WHEREAS, The Spokane County Planning Commission did, after public
h earing on Augus t 8, 1975, forward to the Board of Coun ty Commi s s ioners a
recommendation that the Zoning Map not be changed from the existing Residential
Office classification to the Commercial classification on property described as
follows:
The W 1/2 of Tract 144 of Opportunity, except the North 461 feet,
except the East 125 feet, and except the R.R. R/W, Sectfon 17,
Township 25 N, , Range 44, E.W,M., Spokane County, Washinqton.
and,
WHEREAS, The applicants before the Planning Commission, Drs, Belknal)
and MacNeill represented by F. V. Seipp, did by letter dated August 13, 1975,
request a hearing before the Board of County Commissioners to present evidence
and testimony in favor of their application, and
WHEREAS, The Board of County Commissioners did hold a public hearing
on September 15, 1975, to consider the recommendations of the Planning Commis-
sion and testimony and evidence of the applicant and other interested parties, and
WHEREAS, at said hearing opportunity was afforded those favoring and
those opposing the above-,described Zoning Map proposal, and thc Boarci of Coiinty
Commissioners of Spokane County having fully considered the tesLimony given,
the records and minutes of the Planninq Commission and all other evidence
presented and having personally acquaintAd themselves with the site and vicinity
in question, does hereby find:
1) That the site iiz question consists of 27,992 square feet situated
on the northeast corner of Sprague Avenue and Farr Road.
2) That the applicant proposed to construct a franchise restaurant,
including the serving of alcoholic beverages, on the sfte.
3) That the approval will conform to similar zoning actions along
Sprague Avenue.
4) That appropriate provisions have bean made to assure compatibility
of the project with ad joining propPrties through the approval of a
specific development plan.
S) That the site is situated witiiin an lllbuI11Zing area , Tlzc zone
change would not have any greater effect upon the topography,
gcology, biological and botanical characteristics, atmospheric
and aquatic conditions and other natural development than similar
uses established along Sprague Avenue.

6) That the proposal is compatible with ad joining land uses,
transportation and titility services.
NOW, THEKEF'ORE, The Board of Coutlty Commissioners of Spokane
Counry does hereby conclude that [he above-described findings are sufficieTit- an:a
controllinq; and that an environmental impact statement is not required for the
described project, and does, therefore, order that an appropriate resolution to
change the Zoning Map from the Residential Office classification to the Commercial
classification be prepared incorporating the following conditions;
1) Improvement to Spokane County standards of Farr Road. Such
improvements shall incluclc, r.urb, clr~ inagc control,
and paving to existing oil.
2) Approval of access permits by the Spokane Couilty Engineer's
Office prior to release of building permits.
3) The advertised property shall be developed in substantial
conformance with the "approved" development plan; i.e., a
single story building oriented toward the southwest corner of the
property with parking to the north and east of the building.
Note: A variance m3y be required to allow the building to be
placed within 15 feet of Farr Road.
4) Approval of a specific landscape plan for the project by the
Director of Planning. Such plan shall indicate the type of yrour:d
cover contemplated, the species, vari.ety, and distribution of
plantings as well as an automatic sprinkler system.
The areas to be landscaped shall include that portion of the right
of way along Sprague Avenue between the parking tot and the side-
walk (encroachment permit required), the setback areas and
adjoining rights of way (encroachment permit required) between the
building and the sidewalks along Sprague Avenue and Farr Road,
and a 4' wide landscape strip extending north along Farr Roa(l.
The Director of Planning may require a bond or other suitabl--
assurance for installation of landscaping.
S) A 6' high ornamental masonry wall conforming to the masonry surface
of the principal building shall be installed along the north side of
the access easement to the north of the ownership. Such walt shall
be constructed and placed in a manner which will not disturb the
established trees and bushes along the north boundary of the acces s
strip. An opening shall also be provided along the north wall to
afford access to the rear of the resi.clcntial lot t(D the north of the
easement road,

f) Thc delineated driveways and parking lot shall be maintzined in
hard surface paving. The final design, location, and arrangement
of Parking stalls and driveways shall be in accorciance wlth
standard traffic engineering practices.
7) Approval of a signing and lighti.ng plan for the property by the
- Director of Plannfng. Such plan shall utilize low intensity ligh til-rcj
which will not produce glare on adjoining roadways and resiclential
~ properties. A free-standing advertising sign not exceeding 84

square feet in area or 25 feet in height will be allowed.
