ADNSTOR FINDINGS & ORDER ~ Hearing: October 18, 1978 Minutes Written: November 27, 1978 VARIA NC E VE-122-78, Siqn Extension and HeiQht ZONING ADJUSTOR DECISION: After public testimony and review, the decision of the Zoning Adjustor is to approve the applicant's request for a Sign Extension and Height Variance. A. FINDINGS FOR APPROVAL: Pursuant to Section 4.25.030 (b) of the Spokane County Zoning Ordinance, the Zonfng Adjustor has the responsibility of determining that a use will not be detrimental to the surrounding prnperties. In determining compatibility, the Zoning Adiustor based his decision on the testimony presented at the October 18, 19 78 Zoning Adjustor Hearing as well as criteria set forth in the Spokane County Zoning lju:)L~JS ~ L.ILfL Li1L ..i would not be detrimental to public health, safety, and welfare. 2) It was found that other sign variances had been granted in the area and being so, tliis approval will not constitute fihe granting of a special privilE(le. 3) Testimony given at the hearing pointed out that the sign is nvt an actual advertising sign, but a public service which prints public servfce messages on a light board. B. URDER: 1) The sign shall be constivcted in substantial conformance to the plot plan on fiel with this application and shall be no closer than seven (7) feet from Sprague Avenue property line. C . Spokane County Planning Depa eni Zoning Adjustor Variance Permit Procedure In order to save time and expedite the Variance application procedure, these simple steps should be followed: , Step One: The applicant should determine whether he or she believes that they meet the criteria for a Variance. The criteria are as follows: l. 8ecause of special circumstances_applicable to the property, including size, shape, topography, location or surroundings, the strict application of tfie Zoning Ordinance is found to depri ve su bj ect property of ri g hts' and pri v i 1 i ges en j oyed by other oroperti es i n the vicinity and under identical zone classifications. 2. That the granting of the Variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and Zone in which subj ect property is situated. 3. Additionally, that the granting of the Variance will not constitute a special privilege not shared by other property owners within a close proximity. teT:o: After determining that your property does meet the cri ;.er;a as mentioned above, two other requirements should be met. First, be sure your property complies with the Short P1at Qrdinance that went into effect March 13, 1978. Check with our Short Plat Office in this department to see how your property fits into this neVr ordinance. Another requirement for dwellings within a recorded plat is possibly restrictive covenani-3. -The restrictive covenants are attached to your deed. Make sure that it does not prohibit ycu from obtaining a request to reduce or waive minimum dimensional standards as set by the individual(s) who recorded the plat. Step Three: Fi11 out the necessary apalicatien attached with this procedure form. Step Four: Before the above application can be accepted at the ?lanning OrTice, the . fo',lowjng items of information are required. • 1. Plot Plan: This plan shall show all dimensional measurements of the applicant's property showing distance from the dwelling (proposed dwelling also) to appropriate property lines. 2. Assessors Map of*the property; the Assessors are located in the County Courthouse, first floor. 3. Ownership micro; which can be provided for you at the Assessors Office. 4. Recorded Non-Exclusive Easement; this only pertains to property which requires an easement for access to the applicant's parcel. Tne Auditor's Office would have this information. Step Five: After gathering the above information, bring it to the Planning Departnent with the appropriate $125.00 fee, at which time the applicat7on is filed and a hearing date will be set. (Hearings are held every two weeks on Wednesday afternoons at 1:30 P.M. in the Broadway Centre Building Hearing Room on the second floor at North 721 Jefferson) Step Six: The applicant or a representative is required to be present at the scheduled hearing of their application to answer questions concerning the request. A decision by the Zoning Adjustor may be reached at the hearing or the action may be Fostponed until all questions have been answered. ' . . Vari ance Pe~ ~~i-it Procedure 2 Step Seven: After the Zoning Adjustor renders a decision, each Variance request may secure One Building.Permit PROVIDED: 1) The permit has been approved; 2) all conditions of the permit which can be done prior to the issuance of a building permit are met with and; 3) within ten (10) days from the date of the wratten minutes of the 2oning Adjustor no appeals have been filed with this office. Step Eight: If the applicant's request is denied, then he or she may appeal the decision to the Spokane County Board of Adjustment within ten (10) days of the written minutes of the Zoning Adjustor. This appeal must be filed in duplicate to the Spokane County Planning Oepartment; the fee for the appeal i s$35. 00.
