ZONING ADJUSTOR DECISION: On November 15, 1977, the Zoning Adjustor rade an
on-site investigation ;n order to render a fair :'eciston. The cectsion is to deny the Variance
for the following reasons:
REASONS:
1. Other commercial properties within the immediate area currently do not enjoy
relief for sign heights.
2. Future commercial uses b the north would, therefore, have an established
precedent to seek. the sane privilege if this variance was granted.
Interstate signing facilities provide spaces for interchange commercial advertising
.
and directional signing in suitable locations.
4. The intent of the Freeway Commercial Zone Classification (Section 9.08A of the
Spokane County Zoning Ordinance) is to provide easy access to highway services
which include areas with limited freeway exposure. The height restriction of
35 feet for signs is in%erded to provide for some exposure without varying from
an established skyline of the surrounding area. The granting of this Variance
would be a notes; 1e departure from the established skyline along Sullivan Road.
5. The height of the sign being requested would have a greater impact (aesthetically)
on a much larger residential area to the south and west, (only those property
cycvers within 200 fee'. were notified of the proposed Variance request) .
C. Alternative site locations may be available for the McDonald Logo to direct:
Freeway 7:reversers to their facilites. (Example: new off -premise directional
sign located on North Division just north of the City limits).
7. The applicant could not demonstrate to the satisfaction of the Zoning Adjustor
that the deccrthed property is deprived of a use normally enjoyed by other
prop:ertics in the same vicinity ani' zone. Therefore, the granting of this
Variance would be a granting of special privileges inconsistent with the
limitations placed ..:fin other grope_ :ries twithin the same vicinity and zone.

Construction and location must comply with Spokane County Bldg. Code, Zoning Ordinance, and
County Engineer's Office - an inspection is required. No sign shall extend over County right
of way. Signs at or near street intersections shall not obscure visibility of traffic. Any
sign over 42" high above ground shall have a minims of 12' clearance from bottom of sign
above ground. Any masts, towers, or overhead framework which are built into, or anchored to
the roof or wall of any building, shall have the structure adequately and properly anchored
to and supported by the structural framework of the roof and/or walls. Cables or guys used
to support or anchor such masts or framework, and anchored to the structure, shall be ade-
quately and properly attached to the structural framework of the wall and/or roof support-
ing the anchoring system. Structural framework of the walla and roof shall be adequately
and properly reinforced as required by the Code. Permit and inspection fees based on net
structural costs: $1.00 to $500.00 - $5.00; $501.00 to $2,000.00 - $5.00 for the first

I am unable to attend your public hearing on the above matter, therefore I
wish to have the following comments entered into the records.
My company recently built the apartment buildings shown on the overall "Develop-
ment and Traffic Plan" encompassing this proposal. More recently, we were
required by Spokane County to obtain a "Down Zone" from Freeway Commercial to
Multi -family Suburban zoning, for the exclusive purpose of completing carports
within the northerly 12 unit apartment building as shown on said plan. Hence,
I have the opportunity to review your "Development and Traffic Control Plan",
as well as the zoning ordinance pertaining to the Freeway Commercial zone and
find in addition to Spokane County's concern for my less intensive carport
use of Freeway Commercial zoning, that;
1. According to subsection 4.08A.010, the intent of the Freeway
Commercial zone is to encourage the controlled development of
commercial facilities. To that end, special conditions are
applied including the "Development and Traffic Control Plan"
to prevent or minimize traffic hazards or congestions on the
limited access highway, its access and egress ramps and con-
necting county roads; and to prevent of minimize adverse
affects upon adjoining land developed or zoned for residential
use. (Please note, the properties adjoining to the west are
zoned Agricultural Suburban and contain single family residences
as well as the multi -family sites inherent in the Traffic and
Development Control plan.)
2. According to the approved "Development and Traffic Control Plan"
Item 8 required; that plans and specifications for signs and all
exterior lighting shall be submitted by the applicant as approved
by the Planning Commission and Board of County Commissioners
prior to installation. The provision of Chapter 4 .ORA, permit-
ting the zoning adjustor to review amendments to the Traffic and
Control Plan should not be applicable to this particular condition
in so far as it is not an amendment to the Traffic Development
Plan per se. Therefore, said plans for signing should be submit-
ted to the Planning Commission and not the Zoning Adjustor for
their review.

3. According to the vicinity map advertising this item, access
seems to be proposed through Broadway. Has the Zoning
Adjustor amended the Traffic Development Plan to allow said
access?
4. I have reviewed other McDonald resturants and find that there
are architectural plans for the resturant which would be much
more compatible with residential uses nearby. It includes
the lack of telescoping signs such as those proposed for this
site. I am thinking specifically of their resturant located
across from the Sea -Tac Mall in Federal Way, Washington. Is
the McDonalds chain phasing out this old architectural facade
and signing, and if so why propose an obsolete plan? In con-
clusion, it seems to me that the Freeway Commercial zone is
a very special creature, in that it allows intensive commercial
uses in otherwise isolated locations where vacant or semi rural
uses prevail. Were it not for its proximity to the freeways, the
zoning would become a spot zone. Therefore, I fully realize the
importance of a controlled implementation through an approved
Traffic Development Plan. In this case, however, the Traffic
Controll Plan is not being followed closely, is not being
properly amended, and the specific use in this case would be
contrary to the intent of the protection of residential uses
nearby. I therefore urge you to consider denial of this variance
for an 80 foot McDonald sign.

this information and other concerned input and render an objective decision.
