. j ZONING ADJUSTOR FINDINGS & ORDER , Hearing : January 17, 1979 Minutes Written : February 22, 1979 VARIANCE ~ VE-2-79, SETBACK REQUIREMENTS ZON I NG ADJUSTOR DEC ISION : After public testimony and review, the decision of the Zoning Adjustor is to approve the applicant's request for a Setback Variance in the Residential Office Zone. A. FINDINGS FOR APPROVAL: Pursuant to Section 4.25.030 (b) of the Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility of determining that the granting of a Variance will not be detrimental to the surrounding properties. In assuring compatibility, the Zoning Adjustor based his decision on the testimony presented at the January 17, 1979 Zoning Adjustor Hearing as well as criteria set forth in the Spokane County Zoning Ordinance for issuance of a Variance. The Zoning Adjustor hereby finds the following: 1. The matter was referred to the Zoning Administrator to determine if the building was in substantial conformance to the plot plan submitted to the Planning Commission for an eariler zone change approval. It was found that the new plot plan is in substantial conformance. 2. Because of the shape of the lot it makes it impractical to construct a building on the site with a Setback Variance. 3. The building will be compatible with the other medical buildings in close proximity. 4. Ample parking can be provided on the site to comply with 4.17 of the Zoning 4rdinance. 5. In the opinion of the Zoning Adjustor, the granting of this Variance would be consistent with other properties in the same vicinity and Zone and as such, would not be construed as the granting of a special privilege. B. ORDER: ' 1. The property shall be developed in substantial conformance to the plot plan on file with the application. 2. The building shall be no closer than 10 feet in the side yard and 10 feet from the flanking street. In both cases the 10 feet is from the flanking street and side property line respectively. C.
