INVOCATION: Deputy Mayor Taylor gave the invocation.

COMMITTEE, BOARD, LIAISON SUMMARY REPORTS:
Councilmember Schimmels reported that he attended a fundraiser hosted by SCRAPS; Councilmember
Gothmann reported that he is maintaining good community contact concerning the proposed closing of
Pratt Elementary; and Councilmember DeVleming mentioned that he met with the SCAPCA Board where
board members are putting plans together for a retreat next week where they will work on drafting
bylaws.
MAYOR'S REPORT:
Mayor Wilhite reported that she also attended the SCRAPS auction fundraiser; she attended a Japanese
American citizen group luncheon; and attended a dinosaur presentation. Mayor Wilhite then read the
proclamation on "Child Abuse Prevention Month." Mayor Wilhite invited Ms. Murphy to speak
concerning the proclamation. Mary Ann Murphy, Chair of the Washington Council of Abuse and Neglect,
thanked Council for the opportunity to make this commitment to call everyone into action to make the
community safer and healthier for children, and explained that the pinwheel they are using, is a symbol of
the joy and innocence of the children.
PUBLIC COMMENTS:
Pat Breithaupt, 2002 S High Drive, Spokane, 99203: explained her problem in trying to relocate a
building through Millwood and down Trent in the Valley, and said that she came in January to determine
the procedure needed and feels the City of Spokane Valley does not have a clear cut plan to follow; and
she gave the City Clerk a handout from the Spokane County Air Pollution Control Authority, and also a

handout from Millwood. She further explained that this process her been very expensive, and that she
wound up waiting a month for a pre - development hearing. She said that she doesn't want to lose
everything for not moving the building, and feels there should be a way to handle this more expeditiously;
that they paid $50,000 to have the building loaded and ready to move, paid $9,000 for engineering
services, and over $100,000 for the building. In response to Council questions, she said that her engineer
was slow in working toward her goal; but that she still has not heard from all departments, such as fire.
She also said that the owner of a tavern which has a large double parking lot, said she could "park" the
building there while finishing this process. She also mentioned that her husband was told by our staff that
they could move forward if the plans were 95% complete, but no one could tell him what 95% completion
was. Councilmember Munson said he is aware that staff are working on this issue, and Mayor Wilhite
said she is also confident that they will hear something soon concerning this problem.
1. PUBLIC HEARING: Proposed Amended Budget — Ken Thompson
Mayor Wilhite opened the public hearing at 6:25 p.m. and invited Finance Director Thompson to explain
the proposed budget. Mr. Thompson reported on the necessary budget adjustments, as shown on his
Request for Council Action form, and in his PowerPoint slide, and stated that a first reading of the
ordinance is also scheduled later during tonight's meeting. Mr. Thompson mentioned that the figures do
not include $30,000 for additional review of projects, and that figure will be shown when the ordinance
comes back for a second reading. City Manager Mercier also stated that staff will be substituting an
attempted recruitment of a Professional Engineer (PE) rather than an assistant engineer, and attempting to
capture twenty hours of PE time to assist in review of capital projects; so this changes the designation of
someone we were hiring, and includes the half -time position, all of which would be funded from the
general fund. Director Thompson said the Finance Committee also considered these additions. Mayor
Wilhite invited public comment; no comments were offered and Mayor Wilhite closed the public hearing
at 6:31 p.m.
2. CONSENT AGENDA: Consists of items considered routine which are approved as a group. A
Councilmember may remove an item from the Consent Agenda to be considered separately.

Deputy Mayor Taylor asked that Consent Agenda item #d be removed to discuss separately. It was then
moved by Councilmember Munson, seconded and unanimously agreed to approve the Consent Agenda
with the exception of item d. Deputy Mayor Taylor then asked about the existing alley behind the
museum and of the intent of the vacation. Assistant Planner Kendall explained that this is an application
for a street vacation located south of Sprague Avenue, north of First Avenue, and west of Pines Road for
the vacation of a portion of the alley and concurrently, to dedicate the right -of -way for the purpose of
realigning the alley approximately 26 feet south of its existing location; and that the applicant proposes to
build a Rite Aid there, and tear down the existing building on the corner of Pines and Sprague all the way
to Dave's Bar. Councilmember Munson asked if there is a pending application to add those buildings on
the historic roster, and Ms. Kendall said she is not aware of any pending application, but that the Museum

is registered. Ms. Kendall stated that she contacted the state authorities to gather information, and it
appears that the applicant has only applied for a street vacation at this time, and has not applied for a
demolition permit. It was moved by Councilmember Gothmann, seconded, and unanimously agreed to
approve Consent Item #d.
NEW BUSINESS
3. Second Reading Proposed Ordinance 07 -004 Amending Purchasing Code — Cary Driskell
After City Clerk Bainbridge read the ordinance title, it was moved by Deputy Mayor Taylor and seconded,
to adopt ordinance 07 -004 as drafted. Deputy City Attorney Driskell explained that this ordinance has
not been changed since the first reading. Councilmember Gothmann said that this is one of the most
difficult ordinances he has seen in terms of trying to find anything; that it is very important as it provides
the basis for the public determining if we are fair with vendors; that he has trouble with the organization
and the subjects covered by the ordinance; that one cannot go to any section to find out what to do if you
sell things; and that it is poorly organized, and he suggested it be re- organized in three categories:
Architecture a& Engineering, Public Works, and Non - Public Works. Mr. Driskell pointed to the sections
which state the rules and policies, definitions, and purpose and use of the small works roster.
Councilmember Denenny said he has no problem with the organization of the ordinance and feels it is
well organized. Mr. Driskell also mentioned that several sections include language taken directly from the
state statutes. Deputy Mayor Taylor also voiced his opinion that he feels the changes are good, and he
supports the ordinance as is. Mayor Wilhite invited public comment. Tony Lazanis, 1626 E Empire: said
we need to make it simple so citizens don't have to hire an attorney to get the bid or use the process.
Mayor Wilhite invited further public comment, and no further comments were offered. Councilmember
Schimmels also voiced his opinion that he does not see a need for a change and therefore won't support
the ordinance. Vote by Acclamation: In Favor: Mayor Wilhite, Deputy Mayor Taylor, and
Councilmembers Munson, Denenny and DeVleming. Opposed: Councilmembers Gothmann and
Schimmels. Abstentions: None. Motion carried.
Mayor Wilhite called for a recess at 7:00 p.m.; and reconvened the meeting at 7:09 p.m.
4. Second Reading Proposed Ordinance 07 -006 Amending Public Record Ordinance — Mike Connelly
After City Clerk Bainbridge read the ordinance title, it was moved by Deputy Mayor Taylor and seconded,
to approve ordinance 07 -006. Deputy City Attorney Driskell said that recent changes in state law last
year prompted this ordinance, which will replace that which is currently in our code; and that this
ordinance is adopted after the Model Public Records Ordinance prepared by the Attorney General's
Office. He added that if the state legislature makes further changes, this ordinance can always be brought
back before Council for further revision. Mayor Wilhite invited public comment. Steven Pollei, 212 S
McDonald, said that he sent staff and council an e -mail discussing this topic, including the rules for civil
procedures and state statutes. Mayor Wilhite invited further public comment; no further comments were
offered. Vote by Acclamation: In Favor: Unanimous. Opposed: None. Abstentions: None. Motion
carried.
5. First Reading Proposed Ordinance 07 -007 Amending 2007 Budget — Ken Thompson
After City Clerk Bainbridge read the ordinance title, it was moved by Deputy Mayor Taylor and seconded,
to advance ordinance 07 -007 to a second reading on the April 24, 2007 Council agenda. Finance
Director Thompson explained that this is the ordinance which adopts the budget with the changes as he
previously mentioned, and that the additional $30,000 for engineering review will be included on the
ordinance when it comes before Council for a second reading. Mayor Wilhite invited public comment; no
comments were offered. Vote by Acclamation: In Favor: Unanimous. Opposed: None. Abstentions:
None. Motion carried.

6. First Reading Proposed Ordinance 07 -008 Amending Logo Provisions — Cary Driskell
After City Clerk Bainbridge read the ordinance title, it was moved by Councilmember Gothmann and
seconded, to advance ordinance 07 -008 to a second reading. Deputy Attorney Driskell explained the
proposed changes as noted in the strike - through, underlined copy, and added that staff will make a further
change to omit the words "or designee" in section A6, as the Code will be further revised later to include
general definitions. Councilmember DeVleming voiced his concern with the removal of the business
name Purrfect Logos, and Mr. Mercier responded that this is strictly for apparel, and if other businesses
approach the City we want to make the use of the logo nonexclusive; and that the logo apparel is only for
sale to City employees or City representatives, therefore we are not removing Purrfect Logo's ability to
provide that service, and that the primary purpose is to protect the application of the logo. Mayor Wilhite
invited public comment; no comments were offered. Vote by Acclamation: In Favor: Mayor Wilhite,
Deputy Mayor Taylor, and Councilmembers Schimmels, Denenny, Gothmann and Munson. Opposed:
Councilmember DeVleming. Abstentions: None. Motion carried.
7. Proposed Resolution 07 -004 Supporting Memorandum of Understanding for Foundational Concepts
for Managed Plan, Total Maximum Daily Load — Councilmember Denenny
It was moved by Councilmember Munson and seconded, to approve Resolution 07 -004 .Councilmember
Denenny explained that this resolution supports the Memorandum of Understanding (MOU) for the
foundational concepts for managed plan and total maximum daily load (TMDL); and in response to
questions, this does not tie this City to any future negotiations for rates, but only supports the MOU.
Mayor Wilhite invited public comment. Dick Behm, 3626 S Ridgeview Drive: said he has been involved
with this project since the mid - eighties, and he extended congratulations to the Council and in particular
Councilmember Denenny for all the hard work. Mayor Wilhite invited further public comments; no
further comments were offered. Vote by Acclamation: In Favor: Unanimous. Opposed: None.
Abstentions: None. Motion carried.
8. Motion Consideration: Snow Plowing Level of Service — John Hohman/Neil Kersten
It was moved by Deputy Mayor Taylor and seconded, to approve the level of service for snow plowing
and deicing as stated in the presentation that is about to be given. Public Works Director Kersten went
through his PowerPoint presentation which showed the snowplowing priorities and staff, equipment and
hours necessary to complete each area of priority. He explained that the level of service for priorities 1, 2,
and 3 would be limited operations for snow events ranging from one to three inches; plowing performed
as conditions warrant with focus on problem areas and hillsides; coordination with Police Department on
accident and problem areas, and full plowing for snow events exceeding a depth of four inches. For
priority 4, Mr. Kersten said that residential streets on the valley floor will only be considered for plowing
when functional traffic flow is substantially inhibited. For ice control priorities 1, 2, and 3, there will be
limited liquid deicing giving priority to snow events on bridges and primary intersections; solid granular
deicer will be the primary deicing method for streets and intersections and will begin as soon as there is
snow accumulation on the roadway, and there will be limited sanding and liquid deicing during snow
events, usually limited to intersections, hills, and corners. For ice control priority 4, Mr. Kersten said that
deicing and sanding will not be conducted on residential streets on the valley floor except at controlled
intersections and selected problem areas. Mr. Kersten also said those procedures will also be used
depending on the weather forecast. Mayor Wilhite invited public comment.
Ed Weipel, 716 E 10th Avenue: said where he lives, sanding his street is a waste of money as it only
speeds up traffic.
Tony Lazanis: said he wants to know how much money was appropriated for the year and how much was
spent; and do we share maintenance of the equipment. Mr. Kersten said we share the equipment, and pay
for the equipment based on a hourly rate which includes maintenance and fuel; and that the total annual
budget was in the range of $600,000 to $700,000; that that we spent about $300,000 this year.

9. Motion Consideration: Authorizing Negotiation of Street Maintenance Contract —Neil Kersten
It was moved by Deputy Mayor Taylor and seconded to authorize staff to proceed with negotiations with
Poe Asphalt Paving for street and stormwater maintenance and repair. Public Works Director Kersten
explained the proposal as noted in his Request for Council Action form, and said that we received two
responses to the Request for Proposals, and after conducting interviews, both companies are very strong,
but the selection committee unanimously agreed that Poe provided the most responsive proposal and
interview. In response to Council questions concerning cost and what we paid the County, Mr. Kersten
said this is what we had budgeted and would like to have paid the County, but they no longer provide
these services. Mayor Wilhite invited public comment; no comments were offered. After discussing the
differences in companies, and that Poe doesn't run overtime, Council voted by Acclamation: In Favor:
Unanimous. Opposed: None. Abstentions: None. Motion carried.
9a. Mayoral Appointment: Public Transportation Improvement Conference (PTIC) — Mayor Wilhite
Mayor Wilhite explained that the Spokane Transit Authority is asking for an appointment for this year's
Public Transportation Improvement Conference, and that she would like to appoint herself to attend that
meeting. It was moved by Deputy Mayor Taylor, seconded, and unaniinously agreed that Mayor Wilhite
be appointed to as the representative to this year's Public Transportation Improvement Conference.
PUBLIC COMMENTS: Mayor Wilhite invited general public comments.
Dick Behm, 3626 S Ridgeview Drive: spoke concerning the condition of the roads, and he commended
Mr. Kersten and his staff for the road maintenance they have accomplished.
ADMINISTRATIVE REPORTS: None
EXECUTIVE SESSION: Land Acquisition
It was moved by Deputy Mayor Taylor, seconded and unanirnously agreed to adjourn into executive
session, after a five minute break, for the purpose of discussing partial land acquisition; that Council will
reconvene not more than thirty minutes; and that they anticipate some action will be taken when Council
reconvenes. Council adjourned into executive session at 8:00 p.m. after taking a five- minute break.
Mayor Wilhite declared Council out of executive session at 8:26 p.m. There was no action proposed and
it was moved by Councilmember Denenny, seconded, and unanimously agreed to adjourn.

On March 12, 1998, new asbestos regulations
became effective throughout Spokane County.
This information sheet is provided by the
Spokane County Air Pollution Control
Authority ( SCAPCA) as a brief summary of
SCAPCA's regulations pertaining to renovation
and demolition activities The following
information is a quick overview and is not
intended to be a substitute for SCAPCA

Basic Requirements for
Commercial Renovation
and All Demolition
A survey for asbestos- containing material (ACM)
must be performed by an Asbestos Hazardous
Emergency Response Act (AHERA) inspector
prior to undertaking a renovation or demolition
project_ A copy of the asbestos survey must be
made available for SCAPCA inspection personnel
at all rimes at the project site.
In addition, SCAPCA must be notified in
advance, on its agency-supplied forms, of any
asbestos project (construction, demolition,
renovation, repair, or maintenance) and whenever
a structure will be demolished.
cCAPCA's regulations define a demolition
aject as the wrecking, razing, leveling,
dismantling, or burning of a structure (by a fire
department for training purposes), thereby
making thc structure permanently uninhabitable
or unusable. A fee must accompany the
notification.
Only those persons certified by thc Washington
State Depamnent of Labor and Industries (I.&I)
may strip, remove or disturb ACM. ACM must
be removed in accordance with applicable
regulations and must be disposed of at approved
waste disposal sites.

Additional Requirements
In addition to SCAPCA requirements, most
building departments require a renovation and
demolition pertrut (separate from SCAPCA's
Notice of Intent). I,&I has asbestos survey,
notification, and temoval standards (WAC 296-
62, 296 -65, and 296 -155) and the local Fire Mar-
shal may also require notification for asbestos
removal (Uniform Fire Code section 8707).
Rather than requiring a separate notification
form, the Fire Department requests that a
copy of the L&I notice of Intent to Remove or
Encapsulate Asbestos be faxed to them at (509)
625 -6995. Please contact thc appropriate agency

under government listings.

SCAPCA was established in 1969 under the
authority of the Washington Clean Au Act.
SCAPCA is a local governmental entity
responsible for regulating the release of pollution
to the outside au. The agency enforces federal,
state, and local air pollution regulations in the
incorporated and unincorporated areas of
Spokane County.

TOWN OF MILLWOOD
APPLICATION FOR BUILDING PERMIT
Permit Fee: Based on valuation. Other fees may be required.

NOTE: All properties shall be connected to the municipal sewer system prior to the
issuance of a building permit.
This Building Permit application must be completed in full. This Building Permit
application along with the required drawings must be submitted to the Town of Millwood
as the application package.
Information Required by the Applicant:
The following information is required for the application to be considered complete.
Missing information will delay the permit process.
PROVIDE THREE COPIES OF A SITE PLAN OF THE PROPOSAL DRAWN TO
SCALE WITH THE FOLLOWING INFORMATION:
a. Scale of the drawing (1:20, 1" = 20' minimum)
b. Paper size is no greater than 11" x 17"
c. North arrow
d. Property lines and dimensions
e. Widths and names of closest rights -of -way
f. Location of easements, if any
g. Exact location and size of all existing and proposed structures
h. Height of all structures, both existing and proposed
i. Water and sewer line locations
j. Topography of the site with elevations if the site contains slopes > 20%
k. Ordinary High Water Mark of the Spokane River, if applicable
1. Landscaping, if required
m. Parking and/or driveways if paved or required
PROVIDE THREE COPIES OF COMPLETE STRUCTURAL DRAWINGS:
These shall include all elements as required by Spokane County Division of
Building and Planning.
NOTE: FOUR COPIES OF STRUCTURAL DRAWINGS WILL BE REQUIRED
IF THE PROPOSAL IS A FOOD SERVICE.

Within 28 days of the receipt of the completed application package, the package is
reviewed and the Town of Millwood issues a "Notice of Completion and Consistency" to
the applicant. The Notice of Completion and Consistency indicates if further information
is required from the applicant, and whether or not the application is consistent with the
Millwood Municipal Codes.
Process:
STORMWATER DRAINAGE SYSTEM SUBMITTAL: Certain projects will require
plans for the accommodation of stormwater. If stormwater plans are required the
applicant will be notified and the Town will provide information.

If the application package is complete and the proposal is consistent with Millwood
Municipal Codes, then the applicant is responsible for submitting the Millwood- approved
application packages to the Spokane County Division of Building and Planning for
structural, mechanical, and plumbing review. Spokane County collects separate plan
review, plumbing, and mechanical permit fees from the applicant at this time. Electrical
permits are obtained from the Washington State Department of Labor and Industry.
The applicant shall not change the Millwood - approved plans in any way. If Spokane
County requires structural revisions, the applicant must notify the Town. If the applicant
chooses to revise the proposal after Millwood has approved the application package, the
applicant must return the entire application package to Millwood for review. All
revisions shall be indicated appropriately on the original cover sheet and revised pages
shall be placed behind the page being revised.
The applicant shall return to Millwood, a minimum of two of the application packages.
These two application packages shall be intact and shall have both the original Town of
Millwood stamps and the original Spokane County stamps. Copied documents are not
accepted. The applicant may be required to submit additional copies of the application
package to other agencies.
When the applicant has returned the stamped application packages, Millwood reviews the
application packages for Spokane County remarks and changes. Millwood retains the
original application package marked "Town of Millwood." When the applicant pays the
Building Permit fee and any other owned fees, the Town of Millwood issues the
building permit.

If the structure will be sited in the Town of Millwood then this application must
include a site plan and an elevation drawing for the proposal drawn to scale, which
contain: the scale of the drawing (must be a usable scale i.e. 1:20), north arrow, site area
with property lines and dimensions, widths and names of closest rights -of -way, location
of easements if any, exact location and size of all existing and proposed structures, height
of all structures both existing and proposed, topography of the site, water and sewer lines,
the Ordinary High Water Mark of the Spokane River if applicable, landscaping if
applicable or required, parking areas and driveways if applicable or required.
