VE-106-79, RELAXATION OF FRONTAGE REQUIREMENTS
ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a Frontage
Variance.
A. F I N D I N GS : Pu rsuant to Section 4. 25 . 030 of the Spokane County Zon i ng
Ordinance, the Zoning Adjustor has the responsibility of determining that the
granting of this application will not be detrimental to the surrounding
properties. In assuring compatibility, the Zoning Adjustor based his decision
on the testimony presented at the above noted Zoning Adjustor Hearing as well
as criteria set forth in the Spokane County Zoning Ordinance for review of this
application. The Zoning Adjustor hereby finds the following:
1. The subject lot was established many years ago by property owner to the
immediate south.
2. Testimony presented at the hearing established owner as an innocent
purchaser of the property.
3. This lot which meets the minimum area standards for a single family
residence in this zone would be valueless if the Variance were not
granted.
4. The granting of this Variance, in the opinion of the Zoning Adjustor, is
not a granting of special privileges as evidenced by other properties
having the same rights and privileges in the vicinity and under identical
zone classification.
5. It was found that this action will not be injurious to properties or
improvements in the vicinity and that the granting of this variance will not
be materially detrimental to the public health, safety, and general welfare.
B. ORDER:
1. Applicant's request for a Variance is hereby approved.
2. There shall be no further segregations or divisions of land unless said
segregations are in compliance with State and local platting laws.
3. The applicant shall maintain his site design in substantial conformance with
the "plot plan" on file with this application, and in any case, shall observe
all setback requirements as prescribed by the Spokane County Zoning
Ordinance.
