in' N.) KNOW ALL MEN BY THESE PRESENTS, that the Grantor, Market Pointe II, LLC, a Washington limited
0 liability company, for Ten Dollars and other valuable consideration, the receipt of which is hereby
• �0 acknowledged, grants to the City of Spokane Valley (Grantee), a municipal corporation in the State of
Washington, an Easement over, under, upon and across the hereinafter described lands situated in the
City of Spokane Valley, County of Spokane, State of Washington:

AFFECTS ASSESSORS PARCEL NO.: 45114.0205
The Drainage Easement granted to the City of Spokane Valley and its authorized agents is for the sole
purpose of allowing construction, operation, and maintenance of a stormwater treatment swale including
stormdrain piping and outfall; catchbasins and drywells; future underground irrigation waterline; and
electrical power and control wiring in underground conduit. The Grantor hereby agrees not to obstruct
access to the storm drain pipe, irrigation line and wiring to the above - described lands. The Grantor
hereby agrees to limit the improvements within the easement to landscaping consisting of grasses,
shallow- rooted shrubs, but not trees or deeply rooted plants. The Grantee will not be responsible for
replacement or repair of any improvements that the Grantor may place within the drainage easement, nor
shall the Grantee be responsible to repair, maintain, or replace any damage to improvements, other than

replacement of grasses and shallow- rooted shrubs that are damaged by work of Grantee in the easement
area, that the Grantor or assignees may place in the drainage easement if the Grantee, at its sole
discretion, replaces or repairs the stormdrain piping and outfall; stormwater treatment swale including
catchbasins and drywells; future installation or maintenance of underground irrigation waterline; and
electrical power and control wiring in underground wiring.
The City of Spokane Valley accepts complete and total responsibility for the construction and perpetual
maintenance of the public drainage facilities located within said Easement per City Project Number 0155
plans on file in the office of the City of Spokane Valley Public Works Department and as amended by the
Director of Public Works. The Grantee shall not be responsible to replace, repair, or maintain any other
improvements.
The Easement and the agreements and duties provided for herein shall run with the land and shall be
binding on, and shall inure to the benefit of the parties referenced herein, their heirs, successors and
