Transamerica Title Insurance Company which are imposec-by Ehe'-aedication
of the plat of WEST VALLEY ADDITION N0. 50 dated March 22, 1953, Piled
for record March 30, 1953 as Document No. 161299B and recorded in Volume
2 of Plats, page 46, as amended by Releases oF Covenant dated June 29,
1955, filed for record July 5, 1955 as Document No. 327572B, recorded in
Book 55 of Miscellaneous, page 137, by eliminating paragraph "G", are
as follows:
A. All lots in this addition shall be known and described as resi-
dential lots. No structure shall be erected, placed or permitted to re-
main upon any portion of this addition other than one detached single
family dwelling or a two (2-) family dwelling and private ga.rage and
other outbuildings which may be incidental to the residential use of
the said land.
B. No building shall be erected on any lot nearer than 30 feet
from the front lot line, nor nearer than 10 feet to any side atreet
line. No buildings except a detached garage or other outbuilding
located 100 feet or more from the front lot line shall be located
nearer than 5 feet to any side lot line.
• C. None but new dwellings ahall be permitted to be placed on
any lot in this addition,
D. No noxious or offensive trade or activity shall be carried on
ugon any lot in this addition, nor shall anything be done thereon which
may be or become an annoyance or nuisance to the neighborhood.
E. No dwelling costing less than $8,500.00 shall be permitted on
any lot in this addition,
F. Any structure erected or placed in this addition shall be com-
plete as to the external appearance, including finished painting, and
shall be connected to water main, septic tank or public sewer, within
six months from the date of commencement of construction.
H. No trailer, basement, tent, shack, garage, barn or outbuilding
erected upon said premises shall at any time be used as a residence
either temporarily or permanently, nor shall any structure of a te mporary
character be used as a residence.
I. These covenants are to run with the land and shall be binding
on all parties and persons claiming under them until January 1, 1978,
and are automatically extended for successive ten year periods thereafter
unless by vote of a majority of the then owners of the lots it is agreed
to change the covenants in whole or in part.
J. If the parties hereto or any oP them, or their heirs or assigns,
shall violate or attempt to violate any of these covenants herein, any
other person or persons owning any real property 3.n thie addition may
prosecute any proceedings at law or in equity against the person or
persons violating or attempting to violate any such covenant to restrain
