Based upon the above findings and in accordance with this ordinance, the City Council does hereby vacate the street or a(ley described on the attached Exhibit "A" which is inr,orporated herein by reference. Section 3. Zorting. The 7oning designation for the vacated property shall be the ciesignation attached to the adjoining properlies as set forth tvitUin the respective property or lot lines. The Director of Commuriiry Development is authorized to make this notation on the o{ficial zoning map of the City. Section 4. Conditions of Vacation. The following conditions shall be fully satisfied prior to the transfer of title by the City, a) A reeord of survey prepared by a registerecl survc}ror in the State of Washington and including an exact metes and bounds legal description and specifying if applicable any and all easements for construction, repair and maintenance of existing and fuhlre utilities of and services. the record of survey shall concain the profcssionat stamp and signature , the registered surveyor and sbould be filed upon completion «rith the Spokane County Fiuditor. Thc sunleyor shall provide the City• of Spokaiie Vallcy witti a mylar copy of the recorded survey and the Auditor's Document Number and date of recordatinn; and b) Placement of at least tkvo monuments on the cencerli»e of the vacatecl right-of way with one located at the intersection of the centerline of the vacated right-of-way with each street or right-of-way in accordatlce with the standards established by the Spokane Coamty Standards fpr Road crnd Sewer C'onstruction; and c) Payment of all dircet and indirect costs of title transfer of the vacated street or alley from public to private owncrship including but noc limited to title company charges, copying fees, amd recording fees; and • Sec6an S. Pollnwing satisfaction of the above conditions, the City Clcrk shall record a certified copy of t:his qrciinanee in the office of the County Auditor xnd the City lVlanager is authorized to execuce all necessary dacuments, including a Quit Claim Deed, in orcfer to complete the tTansfer of the properCy identif ed herein. Section 6. Seversbilitv. If any section, sentence, clause or phrase of this Ordinalce shall Ue held to be invalid or uilconstitutional by a court of comnetent jurisdiction, such invalictity or unconstitutionality shall not affect the validity or constihitionality of any otlier section, sentence, clattse or phrase of this ordinance. Section 7. Effective Dace. This Ordinznce shall be in full force and effect fve (5) clays af~ter publication of this Ordinance or a surrunary chereof in the oEicial newspaper of the City of Spokane Valley as provided by law.
