Planning Commis sion Recommendation: Approve, to Local Busines s Zone ,

1. Dedication and improvement of the East 5' of the advertised property
along Moffitt Road for R/W. (Improvements shall include curb,
drainage control, and paving to existing oil.)
2. Dedication and improvement of the West 5' of the advertised property
along Gillis Road for R/W. (Improvements shall include curb,
drainage control, and paving to existfng oil.) .
3. Dedication of 20' radii at the northeast corner of Gillis and Sprague
and the northwest comer of Moffitt and Sprague.
9. The site shall be developed in substantial conformance with the
development plan on file with the application; i, e., existing and
proposed office structures on the west portion of the site, retail
space in the center of the site, and a restaurant in the east portiori
of the site. Provisions shall also be made to comply with the set-
backs and parking requirements of the Local Busines s Zone. Signing
shall be installed in accordance with Section 4.09.125 of the Spokane
Courity Zoning mdinance.(Local Business signing requirements.)
S. Any parking area exceeding a six (6) car capacity shall provide a
screen forty-two (42) inches in height along the periphery of the
parking area adjoininq any residential zone. Such screen shall Lc:
constructed of ornamental masonry. The Planning Director may
approve an ornamental fence or a planted screen in lieu of said
ornamental masonry wall.
6. The design location and arrangement of parking stalls and driveways
shall be in accordance with standard traffic engineering practices.
Any portion of the lot which is to be driven on by automobiles shall
be rr:aintained in hard-surface paving.
7. Parking areas between the proposed buildings and the north property
line shall be unlighted, except that walkways, driveways, and land-
scaped traffic islands may be illuminated by low intensity lighting

B. Reasons:
1, Adjacent Sprague Avenue frontage properties to the east and west
are zoned Commercial.
2. The multiple family project to the north provides a significant Luffcr
area between the Sprague Avenue frontage properties and the
residential neighborhood to the north.
3. The applicants have submitted a specific development proposal
which includes office, retail, and restaurant uses. The Planning
Commission has recommended certain development standards such
as: paving of off-street parking areas, landscaping, screening,
lighting, etc., which should insure compatibility with surrounding
residential uses.
4. The Commission notes that the signing restrictions of the Local
Business Zone in conjunction with the suggested development
standards will allow utilization of the property in accordance with
the planning objectives of the Residential Office Zone.

Dear Mr. Wolff:
I understand thafi you hava requested a letter concerning tr,e fencin5
of the Taco Bell site within the Local Business Zone at the northwest
corner of Sprague Avenue and Moffitt Road. Your attention should be
directed to Condition 2 of Rosolution 3-221 of the Board of County
Commis sioners: Any parking area exceedirrj a six (6) car capacifiy shall
provide a screen forty-two (42) inches in height alona the
periphery of the parking area adjoining any residenti
zone. Such screen shall be constructed of ornamental
masonry. The Planning Director may approve an ornamentUl
fence or a planted screen in lieu of said ornamental
masonry wall.
This same condition appeared in the Minutes of the County Planning
Commission February 18, 1972.
The zoning map indicates that the property immediately to the north of ti;e
Taco Bell parking area on the approved plot plan is in the Multiple Family
Suburban classification. This is two-hundred (200) feet north of Your soutl-i
property line. Thus, as indicated in the above resolution, fencing sha11 b
e
installed from the east to the west property lines.

Attached please find the original plan submitted to the planning
corrmission on the above identified property indicating 7000 square

land. The new plan indicates that we have acquired 37% more land and
request a reduced arnount of building--about 66% of the proposed. In
MoNrGAr,E other words we have i ncreased 1 and, decreased amount of bui 1 di ng, i n-
creased parking and open spaces, and decreased the percent of land
covered. From all of these aspects it would seem that the new plan,
from a planner's standpoint, would be more amenable than the original

^..'F•lVAGEMENT plan accepted by the pl anni ng carmi ssion. Of course the obvi ous
difference is that now instead of one great big building on the site,
as originally proposed, we have two little buildings on the site in
this new plan. Again, however, the agregate square footage of the
~ two little buildings is just a little more than half the square footage
originaliy proposed in the one big building.
, Futhermore, as we proposed in the original submission 8,000 square feet
of new retail space, that portion of the property together with the
, existing medical building to the West has been purchased by Or. Ryan.
His plan rather than to build new retail space, is to build a twin
I building, sometime in the future, along the same lines as the
existing 3200 square foot medical building. This again is a reduction
in the amount of square►footage to be built, a reduction in the intensity
I of use and an increase in the open area; all of which appear to apply
~ to the rules of better planning.

In sumnary then we have increased the amount of land relative to the
original proposal and substantially decreased the amount of building.
On the specific portion of property under consideration we have held
with the same usage, i.e. a restaurant, however, we are now putting
that usage into two littler buildings instead of one larger onc.
I mi5ht make one la;t point, ihat being thaL at the time Ure submitted
the original land use proposal, the site abutted a single family
residence use. At this point in time we have acquired that singic
family residence property. The portion of the land identified a!z
the Taco Bel l section does not abut any single fami ly residence

you to take those steps necessary under a variance action to enabl(~
this property to be used under these conditions.

the needs of families, students and working peoplc who enjoy eating out
in an attractive, wholesome atmosphere offering good service and tasty
