Wf-I.ERCAS, the City Council by Resolution 05-004 initiated vaaation proceeclings for a portion of Knox
Avenue west of Locust Street by pro<<iding tllat a hearing on the proposal woulct be held before the
Planning Commission on the 28th day of r'lpril, 2005; and
Wf-IEREAS, the Planiiing Commission held a public hearing on April 28h, 2005 0ii the proposed
vacation; and
W7-IEREAS, following a liearing, the 1'lanning Cornmission foiEnd that fouiid the notice ctncl hearing .
requiremen2s of Title 10 Flrticle 1;C Section 10.09.04.10 of the Spokarie Valiey ivlunicipal Code havc been
met, and further found: that
' The vaeatinn of die street/ailey will pei-init full development of the property for benefcia1 uses
and permit appropriate levels oF maintenance.
2. Knox Avenue is no longer required for public use or public access;
3. The substitution of a new and different public: way is neither necessary nor feasible. -
4. Given the present age and condition of adjnaent dcvelopment, iE is unlikely Ihat conditions will
change in the future to provide a greater use or need t:han presently exisis;
5. Abuttirlg property w-vners havc acquired dtle to a portion of the original right-of way of Knox
Avenue by sepaeate land use acdons; and
WNFRF.AS, the Planning Commission findings and/or minutes have been fleci with the City Clerk as
par[ of the publ ic record s«pporting the vacation;
NVHEFt.EAS, fifty pereent of the peoperly owners abutting thc property to be vacated did not file a written
objection io the proposed vacation with the City Clerk;
W1-TFREAS, through ordinance the City sliatl provide that the vacatecl properiy be teansferreci CU the
abutting property owners, one-half to each, unless circumstances require a different division of properCy,
that the zoning district dESignation of the properties adjoining each sic4e of the street shall attach ro die
vacated property; ehat a record of survey shall be submitte<i to the Director of Commimity Development
and that al) direct and indirect costs of tiile cransfer to the vacated street be paid by the proponent or
recipient of the transferred prqpercy;
WIIEREAS, the Ciry Council pursuant to RCW Chapter 35.79 and "I'itle 10 Article 1X Section
10A9.04. 10 of the Spokane Vallcy Municipal Code desires to vacate the above street as set Forth herein.
NOW, THEREFORE, the City Counci) of the City of Spokane Valley, Spokane County, Wasliington, cie
ordain as follows: , Section 1. Pindines of Fact. T1te City Council Enakes the followi3ig findings of fact: (1) the
City Department of Public Works has reviewed the rip
,ht-of way to be vacated and deterrnined that the
property adjacent to the vacated property is otherwisQ servea by public or private access; (2) a public
hcaring on the propased vacation has been held in accordance with State I,aw and City Ordinance before
the Planning Commission with the recard of such hearing and procccdinss lodged with the City Clerk; (3)
a written protest has not been filed wich the City Clerk by at least fifty percent of the abutting property
owners; anci (4) vacation of'the street ar alley serves the public intcrest.

Section 2. I'rooertv to be Vacated. $ased upon the above findings and in accordance with
this nrdinance, the City Council does hereby vacate the street or alley described on the attached Exhibit
"A" which is incorporated herein by reference.
SecHon 3. Zonine. The Zaning designation for the vacated property shall be the designation
attached to the adjoining properti.es as set forth within the respective property or 1ot li.nes. The Director of
Community Development is authnrized to mitke this notation on the of.ficial zoning map of the City.
Section 4. Conditions of Vacation. The following conditions shall be fu(ly satisfied prior to
the transfer of title by the City.
a) A record of survey prepv-ed by a regisl:ereci surveyor in the State of Washington and
including an exact metes and bounds legal description and specifying if applicable any
and all easeinents for consh-uction, repair and maintenance of existiug and furiire utilities
snd setvices. the record of survey shall contain the profcssional stainp and signature of
the registered surveyor and shoulct bc filed upon completion with the Spokane Counry .
Auclicor. The surveyor shall provide the City of Spokane Valley wiCh tt mylar eopy of't}ie
recorded survey and die Auditor's I7ocument Number and date of rccordation; and
b) Placement of at least hvo monuments on the centerline of the vacated riglit-of way with
one lociitet1 at the interscction of the eenterline of the vacated right-of-way with each '
street or right-of-way in accordance with the standards established by the Spokane
" CourrN Standards for Road cv7d Setver Constructiot7; ari d
c) Payment of all direct and indirect costs of title transfer oF the vacated street or alley froai •
public to private ownership inclucling but not limited to title company charoes, eopying
fees, and recording fees; and -
Seetion S. Closing. Following satisfaction of the above conditions, the City Clerk shall
record a certified copy of this Orclinance in the office of the County Auditor and the Cily Ivfanager is
auchorized to execute all necessary documeuts, including a QLiit Claim Deed, in order to complete the
trausfer of the peoperty identified herein.
Sectinn 6. Severabilitv. If any section, sentence, clause or plirase nf this Orciinance shall be
helcf to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstihitionality shall not affect the validity or constitutionality of any other section, sentence, cl3use or
phrase of this ordinance.
Seetion 7. F-ffective Date. This Ordinanc-e shall be in full force 4tnd effecl fivc (5) days after
publicatinn of this Orclinanee or a sumrnary thereof in the official newspapar of the City of Spokane •
