DECLARATION OF EASEMENT
The City of Spokane Valley hereby grants an easement to itself, the Spokane Valley Fire
District, Avista Corporation, Comcast, Modern Electric Water and Power Co., Spokane County
Utilities, Century Link and to all other utility purveyors and their successors, for the purpose of
constructing, installing, operating, maintaining, repairing, replacing, removing, and all other uses
or purposes which are or may be related to the utilities over, under, and across those portions of
vacated Whipple Road, located in the Southeast Quarter of Section 16, Township 25 North,
Range 44 East, W.M., more particularly described as follows:
WHIPPLE ROAD — from a point 25 feet South of the centerline of Main Avenue — 40 feet wide
South to end.
Situate in the City of Spokane Valley, County of Spokane, State of Washington.
IN WITNESS WHEREOF, the Grantor hereto has caused their duly authorized representatives
to execute this instrument as of the date hereinafter written.

COUNTY ENGINEER'S ROAD FILE NO. -223O
RESOLUTION - VACATION
This being the day set for the hearing on the County Road Engineer's Report on
the proposed vacation of WHIPPLE ROAD, proceedings for which were initiated by R. CECIL
WHIPPLE and others, and it appearing to the Board on proof duly made that notice of the
hearing was published and posted in the manner and for the time required by law, and the
Board after examining all claims and all maps and papers on file and after hearing the
evidence adduced at the hearing and it appearing that the hereinafter described road is
useless and the same is no longer needed as a part of the general road system within the
County and that the public will be benefited by such vacation.
THEREFORE, BE IT RESOLVED BY the Board of County Commissioners of Spokane County,
Washington, that the hereinafter described portion of public road to -wit:
WHIPPLE ROAD - from a point 25 feet South of the centerline of Main Avenue - 40 feet
wide South to end.
Located in the Southeast Quarter (SE 1/4) of Section 16, Township 25 North, Range 44
E.W.M.
be and the same hereby is vacated in accordance with the provisions of Chapter 36.87
R.C.W. SUBJECT to the County Engineer's certification to the Clerk of the Board that:
1). Necessary utility easements have been provided, and
2) The Spokane County Road Fund has been compensated for the vacated right-of-way
'either by grant of additional right-of-way on Main Avenue or payment for the
vacated right-of-way.
PASSED AND ADOPTED By the Board of County Commissioners of Spokane County, Wash-
ington, this 30th day of October, 1984.
