WAEREAS, pursuant to the provision5 af RCW 36.32.120(6), the Qoard of County
Commissioners oE' Spokane County (hereinafter somelimes referred to as the "Board") has the care of
County property and the management af Counry funds and business; and
WHFREAS, pursuant to the provisions of RCW 36.34.290 the Board of County Commissionees
may dedicAte any county 1and to public use for public strects and alleys in any city or town; and
WHEREAS, lhat portion of Appleway Avenue from Tschirley Road to I-lodges Road abutting
the former Chicago, Milwaukcc, St. Paul and Pacific Railroad righ4 of way has been funded for
reconstruetion within the City of Spokane Vallcy under Ciry of Spakxne Valley, Appleway Project No.
STPUL-3842(002); and
WHEREAS, thc City of Spokane Valley has formally requested the dedication of a portian of the
former Chicago, Ltilwaukee, St. Paul and Pacific Railroad right of way which is adjacent to Appleway
Avenuc from Tschirley Road to }•Iodges Road within the City of Spnkane Valley in conjunction with
Appleway Project No. STPUL-3842(002) which is needed for constructian purposes and to provide for
Icgal access for the travcling public; anci
WHEREAS, ihe Spokane County Engineer, consistent with the rcquest of the Ciry of Spokane
Valley referencecl in the immediatcly preceding recital deems it in the hest interests of the public that thc
prnperty described in the immediately follow recital be dedicated to the City of Spokane Valley for streets
and recommcnds approval of this dcdication for roaclway purposes; and

THEREFORE BE IT RESOLVED by the Board of County Commissioners of Spokane
County, Washingion, pursuant to the provisions of RCW 36.32.120(6) and RCW 36.34.290, that the
Board does heteby approve the recommendation of the County Engineer and that the aforementioned
legal descriptinn of Counry General property (the "Property") be dedicateci to the City of Spokane Valley
for right of way purposes subject to:
(1) Spokane Counry retaining a perpetual casement in the Property to operate, repair,
eonstruct, and reconstruct its sanitary sewer lines, together with any and all necessary
appurtenances thereta, over, across and under the Property, arld
(2) Spokane County shall retain frcc, open and unobstructed right of ingress and egress to
the Property Por access to the sewer system and to other parcels ownecl by Spokane
County abutting the Property and shall also retain the right tq maintain and re-
establish the access rUad an thc Property for the aforemcntioned purposes; and
(3) Thc City of Spokane Valley will not cause or 1Uow to be caused any damagc to thc
sanitary sewer lines, their appurtennnces and access road to thc Property. Thc City of
Spokanc Valley understands that any such damage is the sole responsibility and
liability of the City of Spokane Valley.
