TEMPORARY CONSTRUCTION EASEMENT
THE GRANTOR, Market Pointe 11, LLC, a Washington limited liability company, for and in
consideration of $10.00 and other valuable consideration, conveys and grants unto the City of Spokane
Valley, a municipal corporation of the State of Washington, and its assigns, THE GRANTEE, under the
imminent threat of the GRANTEE's exercise of its right of Eminent Domain, the right, privilege and
easement over, upon, and across the hereinafter described lands for the purpose of: Constructing
Sidewalk, Drainage Swale on adjacent property, Temporary Walking Path, Widening of Bridge, and
blending to existing ground. NOTE: Temporary fencing will be erected between the temporary walking
path and the parking lot & drive-thru for the Krispy Kreme restaurant located on the property. Said fence
will serve as a barrier to prevent pedestrians on the walkin•path from crossing into parking lot and/or the
drive-thru area.
The temporary rights herein granted shall commence on June 23, 2014 and terminate on June
22, 2016 or upon completion of project construction, whichever occurs first.
Said lands being situated in Spokane County, State of Washington, and described as follows:

It is understood and agreed that delivery of this temporary construction easement is hereby
tendered and that the terms and obligations hereof shall not become binding upon the City of Spokane

authorized agent. e
