ZON I NG ADJUSTOR OEC I51 ON : After public testimony, an on-site inspection
and review, the decision of the Zoning Adjustor is to approve the applicant's request
for a Lot Depth to Width Variance in the Agricultural Suburban Zone.
A. FINDINGS FOR APPROVAL: Pursuant to Section 4.24.030 (b) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility
of determining that the granting of a Variance will not be detrimental to the
surrounding properties. In assuring compatibility, the Zoning Adjustor based
his decision on the testimony presented at the February 21, 1979 Zoning
Adjustor Hearing as well as criteria set forth in the Spokane County Zoning
Ordinance for issuance of a Variance. The Zoning Adjustor hereby finds the
following:
1. The granting of this Variance, in the opinion of the Zoning Adjustor, is not a
granting of special privileges as evidenced by other properties having the same
rights and privileges in the vicinity and under identical zone classification.
2. Denial of the applicant's request would deprive the applicant of a minimum and
basic use (i.e., single-family residence) which is compatible in size with other
parcels in the vicinity.
3. The described property does have of frontage on a County maintained and
ded i cated road.
4. Because of the size, (3/4 of an acre ) the granting of this Variance will not be
detrimental to the public welfare of surrounding properties.
5. After a site inspection, the Zoning Adjustor is of the opinion that the granting
of the Variance will not be materially detrimental to the public welfare or in-
jurious to the property or improvements in the vicinity.
B. ORDER:
1. Prior to the issuance of a building permit, the applicant shall submit evidence
to the satisfaction of the Short Plat Administrator, which shows compliance with
the Short Plat Ordinance.
2. Spokane County shall not assume any obligation for said private r•oad or ease-
ment and the owner or owners hereby acknowledge that the county has no
obligation whatsoever to establish, examine, survey, consturct, alter, repair,
improve, maintain, provide drainage or snow removal on said roadways.
3. There shall be no further segregations or divisions of land unless said seg-
regations are in compliance with State and local platting laws.
4. The applicant shall maintain his site design in substantial conformance with the
"plot plan" on file with this application, and in any case, shall observe all
setback requirements as prescribed by the Spokane County Zoning Ordinance.
