Additionally, they are qovern- ed by specific and necessarily implied provisions of said enabling statutes and zoninq ordinances. The usual powers of Boards of Adjustment and like bodies relate to the particular cases before them. Such powers necessarily include the power to authorize, deny or in a few instances recommend for nr_ aqainst variances, non-conf_orminR iises and nermits. Furthermore, such Boards are said to have the inherent power in connection with pP_Y"nllt5 and variances to impose reasonable conditions and restrictions dirpctl-t, related and incidental to the proposed use of the propertv and which are not inconsistent with the applicable zoninq laws. See Besselman v. Moses Lake, 46 Wn.2d 279, 280 P.2d 689; State ex rel My'~ire v.s Spokane, 70 Wn.2d 207, 422 P.2d 790 (196T);`Chrobucc-v. Snohomish Countv, 78 Wn.?_d 8 5 8 ; 488 P. 2d 489 (1971),- This ability to imros~- reasnnihle cnnditiar.-; is one held not only by the Board of Adjustments and the zoning Adjuster but additionally by the Spokane Countv Planninq Commission. Accordingly, it appears that thP "reasonable conditians" that either the Board of Adjust- ments or the Spokane County Planning Commission can impase upon applicants in effect become an "im•~l ~od" ter-n of the 7onirq orc?inan(-r- itself. With this backrTround in mind we must necessarilv now turn to Chap. 4.25 (Board of Adjustment) of the Sookan- County Zoning nrdinancP. Therein Sect-i on 4. 25. 030 pmvidPcz ;:~nd I quote for ease of reference: "The Board of Adjustment, subject to appra- priate conditiona and safequards as nrovided hy this t1_t1P_ , shall herei.n decide: a. . . . . variances. Application for variances from the terms of the Zoninq Ordinance; pro- vided that any variance granted shall be ,ubject to such conditions as will assure that the adjustment thereby authorized shall not constitute the grant of special nrivilege inconsistent with the limitations upon other propertiAs in the vicinity and zone in which the subject property is situated, and that the followina circum- st-ar.ces are founc3 to anplv : . . . " Fr'Om the above qunted statutory section the Board of Adjust- ment has the authority to grant variances from the terms of the zoning ordinance. 4ne of such said terms can_Fe the conditions which are necessarily imposed by the Board of County Commissioners in approvinq a zone change. Therefore, in answer to question 1 as set forth above, the Zoninq Adjuster and/or the Board of Adjustment do have the authority to grant a variance from a condition imposed by the Boarc3 of Countv Co*►tmic!sior,prs unon thei r anoroval of a zone chance, QUFSTION Initially, I might make mention of the four cases cited by Howard An(lPrson in his letter of Dec?mber 10, 1973. - - ~ . A11 four of the cases dealt wi tti setback requirements as established by zoninq or.dinances. The majority of the cases concerned appeals either by the petitioner or the surrounding residences on the denial or grant of a variance relating to a setback rectuirement. In each instance, the court held that if there were a setback, that the setback must have a reasonable relationship to the health, safety and welfare of the inhabitants and that if it did not that the ordinance itself providing for such setback was unreasonable, improper and illegal as to that- piece of property. See Schmalz v. Buckingham Township 7oninq Board of Adiustment, 389 Penn. 295,~.32 At1.2'r233 (1957). These cases then brinq to light a consideration to be included by the Zonin_q Adjuster in his decision makinQ orocess herein. That is to say whether the present setback requirement as established by the Board of County Commis- sioners and applicable to the property under consideration is substantially benPficial under the present conditions of that area to the health, safetv and welf.are of local inhahitants. I believe the answer to that i.neTuirv is Rlllt'P r'V 1 dPTI+' - In determini^q whPther to authorize a variance because of the special conditions makinq existinq eondi- tions inequitable, the Zonincx Adjuster is vested with wide discretion and the courts will not interfere with that discretion unless it is abused. See Zoninq Law and Practice, Yokley 3d Ed. Vol. 2, 5 15.7. In substantiatinQ this genAral .r.ule, the Washinaton court in the case of McNaughton v. Boeing, 68 Wn, 2d 659 cited Lillions v. GibbG ► 37 tar.. ?.c3 62q, 289 P.2d 203 (1955) for the proposition that- "Arbitrary and capricious action of admini-- trative bodies means wilfull and unreasoninq action, without cor.sideration and in disreqard of ficts or circumstances. ' statute or ordinance vary within nrescribed limits and constant with the exercise of legal discretion, the stri.^t letter of zoning law in cases of claims havinq real merit which can be granted consistently with the spirit and purpose of the zoning laws of the particular municipalit~,7. It is also well settled, however, that a variance will not be granted on the qrounds of economic hardship alone. See Andress v. Zo~nin~ Board of Ad'ustment of Philadelphia, 410 Pa.77, 188 Atl. 2d 709 963 ~ T'his fs-especialiys-o w}1?n a person bvys with knowledge of the economic hardship. In such a case the general rule is that the owner canno* complain thereof and assert such hardship as a basis for obtaininq a variance. See Andress, supra. The onlv reason I make mention of this case is to reaffirm and reiterate the qeneral rule which I feel is applicable hore that the petitioners are bound by constructive notice o{ the setback requirement on the parcel of property which they purchased. They cannot now contend economic hardship as the primary basis for requesting a variance. Certainlv, to thP same extent that other owners of the property were aware of the property beinq zoned local business and the 150 foot sethack reRUi.r.emPnt so to should the apnlicant herein. Finally, althouqh not directly on point, I feel there is another case which you should be made aware of prior to makinq any decision in this matter. That case is Farrell v. Seattle, 75 Wn.2d 540, 452 P.2d 965 (1969). Therein the City o- Seattle appealed a Superior Court hol.ding that the land use restrictions imposed unon thn r.Aspondent vroperty owners were discriminatory, arbitrary ~nd capricious and that because they bore no substantial relationship to the health, safety, morals and general welfare of the community, said restrictions were void. This Superior Court holding would have enabled the oetitioners to construct and operate a gasoline service station. In reversincr that holdinq the Supreme Court cited Dowse v. Salt Lake City Cor oration, 123 Utah 107, 111, 255 P.2d 723 (1953). In that case, the Supreme Court of Utah in affirming a denial of an application to rezone from residential to commercial even though much of the property in the other blocks of the neighborhood of the one on which the plaintiff's propertv was located waq 7oned f.or commercial purposes said : "The fact that plaintiff's one-h31f lot might be n1nY'P nrof i.tably used for commerci.al th~an for. -4- . . rL sidential nurnoses or indeecl t3i(, fac:t tiiat zt has become unsuited for residential purposes does not now show discrir.tination or reveal arbitrar action.
