right of way. Therefore, you do not really go to the center of the street. The zoning that is adjacent to the right of way will automatically extend into the area that is vacated. Therefore, as we vacate it, then it will automatically become garden/office. Commissioner Bates asked if the letter submitted from David Chamber of Avista has been resolved. Commissioner Bates stated that it looks like Mr. Chamber's was confused due to the map that was sent to him. Mr. Palaniuk stated that Mr. Chamber's wanted to make sure lie had an casement across to the parcel with a ten foot easement, so that lie could serve that parcel. Mr. Palaniuk stated that it is residential urban district, which allows single - family residences, duplexes, some limited multifamily residential and allows the assisted living facility, which is more of a multifamily type. Mr. Lafser wants to know why they would put an assisted living in an R-4. Mr. Palaniuk stated there will be a hearing on that rezone on October 24, 2013. Mr. Arger will be there for questions, Mr. Lafser commented that as long as the city is vacating properties than just make the street as wide as it should be with Mr. Argers and Mr. Silvey's property. Commissioner Bates responded (fiat would a separate issue altogether. Mr. Lafser has concerns about the traffic flow thru Alki. WHEREAS, the City Council received considerable public testimony expressing concern about nude or semi -nude individuals in a public setting. A record of these comments is contained in the legislative record for this Ordinance, with a copy available for review in the Office of the City Clerk; and WHEREAS, Article 11, section 11 of the Washington State Constitution allows local governments to make and enforce within their jurisdictional limits, local laws and regulations not in conflict with the general laws of the State; and WHEREAS, the Washington State Supreme Court has recognized the right of local governmental entities to regulate conduct in public places, including public nudity and semi - nudity; and WHEREAS, public nudity and semi - nudity can have a negative impact on the community, including exposure to minors; and WHEREAS, following review of the City's existing Municipal Code, as well as statutes contained in the Revised Code of Washington, City staff does not believe existing laws adequately address public semi - nudity; and WHEREAS, local regulations criminalizing conduct should clearly identify the conduct which is prohibited; and WHEREAS, the City Council does not intend through these actions to amend or otherwise impact the City's adult entertainment regulations, codified as SVMC 5.10, which regulations are separate and distinct from this proposed chapter 8.55 SVMC; and WHEREAS, the City Council, in enacting this Ordinance, seeks to promote the City's interest in protecting the public health, safety, and welfare of the residents of the City. NOW THEREFORE, the City Council of the City of Spokane Valley, Spokane County, Washington, ordains as follows: Section 1. The purpose and intent of this chapter is to establish a regulatory framework regarding exposure of certain human body parts while in a public place, and providing penalties for violations thereof, all in the interest of protecting the health, safety, and welfare of the residents of the City of Spokane Valley. Section 2. That SVMC Title 8 be amended by adding a new chapter, to be designated "8.55" - as follows: Ordinance 13 -018 Unlawful Public Exposure Page 1 of 3 DRAFT 8.55.010 - Definitions. Unless the context clearly requires otherwise, the definitions used in this chapter shall have the following meanings: "Expose or exposure" means to reveal or otherwise render open to view in a public place. "Full and opaque covering" means material which is securely attached over or around the shoulders, neck or back, and which is not transparent or translucent. Body paint, body dye, tattoos, liquid latex whether wet or dried, or any similar substance applied to the skin surface shall not be considered opaque covering. Any substance which can be washed off the skin is not full and opaque covering as required by this chapter. "Prohibited body parts" for purposes of this chapter means exposure of- - any part of the male or female genitals, or anus; or - more than one -half of the female breast by area; or - any part of the areola or nipple of the female breast. "Public place" means an area visible to public view, including any place in which the general public has a right to be present or view, whether or not conditioned upon payment of a fee. 8.55.020 - Unlawful public exposure prohibited - facilitation. It shall be unlawful for any person: A. To knowingly expose a prohibited body part in a public place without a full and opaque covering. B. Who owns, manages, or operates any retail sales or retail service business to knowingly facilitate, permit, encourage, or cause to be committed whether by commission or omission, another person to expose a prohibited body part in a public place without a full and opaque covering. 8.55.030 - Exceptions to unlawful public exposure. The prohibitions set forth in SVMC 8.55.020 shall not apply to the following: A. Breastfeeding or expressing milk, regardless of where it occurs; B. Use of public places where privacy is customary including, but not limited to bathrooms, saunas, and changing rooms associated with licensed businesses; C. Classes, seminars or lectures conducted for scientific or education purposes, including but not limited to art classes and medical classes; D. Businesses where medical procedures occur; E. Conduct that is subject to regulation pursuant to SVMC 5.10 — Adult Entertainment. 8.55.040 - Affirmative Defenses. It is an affirmative defense to prosecution for a violation of SVMC 8.55.020 that the unlawful public exposure, when considered in the context in which it was presented, provided actual literary, artistic, political, or scientific value and was not provided for commercial or sexual exploitation or with an emphasis on an appeal to a prurient interest. 8.55.050 - Penalties and enforcement. A violation of SVMC 8.55.020 is a misdemeanor and shall be punishable by a fine not to exceed $1,000 or imprisonment not to exceed 90 days, or both. Section 3. Severability. If any part of chapter 8.55 SVMC is declared unenforceable, it shall not affect the remainder. Section 4. Effective Date. BACKGROUND: The Spokane Valley Police Department reported incidents where private owners have discovered stolen vehicles abandoned on their lots. Currently, if these private owners call for a private impound of vehicles on their property, there is no requirement for the tower to first call the City Police Department to ensure it is not a stolen vehicle. As a result, victims of auto theft are further financially injured by the tower charging impound and storage fees, when that could have been avoided had the City Police Department been notified of the stolen vehicle. The City Police Department requested that staff research potential options for addressing this issue. After doing so, staff recommends consideration of language that requires private tow operators to first check with the City Police Department before performing an impound. Staff recommends amending the penalty provisions of SVMC Chapter 9.10 so that the penalty for any violation of this chapter is a Class 1 civil infraction. Currently, a towing violation is a public nuisance handled by the City Code Compliance Department. However, it is more appropriate for the City Police Department to handle these violations as civil infractions. The maximum penalty for a Class 1 civil infraction is $250 plus various court costs and fees, which total with the penalty approximately $520. Staff drafted a proposed ordinance that incorporates language on the suggested approach, attached. OPTIONS: (1) Move to advance to a second reading with or without modification; or (2) take other appropriate action. The requirement of towing operators to receive prior clearance from the City Police Department is likely to help avoid further inconvenience and monetary impact for victims of such crimes; and WHEREAS, this Ordinance would change the penalty section so that a violation constitutes a Class 1 civil infraction enforceable by District Court, rather than through the City's code compliance office; and WHEREAS, the City Police Department recommends adopting these provisions; and WHEREAS, this Ordinance is in the best interest of the health, safety and welfare of the citizens of the City. NOW THEREFORE, the City Council of the City of Spokane Valley, Washington ordains as follows: Section 1. Adoption. Spokane Valley Municipal Code 9.10.125 is hereby adopted as follows: 9.10.125 Tow operators performine private impounds — Requirements. Any tow truck operator impounding a vehicle from private propeLly is required to notify the City Police Department and wait for clearance to proceed prior to impounding an abandoned motor vehicle. Impoundment of stolen vehicles is only authorized by law enforcement. In the event that the reported stolen vehicle subsequently requires impoundment, the reporting /posted tow company shall receive the tow. Towing operators shall otherwise comply with all towing and impoundment provisions in chapter 46.55 RCW. Ordinance 13 -019 Amending Towing Regulations Page 1 of 2 DRAFT Section 2. Amendment. If any section, sentence, clause or phrase of this Ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this Ordinance. The auditors completed their fieldwork on October 7 and we are simply waiting for the final exit conference. 2013 Budget Amendment The second of two 2013 Budget amendments was adopted October 22 "d after advancing through the following calendar: • September 24 Admin Report • October 8 Public hearing • October 8 First reading on proposed ordinance amending the 2013 Budget • October 22 Second reading on proposed ordinance amending the 2013 Budget 2014 Budget Development Process The 2014 Budget was adopted October 22 "d after advancing through the following calendar: • June 18 Council budget workshop • August 13 Admin report on 2014 revenues and expenditures • August 27 Public hearing #1 on 2014 revenues and expenditures • September 17 City Manager's presentation of preliminary 2014 Budget • September 24 Public hearing #2 on 2014 Budget • October 8 First reading on proposed ordinance adopting the 2014 Budget • October 22 Second reading on proposed ordinance adopting the 2014 Budget 2014 Property Tax Levy A significant part of the budget development process includes the annual levy of property taxes which in 2014 are expected to account for approximately 30% of recurring General Fund revenues. Lodging Tax Council has had a number of discussions regarding the distribution of lodging tax proceeds thus far in 2014 and this will culminate with the 2013 grant process leading to 2014 grant awards. The schedule leading to awarding funds is as follows: • September 4 Letters mailed to agencies that have historically received funding, media release to City website and notice to newspapers. • October 4 Grant applications due at City Hall. • October 16 Grant applicant presentations to lodging tax advisory committee. • October 29 Admin report to Council on results of lodging tax advisory committee meeting. • December 10 City Council motion consideration: Award lodging tax for 2014. Fee Resolution As a part of preparing the annual budget City Departments are asked to review the Master Fee Schedule that is currently in place and determine whether changes in fees charged and/or language used in the governing resolution should be altered. This leads to an annual update to the fee resolution that sets fees for the following year. The calendar leading to the adoption of the resolution setting 2014 fees is as follows: • November 12 Admin report on proposed changes to the fee resolution • December 10 Council adoption of the fee resolution. Budget to Actual Comparison Report A report reflecting 2013 Budget to Actual Revenues and Expenditures for those funds for which a 2013 Budget was adopted (and amended on October 22) is located on pages 5 through 16. Because we attempt to provide this information in a timely manner this report is prepared from records that are not formally closed by the Finance Department at month end or reconciled to bank records. Although it is realistic to expect the figures will change over subsequent weeks, I believe the report is materially accurate. We've included the following information in the report: • Revenues by source for all funds, and expenditures by department in the General Fund and by type in all other funds. • A breakdown between recurring and nonrecurring revenues and expenditures in the General Fund, Street O &M Fund and Stormwater Fund. • The change in fund balance including beginning and ending figures. The beginning fund balance figures are those that are reflected in the 2012 Annual Financial Report. • Columns of information include: • The 2013 Budget as adopted. • October 2013 activity. • Cumulative 2013 activity through October 2013. • Budget remaining in terms of dollars. • The percent of budgeted revenue collected or budgeted expenditures disbursed. A few points related to the General Fund #001 (page 5): Recurring revenues collections are currently at 74.52% of the amount budgeted with 83.3% of the year elapsed. This is typical and reflective of the nature of the timing of when revenues are collected. 4W- FSZUsersVncaihounl Finance Activity ReportsTO1312013 10.docx Page 2 • Property tax collections have reached $6,357,280 or 58.09% of the amount budgeted. Property taxes are paid to Spokane County Treasurer in two installments each year on April 30 and October 31. The greatest portion of these monies are then remitted to the City in May and November, with lesser amounts typically received in June and December. • Sales tax collections represent only 9- months of collections thus far because taxes collected in October are not remitted to the City by the State until the latter part of November. Collections are currently $12,378,141 or 81.17% of the amount budgeted. • Gambling taxes axes are at $287,829 or 47.01% of the amount budgeted. These taxes are paid quarterly. The second quarter payments were mostly received and recorded during July and August. Third quarter payments were due by October 31" and recorded as revenue in early November. • Franchise Fee and Business Registration revenues are typically received in the month following a calendar year quarter. Through October we have received $933,379 or 82.24% of the amount budgeted. • State shared revenues are composed of State of Washington distributions that include items such as liquor board profits, liquor excise tax, streamlined sales tax mitigation and criminal justice monies. Most of these revenues are paid by the State in the month following a calendar quarter. Through October we've received remittances totaling $1,344,571 or 79.82% of the amount budgeted. • Fines, forfeitures and penalties revenues are composed of monthly remittances from Spokane County with payments made in the month following the actual assessment of a fine and false alarm fees. Through October 2013 we've received remittances for the period January through September with receipts of $1,150,329 or 70.47% of the amount budgeted. • Community Development service revenues are largely composed of building permits and plan review fees as well as right of way permits. Revenues are currently $1,538,103 or 131.01% of the amount budgeted. • Recreation program fees are composed of revenues generated by the variety of parks and recreation programs including classes, swimming pools (in- season), and CenterPlace. Currently, revenues total $502,597 or 87.94% of the amount budgeted. Recurring expenditures are currently at 72.13% of the amount budgeted with 83.3% of the year elapsed. Departments experience seasonal fluctuations in activity so they don't necessarily expend their budget in twelve equal monthly installments. Investments (page 17) Investments at October 31St total $45,179,895 and are composed of $40,121,658 in the Washington State Local Government Investment Pool and $5,058,237 in bank CDs. Total Sales Tax Receipts (page 18) Total sales tax receipts reflect State remittances through October and total $13,947,513 including general, criminal justice and public safety taxes. This figure is $1,065,302 (8.27 %) greater than for the same 9 -month period in 2012. Economic Indicators (pages 19 — 21) The following economic indicators provide information pertaining to three different sources of tax revenue that provide a good gauge of the health and direction of the overall economy. 1. Sales taxes (page 19) provide a sense of how much individuals and businesses are spending on the purchase of goods. 2. Hotel 1 Motel taxes (page 20) provide us with a sense of overnight stays and visits to our area by tourists or business travelers. 3. Real Estate Excise taxes (page 21) provide us with a sense of real estate sales. 11SV- FS21UsersVnca1houn1Finance Activity Reports1201312013 10.docx Page 3 Page 19 provides a 10 -year history of general sales tax receipts (not including public safety or criminal justice) with monthly detail beginning January 2004. • Compared with calendar year 2012, 2013 collections have increased by $982,066 or 8.62 %. • Tax receipts peaked in 2007 at $17.4 million and dropped off dramatically in the subsequent three years. Page 20 provides a 10 -year history of hotel /motel tax receipts with monthly detail beginning January 2004. • Compared with calendar year 2012, 2013 collections have increased by $21,484 or 5.71 %. • Collections peaked in 2012 at $490,004. Page 21 provides a 10 -year history of real estate excise tax receipts with monthly detail beginning January 2004. • Compared with calendar year 2012, 2013 collections have increased by $281'665 or 36.65 %. • Tax receipts peaked in 2007 at nearly $2.6 million, decreased precipitously in 2008 and 2009, and have since been gaining ground. Debt Capacity and Bonds Outstanding (page 22) This page provides information on the City's debt capacity, or the dollar amount of General Obligation (G.O.) Bonds the City may issue, as well as an amortization schedule of the bonds the City currently has outstanding. • The maximum amount of G.O. bonds the City may issue is determined by the assessed value and the 2012 assessed value for 2013 property taxes is $6,921,825,295. Following the City's December 1, 2012, bond payment, the City currently has $7,690,000 of nonvoted G.O. bonds outstanding which represents 7.41% of our nonvoted bond capacity, and 1.48% of our total debt capacity for all types of bonds. • The $7,690,000 of bonds the City currently has outstanding is part of the 2003 nonvoted (LTGO) bond issue. Of this amount: • $6,130,000 remains on bonds issued for the construction of CenterPlace. These bonds are repaid with a portion of the 1110 of 1% sales tax that is collected by the Spokane Public Facilities District. • $1,560,000 remains on bonds issued for road and street improvements around CenterPlace. initiated officer contacts. Hot spot maps are attached showing October residential burglaries, traffic collisions, vehicle prowlings, and stolen vehicles. Also attached are trend -line graphs for 2009, 2010, 2011, 2012 and 2013: Citations, Spokane Valley Dispatched Calls, Self- Initiated Calls, Collisions, Persons Crimes, Property Crimes, and Sex Crimes. Also included is the October Crimes by Cities stats report. This report reflects incidents that occurred in a specific city to which a deputy from Spokane County took the courtesy report. For example, an individual may have had his car stolen in Airway Heights, and he waited until he returned home in the Newman Lake area to make a report. In 2011, we switched from UCR to NIBRS classification. As a result, certain crimes were broken down to their violation parts for NIBRS and each part is now counted. Consequently, comparing certain crimes before 2011 to crimes during or after 2011 is not possible using the graphs. The crimes that are impacted by the NIBRS classification changes and should not be compared to prior graphs include: Adult Rape, Assault, Forgery and Theft. ADMINISTRATIVE: The month of October began with the Special Olympics Breakfast of Champions, which Chief VanLeuven and Lt. Lyons attended along with others from the Spokane County Sheriff's Office. In early October, the Spokane Valley Rotary Club, once again donated a new flag to the precinct. We are grateful to this group of citizens who year after year provide this service to our community. Page 1 Chief VanLeuven attended quarterly In- Service Training at the Sheriff's Training Center. Quarterly Leadership was held the following week, which was attended by Chief VanLeuven along with Lt. Lyons as well as all the SVPD sergeants and detectives. Mid - October brought the Annual Crime Prevention Conference, which was held at CenterPlace. Chief VanLeuven provided opening remarks /welcome to all those who were attending. Topics of workshops this year included Active - Shooter Survival, Gang Updates & Trends, How to Do an Emergency Drill at Your Facility, Firearm & Personal Safety, Prosecution Issues for Organized Retail Theft, as well as SCOPE Basic Training. Sgt. Dave Ellis also gave a presentation on the Air -1 Helicopter Unit. The month ended with the Drug Take Back Event, this year held at the WSECU at 12209 E. Mission. Incident Response Team (SIRT) volunteers contributed 71 on -scene hours (including travel time) in October, responding to crime scenes, motor vehicle accidents and providing traffic control. Of those hours, 50 hours were for incidents in Spokane Valley. Special Event hours for Spokane Valley totaled 34. Fourteen hulks were processed in September and 37 hulks processed in October. During the month of October, a total of 99 vehicles were processed; the total for 2013 to date is 674. OPERATIONS: Attempted Robbery — In early October, Spokane Valley Sheriffs Deputy R. Stevens was contacted by a 68- year -old woman at the Spokane Valley Precinct who told him she was the victim of an Page 3 attempted robbery. The victim told Deputy Stevens that she had been at Northern Quest Casino earlier and that she was approached by a 23 to 25- year -old male who identified himself as "Josh." She said he initially asked her for a ride to Spokane Valley, which she denied but did give him $20 dollars because he said his girlfriend left without him. The victim eventually agreed to give Josh a ride to an apartment complex near Pines and Montgomery in Spokane Valley. After she dropped off Josh, he walked around to her partially rolled down driver's side window and said "give me all your money or I will stab you." She said Josh had his hands in his pockets, did not display a knife, but she was fearful he would carry out the threat. She sped off and drove to the Valley Precinct. Crime Stoppers is offering a cash reward for anyone providing information leading to an arrest in this incident. Persons with information should call the Crime Stoppers Tip Line at 1- 800 - 222 -TIPS, or should forward the tip via the Internet website www. crimestoppersinlandnorthwest.org. Tipsters do not have to give their name to collect the cash reward. Crime Stoppers of the Inland Northwest is a civilian organization that promotes public safety by paying cash rewards for information that solves crimes. It is not affiliated with law enforcement. Payless Shoes Robbery— In early October, Spokane Valley Sheriffs Deputy Walter Loucks responded to a burglary call at Payless Shoes located at 13020 E. Sprague Ave. in Spokane Valley. The employee told Deputy Loucks that she observed a white female, in her early 20's, enter the store carrying a large leopard -print handbag. She said the female was about 5'4 ", with a light build and blonde hair. The employee was concerned with the female's motives as she realized the bag may be used to conceal items. Minutes later, the employee heard the front door chime and walked out to greet the new customer. Instead, she saw the suspect departing the business with one of the store's new purses in hand. The suspect was also carrying the leopard print handbag, which was now bulging with shoes, which she was placing in her vehicle. The employee exited the store and told the suspect to return the merchandise or she would call the police. The employee approached the suspect who said, "I have a gun." The victim did not see a gun and went back into the business to call police. The victim said the suspect drove in front of the store and was waving and smiling at her as she passed by. Robbery Suspect Arrested — In mid - October at about 1:00 a.m., Spokane Valley Sheriffs Deputy David Lawhorn responded to a robbery call at Zip Trip, located at 1403 N. Mullan Road. The female employee told Deputy Lawhorn a white male around 50- years -old, approximately 5'4 ", wearing brown pants and a red handkerchief around his head entered the store. She said the male suspect was wearing one black glove and one brown glove. She said the suspect's right fingers were curled up in his hand and appeared non - functional. The employee said the male suspect selected an item off the shelf then walked behind the counter and took two packs of Camel 99's. The male said, "If you say anything I will kill you." The employee said the male suspect exited the store and rode his bicycle eastbound on Sinto Avenue. She recognized the male suspect because he had been in the store two times prior when she was working. At 1:30 a.m., Deputy Lawhorn was assisting another deputy on a traffic stop at Locust and Sinto. He saw a male ride by on a bicycle and saw he was carrying a large knife on his belt. Deputy Lawhorn got in his patrol vehicle and attempted to stop the male, later identified as the above - mentioned male suspect. The male suspect refused to stop and eventually ran from Deputy Lawhorn in the playground at Ness Elementary. Deputy Lawhorn caught the suspect and detained him until the employee came to the school and positively identified him as the person who robbed the Zip Trip. While walking the male suspect to the patrol vehicle, Deputy Lawhorn noticed the suspect was wearing one black and one brown glove. He also found a red handkerchief inside the male's coat Page 4 pocket and two packs of Camel 99's. The male suspect was booked into Spokane County Jail for 2nd Degree Robbery. Intoxicated Man Gets Wish — In mid - October at 4:15 a.m., Spokane Valley Sheriffs Deputy Dale Wells responded to a suspicious person call at 717 N. McDonald Road. Deputy Wells contacted a 48- year -old male at the apartment complex who was extremely intoxicated and told Deputy Wells he was out looking for his vehicle. Several hours earlier, the same male was contacted by deputies because he was threatening to drive his vehicle. He made the intelligent decision not to and was given a courtesy ride to his residence. The keys to the vehicle were left with his sober girlfriend. The male and his girlfriend left his house in an attempt to locate his vehicle. The male's girlfriend refused to give him the keys until he was sober, which angered the male to the point he requested deputies take custody of his car keys. Deputy Wells had allowed the male to sit in the back seat of the patrol vehicle, due to his high level of intoxication; the back door remained open the entire time. When told his keys were safe with his sober girlfriend, the male told Deputy Wells he would only exit the vehicle when his girlfriend did not have the keys. Deputy Wells explained to the male that if he refused to exit his patrol vehicle, he would be arrested. Deputy Wells spent several minutes trying to explain he was not available for other calls with him in his vehicle. The male told Deputy Wells he wanted to go to jail, that he was not going to exit the vehicle and said "arrest me." The male's request was granted and he was placed under arrest for Obstructing a Public Servant. While en route to jail, the male told Deputy Wells that when he was released from jail he was going to go kill his girlfriend. The male was charged with the additional felony crime of Harassment (Threat to Kill). The male was booked into Spokane County Jail for the felony Harassment charge and misdemeanor Obstructing charge. Reward Offered For Robbery Suspect— In mid - October, Spokane Valley Sheriffs Deputy Jeffrey Getchell responded to a robbery call at Wal -Mart, located at 5025 E. Sprague. The Loss Prevention Officer (LPO) said that t about 4:00 p.m. she attempted to stop a male suspect outside the store as he walked out without paying for a flashlight. When confronted, the suspect brandished a knife in a threatening manner and fled to a vehicle. The LPO was able to write down the license plate, which returned as a stolen vehicle. The vehicle has since been recovered. There is no suspect information at this time. Crime Stoppers is offering a cash reward for anyone providing information leading to an arrest in this incident. Two Robbery Suspects Arrested In Two Days — In mid - October at about 8:30 p.m., Spokane Valley Sheriffs Deputies Joe Bodman and Jacob Spitzer responded to a robbery call at the Dollar Tree located at 9211 E. Montgomery. A female employee said a 43- year -old white male was at the check stand purchasing a bottle of water. She said when she was giving him his change, the male reached over the counter, grabbed money out of the cash register, and fled in a Ford Freestyle station wagon. The employee said the male was wearing blue jeans and a dark - colored Harley Davidson T- shirt. He was also wearing a dark hat with a Harley Davidson decal on the front. Sheriffs Deputy Nathan Bohanek was en route to assist with the investigation when he saw a similar vehicle enter eastbound I- 90 from Argonne. Deputy Bohanek followed the vehicle, confirmed it was a Ford Freestyle and attempted to stop the vehicle. The vehicle continued approximately one mile eastbound on I -90 before exiting at Evergreen Road. Deputy Bohanek contacted an elderly female in the front passenger seat and the driver. Deputy Bohanek immediately saw the male was wearing a dark- colored, long - sleeved shirt with a Harley Davidson logo on the chest. Deputy Bohanek requested another unit and the male was detained. Deputy Bohanek spoke with the passenger, the male's mother, who told him they were on their way to Idaho Falls from Edmonds, Washington. She said her son was out of work and she was trying to help him find a job. She also said they left on Sunday and had to ask strangers for Page 5 money along the way for fuel. She said they were sleeping in the vehicle because the $700 she received from Social Security was not enough for the trip. The male was positively identified by employees of the Dollar Tree who were brought to the scene, as the person who robbed the business. Deputy Bohanek located a large amount of money in the male suspect's wallet. Dollar Tree employees knew the amount that was taken from the business and that money was returned. The remaining money was given to the male's mother. Deputies also set the mother up with a hotel room in Spokane Valley, paid for with their personal credit card, and transported the vehicle to the hotel. The male suspect was booked into Spokane County Jail for 2nd Degree Robbery. We were later advised that when Comfort Inn management found out what had happened and that the deputies paid for the suspect's mother's room with their personal credit card, they credited the room charge back to the card and gave the suspect's mother two free nights at the hotel. Family Sleeping While Burglarized— In mid - October, at about 5:45 a.m., Spokane Valley Sheriffs Deputy Tyler Kullman responded to a residential burglary call near 11300 E. Jackson Road. Deputy Kullman spoke with the homeowner who told him he woke up at about 5:15 a.m. to let their dog out when he noticed the south - facing window in the living room was open. The homeowner said he was positive it was closed when he went to bed. When he looked outside the window, he saw the screen lying up against the house. The homeowner said he looked around the kitchen and saw his wallet was missing from the kitchen counter. He went outside and found his wife's purse and all its contents scattered under a carport. The homeowner reported his cards stolen and found out his debit card had been used three times in Spokane Valley. There are currently no suspects. Man Robbed For $10.00 — In mid - October, at 2:00 a.m., Spokane Valley Sheriffs Deputies responded to the Denny's Restaurant at Sprague and Pines on a robbery call. The victim said he was waking northbound on Pines from Sprague when he was approached by two males. He described the first as a white male, around 17 years old, 5'4 ", 120 pounds, wearing a red and white - colored sweatshirt and dark- colored pants. The second was described as a black male, unknown age, 5'4 ", 130 -140 pounds, wearing a dark - colored cap and possibly dark- colored pants. The victim said the two suspects were walking southbound on Pines towards him. When they reached the victim, the white male asked him if he wanted to buy some cigarettes from him, to which the victim agreed. All three walked to the area of Riverside and Houk when the white male acted as if he was retrieving cigarettes from his coat. The victim took a ten - dollar bill out of his wallet. The white male grabbed the money from the victim's hand and punched him once in the face. The black male suspect also punched the victim once in the face and then both suspects took off running. Spokane Police K -9 Officer Craig Hamilton responded to assist. He and his K -9 partner tracked the suspects east on Riverside near an apartment complex at 110 N. Houk. Although they located items of clothing in bushes that the victim said the suspects were wearing, they were not able to locate the suspects. Crime Stoppers is offering a cash reward for anyone providing information leading to an arrest in this incident. Burglar Points Gun At Homeowner - Deputy Tom Walker responded to the 4200 block of N. Progress Road on a burglary in progress on a Sunday in mid - October. Deputy Walker contacted the victim who said he and his wife were backing out of the driveway when he saw a white Ford Taurus parked in front of his house. He thought the driver was using his cell phone and did not think much about it. When he came back from the store, his neighbor told him he thought the male and female occupants of the vehicle may have entered his home. The victim went inside and found his wife's purse was missing. The victim drove around the block and found the Taurus. He followed the vehicle into a cul -de -sac until the male driver pointed a gun at him. The suspect exited his car and began Page 6 walking towards the victim. The victim drove out of the cul -de -sac and saw the suspect drive away from the scene. The victim said the male was in his mid to late twenties, was white and had a tattoo of spikes on the left side of his neck. The female in the vehicle was also white and in her mid to late 20's as well. Crime Stoppers is offering a cash reward for anyone providing information leading to an arrest in this incident. Homeowner Detains Burglar — In late October, at 11:30 p.m., Spokane County Sheriffs Deputies responded to the 10000 block of East Sands Road in reference to a person with a weapon call. Deputies were advised the homeowner had caught a 19- year -old male subject attempting to break into his garage and had him detained at gunpoint. Deputies detained the male when they arrived on scene and located a black, full -face ski mask, a knife and other miscellaneous items on his person. The male suspect told deputies that his 18- year -old brother and their 18- year -old friend were with him and had fled the scene. A short time later, Deputy Dale Wells located the two 18- year -old suspects walking down Highway 27; both were taken into custody. The 19- year -old suspect spoke with deputies and said the three of them had burglarized two other residences that evening. He said he was not certain where the residences were located. There was a vehicle parked at the residence that deputies determined belonged to the suspect. They were able to see numerous food items inside the vehicle that included beef patties and a box of steaks. The vehicle was towed to the Sheriffs Office to be processed at a later time. All three suspects were booked into the Spokane County Jail on the felony charge of 2nd Degree Burglary. Spokane Valley Shooting Investigation — In late October, at 4:30 p.m., Spokane Valley Sheriffs Deputies responded to the 12700 block of East 31 st on a shooting call. Deputies were advised an adult male had been shot in the front yard of a residence and that the suspect was still on scene. Deputies arrived on scene and quickly detained the suspect. The victim was treated by Spokane Valley Fire personnel and transported to a local hospital where he succumbed to his injuries. The 22- year -old male suspect was arrested and booked into the Spokane County Jail that night for 2nd Degree Murder. Driver From Countywide Pursuit Arrested — In late October, at 8:30 a.m., Spokane County Sheriffs Deputies responded to Quartz Land and East Wandemere Estates Lane on a suspicious person call. Deputies searched the area for the suspicious person and eventually found a 36- year -old male near the area of Hastings and Guinevere. Since the male matched the driver's description from a pursuit earlier in the morning, Deputy Dale Wells was called to the scene. Deputy Wells had been behind the male suspect for approximately 30 miles during this morning's pursuit and saw his face multiple times when the male looked out the driver's side window back at him. Deputy Wells positively identified the male suspect as the driver of the vehicle. The male has a long criminal history that includes taking motor vehicles without permission, burglary, trespass, reckless endangerment, robbery and other crimes. The male suspect was booked into the Spokane County Jail on the charges of Assault 2nd Degree, Felony Eluding, Possession of a Stolen Motor Vehicle, Reckless Endangerment, and Resisting Arrest. Public Safety Message - The Spokane County Sheriffs Office would like to inform the community about an individual who has exhibited behavior that is concerning to law enforcement. Since 1997, a 55- year -old white male, who law enforcement is familiar with, has contacted numerous juvenile females and males throughout Spokane County. The majority of the time this individual contacts kids while they are walking down the street and regularly tells the females how pretty they are and asks young boys if they can help him find his dog. To this point, this individual's actions have not risen to the level needed to prosecute him for a crime. However, the Sheriffs Office feels it is extremely Page 7 important that the community knows we are aware of this activity and that we are documenting these events. This white male is bald and drives a mid - nineties Subaru station wagon. Once again, law enforcement has contacted this subject and is not looking for any information about who he is. With Halloween in mind, the Sheriffs Office would like to emphasize the importance of parents talking to their children about speaking with strangers. Also, if anyone has any interaction with any individual displaying this type of behavior, they should contact Crime Check at 509- 456 -2233. Spokane Valley Burglar Caught In The Act — In late October, at 10:30 a.m., Spokane Valley Sheriffs Deputy Chan Erdman responded to a vehicle prowling call near 4500 S. VanMarter. Dispatch said the complainant called in to report his work truck was broken into and several tools were taken. The complainant said the suspect left in a dark- colored Jeep Cherokee and provided a possible Idaho license plate. At about 10:35 a.m., Sgt. Dave Martin spotted a vehicle matching the description traveling northbound on Dishman Mica near 28th. Sgt. Martin and Deputy Jim Ebel stopped the vehicle at 4th and Dishman Mica and contacted the 32- year -old male driver. While Deputy Ebel and Sgt. Martin were speaking with the driver, Deputy Erdman returned to VanMarter to contact the complainant. He told Deputy Erdman he was replacing windows at a residence when the homeowner brought it to their attention someone was taking tools out of their van. The complainant ran outside and saw the male suspect leave in the Cherokee. He looked in his van and saw thousands of dollars' worth of power tools that had been stolen. Deputy Erdman gave the homeowner a ride to 4th and Dishman Mica where she positively identified the male suspect as the person who was in the victim's van. Deputy Erdman was also able to see power tools inside the suspect's vehicle matching the description the victim provided. Deputy Erdman gave the homeowner a ride home and when he arrived, dispatch advised there had been another burglary reported near the 3900 block of S. Woodruff Road. Deputy Erdman contacted the homeowner who told him he heard his dogs barking and looked out in the garage. He said he was holding his infant child and saw a dark- colored Jeep Cherokee parked across the street. He laid his child down, came back out to the garage, and saw the vehicle was gone. He looked around and saw he was missing a Skill Saw and a Spectra laser level both totaling $1,270 in value. Deputy Erdman returned to 4th and Dishman Mica. Deputy Ebel said the male suspect chose not to speak with him, but that the 28- year -old female passenger was willing to talk. She agreed to take Deputy Erdman to two locations the male had burglarized while she was with him. Without any input from Deputy Erdman, she drove him to both victims' homes where he had been. Spokane Valley Property Crimes Detectives served a search warrant on the vehicle and returned all the stolen items back to both victims. The male suspect was booked into the Spokane County Jail on the felony charges of Residential Burglary, two counts of 2nd Degree Theft, and a misdemeanor charge of Vehicle Prowling. After serving the search warrant on the Jeep Cherokee, Spokane Valley Property Crime Detective Roger Knight located a pawn slip that has resulted in identifying several snow blowers and generators that were stolen and pawned. He is asking the public to make sure they are not missing these items from their property. If they are, the public is asked to contact Detective Knight at 477 -3339; some type of proof of ownership will be required to redeem the property. Resident Catches Burglar — At the end of October, Spokane Valley Sheriffs Deputies responded to the 12900 block of East Cataldo on a Residential Burglary call. Deputies contacted the complainant behind his residence who had a 19- year -old male detained. The complainant told deputies that at about 9:20 p.m., he was watching TV in the living room when he heard the rear, unlocked sliding door open. He walked out to the kitchen and saw a blue piece of clothing run out the kitchen and exit the rear, slider door. He said he chased two subjects through two yards when he saw them try to hide under a truck. He said he tried to get them out from under the truck when one suspect ran from under the front of the truck. He was able to detain one male until law enforcement arrived. The male Page 8 suspect admitted to deputies that he and his friend did enter the residence through the back slider. He said they were in the residence looking to steal cigarettes and admitted it was "stupid." At this time, it is unknown who the second suspect was. The male suspect was booked into the Spokane County Jail on the felony charge of Residential Burglary. Burglar Gets Stuck In Shed — At the end of October, Spokane Valley Sheriffs Deputies responded to 17221 E. Broadway for a burglary -in- progress call. The complainant said she saw a male and female enter a shed on the church property then walk away from the scene eastbound on Broadway. Sheriffs Deputies Darell Stidham and Jeff Thurman arrived on scene and detained an adult female and a 43- year -old male east of the church on Broadway. Deputy Thurman detained the male who was holding a small box the complainant said he did not have prior to entering the shed, and Deputy Stidham detained the female. The female told Deputy Stidham she and the male suspect were walking through the church parking lot when he saw a tire pump next to a shed. She said the male suspect took the pump and put it in her backpack. She said the male suspect crouched down and tried to crawl under the locked door on the shed. She said she begged him to stay out and as he tried to push the door open, she tried to push it shut. At one point, she said he was able to reach under the locked door and take a pair of jumper cables and a can of fix -a -flat. She said the male crawled further under the door and grabbed a small box of battery acid. As he did this, he became stuck under the door and she had to pull him out. Due to her cooperativeness, she was not charged at that time. The male suspect was very uncooperative the entire time. He was booked into jail on the felony charge of 2nd Degree Burglary. GOVERNING LEGISLATION: PREVIOUS COUNCIL ACTION TAKEN: Street and Stormwater Maintenance Contract Approval on April 24, 2007, Contract Renewals in 2008, 2009, 2010, 2011, 2012, 2013 BACKGROUND: The City conducted an RFP process in March 2007. In April 2007, the Council awarded the contract to the lowest qualified bidder, which was Poe Asphalt Paving. This is the final year of this contract, and staff plans to put this contract out for public bids in 2014 for calendar year 2015 and beyond. Staff, along with consultants is developing an RFP to solicit bids for a new contract that will begin in 2015. This existing contract was for one year with seven one -year renewal options which may be exercised by the City. This contract is a Cost Plus contract, meaning we pay all direct costs plus an overhead and profit percentage (OH & P). There is a 22% OH & P on Direct Costs and 8% OH & P on Subcontractors. The 2013 contract amount was $1,506,663, which included $1,366,663 for Street and Stormwater Repair and $140,000 for snow removal. The 2014 Contract amount is $1,506,663, which includes $1,366,663 in Street & Stormwater Maintenance and $140,000 in snow removal. While the contract amount remains the same as 2013, the contract rates may vary depending upon the Contractor's negotiations with their labor union which may affect the amount of work performed. Staff will present an Admin Report on December 3rd. The Motion Consideration to authorize the city manager to sign this contract will come before council on December 17t ". It is important to have this contract executed by December 31 st because this contract supplies drivers for snow removal. We are currently working with Poe Asphalt Inc. to determine the hourly rates for 2014. The rates will be presented with the administrative report on December 3, 2013. Mr. Kulata confirmed with the Plaiming Commission that the October 241" Planning Comniission Meeting is going to be moved to October 30`x' at 6:00 PM. New Business: Marijuana Regulations Update: Planning Manager Scott Kuhta conducted a presentation of the Marijuana Regulations to (lie Planning Commission with the intent to familiarize them with 1 -502 and options for specific zoning regulations for recreational marijuana. Mr. Kullta went over the two different regulatory schemes, which are recreational marijuana and medical marijuana. The focus was more on the recreational marijuana — chapter 69.50 RCW (initiative 502) which was adopted by Washington voters in November 2012. Mr. Kuhta went thru the different licenses which are: producer license (growing), processor license, retailer license. Mr. Kulhta fisrther discussed the City's anaylsis of current zones where the niarijuatia activities under I -502 would be allowed. There was a general brief discussion between Planning Commission and Mr. Kuhta concerning the regulations. PUBLIC COMMENT: Solidus Sharp, 13310 E. Mission Ave. Broadway. Mr. Sharp had comments for the Planning Commission regarding, incorporating Data Visualization into the Comprehensive Plan. IX. COMMISSION BUSINESS A. New Business: Overview of the Spokane Valley Comprehensive Plan. Planning Manager Scott Kuhta conducted a presentation of the Comprehensive Plan applications for the 2014 Comprehensive Plan Amendment cycle, which are due November I, 2013. W. Kuhta's intent is to prepare the Planning Commission for the upcoming amendment cycle to the City's Comprehensive Plan and requirements for plaiming under the Growth Management Act. Mr. Kuhta went over the 2014 Comprehensive Plan Amendment Docket with Planning Commission. He stated that Spokane County is proposing an amendment for the parcel directly north of where their Scraps facility is going to be. They would like the zoning changed to allow a little bit more expansion for walking the dogs and for a meet and greet type of situation. Mr. Kuhta commented that we have heard rumors of a large change from low density to high density residential on the eastern portion of the City. He stated that all application has not yet been recieved, but one is expected to come in. Mr_ Kulita explained that there is one city initiated Comprehensive Plan Amendment that they wanted to put on as a placeholder, which needs more discussion with City Council before it's actually brought forward thrrr the process. It's a little piece of park land that the City owns. It is currently park property that may be part of a land swap, but currently is is not being used right now. This would be changed from parks and open space to a mixed - use center. Mr. Kulita wean over the text amendments that are largely housekeeping items. He stated the most significant text amendment would be light industrial policies. He added that we will be looking at the policies to see if they are suiting the City and if not we might want to make them a little more flexible with regard to allowances for uses such as for retail commercial type uses. Staff will have more discussion with City Council before a decision is made on how to approach the amendment. Mr. Kuhta commented that City Center reference will be removed from a number of the chapters in the Comprehensive Plan, at the direction of City Council. There was a general brief discussion between Planning Commission and Mr. Kuhta concerning the regulations. X. GOOD OF THE ORDER Commissioner Anderson expressed concerti about access issues with the Arger rezone before the Hearing Examiner, citing an article in the Spokesmen Review. The article reported that staff has given Mr. Arger two options for access, either from Alki or from Evergreen. Mr Anderson stated this contradicts testimony they heard from Mr. Palaniuk regarding the Alki right -of -way vacation in which Mr. Palaniuk stated Mr_ Arger would most likely take access to the parcel from Evergreen Rd.
