Bisterfeldt and H.F. Schillinger, requesting a Variance to allow an addition to a building to be located approximately 2 ft. from Dean Avenue. Whereas, the Spokane County Zoning Ordinance requires a front yard setback of 35 ft. NOTE; The described property has double frontage - Dean and Mallon Avenue. The property in que stion i s generally located on the south we st corner of Mallon and Thierman and more specifically described as follows: Section 13, Township ZSN, Range 43 E, W o M. Lots 1 through 9 and Lots 11 through 18 Block 4, Piper's Addition, Parcel No,13532-1338 and, WHEREAS, the Zoning Adjustor did, on the 7th day of .March, 1977, hold a public hearing as provided in Section 4.25 of Title IV on the application of Ray E. Bisterfeldt and H, F. Schillinger for a Vari ance for the de scribed property, and, WHEREAS, the Zoning Adjustor did on the 7th day of March, 1977, formally act upon said application and did deny said application based upon findings of fact and reasons set forth in the official minutes dated the 23rd day of March, 1977, and, WHEREAS, an appeal from the decision of the Zoning Adjustor for Spokane County was filed on the 29th day of March, 1977, by Ray E. Bisterfeldt, and, WHEREAS, the Board of Adjustment of Spokane County, did on the 19th day of April, 1977, hold a public hearing as prescribed in Section 4.25 of Title IV on the application of Ray E. Bisterfeldt and H.F. Schillinger, for said Variance, VE-28-77, and, WHEREAS, at said hearing, opportunity was afforded those favoring and those opposing said application, and the Board of Adjustment having fully considered the official records, evidence, and testimony given and having made an investigation of the m atter. NOW, THEREFORE, be it formally resolved that the Board reversed the decision of the Zoning Adjustor and approved the Variance, VE-28-77, for the following reasons and subject to the foilowing conditions: A. Bisterfeldt and H. F. Schillinger are appealing the decision made by you on March 23, 1977, denying a variance so that an additional structure could be added to our building. We feel that the commission made no effort to studyo uut the situation as it exists in this area for the proper.tyo uwners. First of all the blocks in this subdivision are only 2202' in width, this includes the vacated alley. Most normal blocks in the city and other areas are 300'. So if you have a setback of 35' in front and back, you have lost 70' of your land to begin with. In addition to this the lots in these blocks are only 43' wide instead of the normal 50' which reduces the plot even further. We don't feel that the planning commission ever considered the fact that Dean Avenue is only used by the few property owners that inhabit its four block length. Dean dead ends at Thierman on the east and ends four blocks to the west at the Gifford Hill property line, formerly A.S.C. We are enclosing our check for $25.00 requesting that we be given a hearing before the County Comnission Special Zoning Board. Bisterfeld and Mr. H. F. Schillinger who are also the owners of said property and building request variance to put an addition on the existing build- ing of 50'X72' to extend north to Dean Street. This new addition would be used to house a chassis dynamometer which is used to check and calibrate large on-highway trucks, and also to house engine storage. This addition and property on which it would cover would be the best usage that the land could possibly be put to. If we were to put this addition on the west end of our building it would completely destroy the effectiveness of our parking lot both for customers and employees. This property is now a fenced-in area used to secure property of Spokane Diesel, Inc. as well as customers. The distance between the purposed building and our nearest neighbor Wico to the west is approximately 100'. This area is used as a drive around parkiiix? ~.rca as the property runs through from Mallon to Dean, which permits customers and employees to enter from either street. Dean street is the street that dead ends at Thierman on the east side of our property, and runs to Aluminum Supply four blocks to the west. There is a rail- road track boardering Dean on the north. The only use that Dean receives is from Spokane Diesel and its customers and Wico. The property to the north of Dean is owned by Western Farmers, and because of the rail road-track no entr The entrance and egress of our -~,;::,u1u no~ ~~~~~c an. hazards to the public, customers or employees as our frontage ar~~~.a on Dean is sufficently wide enough to allow excellent visibility, and if necessary, a warning sign could be installed.
