TEMPORARY CONSTRUCTION EASEMENT
THE GRANTOR, Market Pointe 11, LLC, a Washington limited liability company, for and in
consideration of $10.00 and other valuable consideration, conveys and grants unto the City of
Spokane Valley, a municipal corporation of the State of Washington, and its assigns, THE
GRANTEE, under the imminent threat of the GRANTEE's exercise of its right of Eminent
Domain, the right, privilege and easement over, upon, and across the hereinafter described lands
for the purpose of: Constructing Sidewalk, Drainage Swale, Connection to Overlook, and
blending to existing ground.
The temporary rights herein granted shall commence on June 23, 2014 and terminate on June
22, 2016 or upon completion of project construction, whichever occurs first.
Said lands being situated in Spokane County, State of Washington, and described as follows:

It is understood and agreed that delivery of this temporary construction easement is
hereby tendered and that the terms and obligations hereof shall not become binding upon the

Spokane Valley by its authorized agent.
