v,icated property; that a record of survey shall be submitted to the Uirector of Communily Development
and that all direct and inclirect eosts of title transfer to the vacateci stree[ be paid by the proponenC or

'ArRL-REAS, the City Council pursuant to RCW Chapter 35.79 and Title 10 Article 1X Section
10.09.04.10 of the Spokane Valley Municipal Cocfe desires to vacate the above sfreet 3s set forth he•rein.
\TOW, TI-IERLFORE, ihe Ciry Council of the City of Spokacle Vsl!ey, Spokane County, Washinyton, do
ordain as follows:
Section 1. Findinas nfFact. The Gity Council makes the following findings of fact; (1) the
City Department of Nublic Works hds reviewed the right-of=way to he vaeated and determined that the
property adjacene to the vacateci property is ocherwise seived by public or private access; (2) a public
hearina on the proposed vacation has been held in accardance with State Law and City Ordinance before
thc Planning Commission with the record of such hearing and praceeclings lodcred with the City C]erk; (3)
a written protest has not been filed with the City Clerk by at (east fifly percent of the abutting property
owners; and (4) vacation of the street or alley serves the public interest.

Section 2. Provertv to be Vacated. Bas£d upon the above findings and in accordance with
this ordinance, t}ie Ciry Council does hereby vacate the street or alley clescribed on the attacheci Exhibit
"A" which is incorporateti herein by referenee.
Section 3. Zoning. The 'Lon.ing designacion for (he vacated property shall be the designation
attached to the adjoining properties as set forth within the respective property or lot lines. The lairector of
Community Development is authorized to inal:e this notation on the official zoning map of the City.
Section 4. Condidons of Vacation. '1'6e following conditioas shall be fully satisfieci prior to
the cransfer of title by the City.
a) A record of survey prepared by a registered s«rveyor in the State of Washington and
ineluding aii e:cact metes ancl bounds legal description snd specifying if applieable any
and all easements for construction, repair and maintenance of e;cisting and future ukilities
and services. the record of survey shAll contain the professinnal stamp and signature of
the registered survcyor and should be filecl upon completion tvith the Spokane County _
Auditor. The survcyor shall provide the City of Spol:ane Vallcy witit fl mylar copy of the
recor(led survey anci the Auditor's Document iNumber and date of recorclation; and
b) Placement of at least two monuments on the centerline of the vacated ribht-of-way with
orie located at the intersection of the centerline oF the vacated right-of-way with each
street or right-of-way in accordance with the standards established by the Spokaire
County Stundards for Rnad m7d Sewer Constrtectior,i; and
e) Payment of all direct ancl indi.rect costs of title transfer of the vaaated street or alley from public to private ownership inclucling but nat limited to tit(e compsny charges, copying
fees, and recording fees; and .
Section 5. Closine. Fallowi.ng satis.faction of the abovc conditions, the Ciry Clerk shall
record a certified capy of this Ordinance in the office of the Ceunty Auditor and the City Manager is
authorized to execute all necessary docLiments, including a Quit Claim Deed, i.n order to complete the
transfer of the prnperty iclentified herein.
Sectioii G. Severabilitv. If any section, sentence, clause or phrase of kllis Ordinance shall be
held to be invalid or uneonstitutional by a court of competent juristliction, such invalidity or
unconstihitionality shall not affect the validity or constihrtionality of any other section, senteoce, clause or
phrase of t.his ordinance.
Section 7. Eff.ective Date. This Ordinance shall be in full force aild effect Cve (5) days after
publication of this Orclinanec or a summary thereof in the official newspitpcr of the City of Spol:ane Valley as provided by law.
