hereinafter referred to as the "project") .
KNOW ALL MEN BY THESE PRESEiNTS, that the Grantor(s), Trent Investments, LLC ,
for and in consideration of mutu.al benefits, the receipts of which is hereby acknowledged,
watrauits and conveys to City of Spokane Valley, a municipal corporation of the State of
Washington, an EASEMENT over, upon, and across the drainage area, legally described in the
attached Exhibit ~,B and - - - .
The Easement granted to the City of Spokane Valley, and its authorized agents, is for the purpose
of allowing starmwater drainage andlar runoff over and across the above-described lands,
including but not limited to disposal into a drainage facility located witlun the same above-
described lands. The Grantor(s) and/or their successors in interest hereby agree not to obstruct,
artificially collect or discharge the flow across or adjacent to the above described lands. The
Grantor(s) and/or their successors in interest agree that the City of Spokane Valley accepts no
responsibility for maintaining this Easement. The Gmntor(s) hercby accept complete and total responsibility for the construction of all related
drainage facilities located within this Easement per the accepted civil and drainage plans on file
in the office of the Development Engineering Division, including but not limited to all drainage
facilities necessary to convey, direct or route the stormwater runoff to said drainage facility or

facilities. The Grantor(s) andlor their successors in interest hereby accept complete and total
-responsibility for the perpetual maintenance of the Facilities located with.in thas Easement In
addition, the Grantor(s) and/or their successors in interest, where applicable, shall maintain the
drainage area with apermanent live ground cover, which may include shrubbery and/or h-ees, so
long as they do not obstruct the flow and percolation of storm drainage. If the Geantor(s) and/or
their successors in interest fail to maintain the facilities, a notiee of sueh failure niay be given to
the Grantor(s) and/or their successors in interest. If not conectecl within the period indicated on
said notice, the City of Spokane Valley has the right to correct thc maintenance failure, or have it
corrected, at the expense of the Grantor(s) and/or their successors in interest.
The Grantoc(s) and/or thcir successors in interest hereby release the City of Spokane Valley, and
all of its officers, employccs and agents from any responsibility or liability for any damage
whatsoever including inverse condemnalivn by or to any and all persons or property arising out
of or in any way incident to or attributnble to the storm drainage within thc Easement.
This Easement described herein above shall run with the land. No modificalion of the boundaries of said Easement can be made without prior approval of the City of Spokane Valley.
