VE-142-78, FRONTAGE REQUIREMENT
ZONING ADJUSTOR DECiSION: After public testimony and review, -the decision
of the Zoning Adjustor is to approve the applicant's request for a Variance in the
Agricultural Suburban Zone.
A. FINDINGS FOR APPROVAL: Pursuant to Section 4.25.030 (b) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility
of determining that the granting of a Variance will not be detrimental to the
surrounding properties. In assuring compatibility, the Zoning Adjustor based
his decision on the testimony presented at the November 15, 1978 Zoning
Adjustor Hearing as well as criteria set forth in the Spokane County Zoning
Ordinance for issuance of a Variance. The Zoning Adjustor hereby finds the
fol lowing :
1. The granting of this Variance, in the opinion of the Zoning Adjustor, is not a
granting of a special privilege as evidenced by other properties having the
same rights and privileges in the vicinity and under identical ione
classification .
2. Denial of the applicant's request would deprive the applicant of a minimum and
basic use which is compatible in size with other adjacent parcels containing
similar uses.
B. ORDER :
1. The duplex shall be located in substantial conformance to the approved plot
plan on file with this application, and in any case, shall conform to all require-
ments for setvacks for a duplex in the Agricultural Suburban Zone, in the
Spokane County Zoning Ordinance.
2. Before a building permit can be obtained, the applicant shall submit to the
satisfaction of the Short Plat Administrator, evidence that shows compliance with
the Short Plat Ordinance.
3. This permit shall be null and void, if the applicant cannot prove to the
satisfaction of the Health Department, a valid sewage system for the duplex can
be obtained.
