WHER.EAS, the City of Spolcane VaUey staff and/or the Spokanc City/County Department of Emergency Management has reporled to the Spokanc Valley, City Council Tl-IAT beeinnine on December 17. 2008, at aDproximatelV 1:00 p.m., a series of severe winter storms beaan devositine verv siEnifcant amounts of snow on the Citv. and tlie weather forecast anticinates sienificant additional snow over- the neYt at least five davs. The amount of snow severely disrupted or is disrupting the health, safety and welfare within the City-of Spokane Valley 'and caused or is.causing extensive damage in parts of the City of Spokane Valley; and WTiEREAS; an emergency or disaster.exists that neccssitates utilization ofthe emergency powers grantecl pursuant to RCW 38.52 and/or 35A.33; and WHEREAS, the emergency conditions warrant the calling of an emergency meeting of the City Council without pr•ior notice pursuant to RCW 42.30.070; and WHE-REAS, significajit economic loss has occurred or is occurring as a result of shufdowns necessary to conduct siructural assessments of facilities; and WHEREAS, tiie City of Spokane VaJley is respansible for maintaining the healtli, safety, and welfare of its citizens; and WHEREAS, the City of Spokane Valley has authority, pursuant to RCW 38.52:070(2), "to enter into conlracts and incur obligations necessary;to combat such disaster, protecting the health and safety of persons and property, and providing emergency assistance to the victims of-sucll,disaster. Each polilical subdivision is authorized to exercise the powers vested under this section in the light of the exigencies of an extreme einergency situation without regard to time•consuming procedures and fornialities prescribed by law (excepting mandatnry constitutional requircments), including, but not limited to, budget !aw limitations, requiremcnts of compelitive bidding and publication of notices, provisions pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of lemporary workers, the rental of equipment, the purchase of suppliES and materials, the- levying of taxes; and the appropriation and expenditures of public funds..."; and WHEItEAS, the City of Spokane Valley is a party to the regional Amended Interlocal Agreement for Emergency Management Services. That Interlocal Agreement was established pursuant to RCW 39.34 and RCW 38.52.070 to facilitate cooperation behveen the City of Spokane Valley and the other local govcrnments thai are pacties to the Agreemenl in the event pf an emergGncy; and WHEREAS, state-and federa) resources are supplemental to Iocal.jurisdiction efforts; and WHER.EAS, Mayor Richard Munson proclaimed that emergency cooditions exist at 5:00 p.m. on Deceinber 22, 2008; and WHEREAS, a local "Proclamation of Emergency" is a preliminary step to rcquesting a "Proclamation of Emergency" from tlie Governor and requesting state and federal assistance. Resolution 08-023 Emergency (winter weather) ['age 1 of 2 • . ~ NOW THEREFnRE, 'rHE.CITY COUNCIL OF THE C1TY OF SP-OKANE VALLEY, WASHINGTON ORDAINS AS rOLLOWS: SECTION 1. - Puroose and intent. As a result of the aforementioned conditions, it is the purpose and intent of this resolution to formally proclaim the existence of an emergency or disaster in the City of Spokane Valley due.to severe-winter storm conditions. SECTION 2-- Definitions. "Emergency or disaster" as used in all sections of dhis Resolution except KCW -38.52.430 shall mean an event or set of circumstances which: (i) Demands immediate action to preseive public health, protect life, protect public propeMy, or to provide relief to any stricken community overtaken by sucti occurrences, or (ii) reaches such a dimension or degree of destructiveness as to «►arrant the governor declaring a stafe af emergency pursuant to RCW 43.06.010. SECTION 3 - Emereencv Proclamation. A. The nction by Mayor Richard Munson in proclaiming an emergency at 5:00 p.m. on -December 22, 2008 is ratified'by the City Council. B. It is hereby declared tlla& there has been an emergency,since December 17, 200$ and continues to be an emergency or disaster as a.re5u(t of the aforemeotioned conditions in the City of Spokarie Valiey, Spokane County, Washington; therefore, designated departments *are authorized to enter into contracfs and iricur obligations necessary to combat such emergency to protect lhc health, safety and welfare of persons and property, and provide emergency assistance to the victims of such disaster pursuant to RCW 38.52 and/or 35A.33. C. Each designated department is audiorized to exercise the powers enuinerated in this Resolutian in liglit of the demands of a» extr-eme emergency siluation without regard to time consuming procedures and formaliries prescribed by law (except mandatory constitutional requirements). SECTION 4 - Cffective Date. This Resolution shall be in full force and effect upon adoption, anci shall remain. in effect until subseqttent action-_by the City Council stating the conditions giving rise to this Eme'rgency Proclamation have subsided. WHEREAS, the City of Spokazie Vallzy staff has reported to the Mayor THAT ON Decembec 22. 2008 , at 5:00 n.m. , the fTeQuent and heavv snotiv stor-ms since December 17, 2008 sever.ely disnipted or is disrupting the health, safety and welfare wi.thin tlie= City of SpQkane Valley and caused or is causing extensive dainage in parts of the City of Spokane Valley; and WHEREAS, a"di.saster" includes (but is -not limited to) destructive nafiural phenomena, public disorder, energy emergency, riot, or other situation causing destruction and distress that affects health, safety and welfare; and WHEREAS, an "eraergency" includes (but is not limited to) dest.ructive natural phenomena= public disorder, energy emergency, riot, or other grave or serious situation or occurrence that~hanpens unexpectedly and demands immed.iate action; and NVHEREAS, an emergency or disaster exists that necessitafies utilization of the , enlergency powers granted pursuant to RCW 38.52 andlor RCVV 35A.33; and WHEREAS, significant ecanomic loss has nccurred or is occurring as a result of the incident and shutdowns necessary, to conduct structural assessments of faci.lities; and WHEREAS, the City of .Spokane Valley is responsible for mainta.ining the health, safety, and wzlfare of its citizens; and VVH.EREAS, the City of Spokane Valley has authority, pursuant to RCW _35A.33.080, to _ make expenditures for emergericies "requ.iring the immediafie prEServation of order or public health, or for the restoration to a condition of usefulness of any public property which has been dainaged or destroyzd by accident= or for public relief from calamity...."; and WHEREAS, the City ot' Spokane Valley has authority, pursuant to RCW 38.52.100(1), "to inake appropriations for the ordinary expenses of [fihe- City] for the-paymznt of experises of its local organization for emergency management"; and WHEREAS, the City of Spokane Va11ey is,-a party to the A.mended Inter-local Agreement for Emergency Management Services, wliich Interlocal Agreement was established, pursuant to RCW 39.34 and RCW 38.52.070, to facilitate cooperation betwzen the City of Spokane Valley aild the several other local governments that are party to the Interlocal Agreement in the event of an emergency; and - -I- WHEREEIS, state and federal resources are supplemerital'to local juxisdiction efforts; and' WHEREAS, a"Proclamation of Emergency" is a prelicninary step to requesting a "Proclamation of Emergency" fxom the Governor and requesting state and federal 'assistance.
