ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a Duplex in the
Agricultural Zone and a Frontage Requirement Variance.
A. FINDINGS FOR APPROVAL: Pursuant to Section 4.25.030 (b) and
4.24.010 (b) of the Spokane County Zoning Ordinance, the Zoning Adjustor has
the responsibility of determining that the granting of a Special Conditional Use
and Variance will not be detrimental to the surrounding properties. In
assuring compatibility, the Zoning Adjustor based his decision on the testimony
presented at the April 4, 1979 Zoning Adjustor Hearing as well as criteria set
forth in the Spokane County Zoning Ordinance for issuance of a Special
Conditional Use and Variance. The Zoning Adjustor hereby finds the
following:
1. The duplex was found to be compatible with the immediate neighborhood as
evidenced by other duplexes and mixed land uses established in the area.
2. The proposed duplex will not effect the lifestyle in the immediate area.
3. The Zoning Adjustor finds that the proposed duplex will not have an adverse
impact on existing public services.
4. The Zoning Adjustor noted that there are existing similar uses within the area
and that the granting of this Variance would not constitute a granting of
special privileges.
B. ORDER:
1. The proposed two family residence (duplex) parking areas, driveways, and
landscaped areas shall be locaed and developed in substantial conformance with
the plot plans on file with this application.
2. Access points shall be approved by the Spokane County Engineers prior to
release of building permits
3. To mitigate points of concern relative to appearance, the following information
shall be required by the Zoning Adjustor and be conditional to approval:
a. Landscape Plan
b. Planting schedule (at least 1 growing season after completion will be
al lowed ) .
c . Provisions for maintenance
d. I nstallation of a sprin kler system
4. Corner lot proposals shall orient each residential unit on separate street
frontages, and shall observe required front yard setbacks.
5. Garages or sheltered carports shall be provided for each unit. Said carports
shall be attached as part of the main structure.
6. The Zoning Adjustor reserves the right pursuant to Section 4.24.010 (a) to
hold a public hearing on the proposed duplex to insure that all conditions are
being compiled with and to mitigate any unforeseen adverse efforts.
7. Prior to the issuance of a building permit, the applicant shall submit evidence
to the satisfaction of the Short Plat Administrator, which shows compliance with
the Short Plat Ordinance.
8. Spokane County shall not assume any obligation for said private road or ease-
ment and the owner or owners hereby acknowledge that the county has no
obligation whatsoever to establish, examine, survey, consturct, alter, repair,
improve, maintain, provide drainage or snow removal on said roadways.
