VE-42-79, SIGN SETBACK AND AREA
ZON I NG ADJUSTOR DEC ISION : After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a Sign Setback and
Area Variance in the Residential Office Zone.
A. FINDlNGS FOR APPROVAL: Pursuant to Section 4.25.030 (b) of the
Spokane County Zoning 4rdinance, the Zoning Adjustor has the responsibility
of determining that the granting of a Variance will not be detrimental to the
surrounding properties. In assuring compatibility, the Zoning Adjustor based
his decision on the testimony presented at the March 21, 1979 Zoning Adjustor
Hearing as well as criteria set forth in the Spokane County Zoning Ordinance
for issuance of a Variance. The Zoning Adjustor hereby finds the following:
1. It was noted by the Zoning Adjustor that other Variances for signs have been
granted in the area. Thus, the granting of this Variance will not constitute
the granting of a special privilege.
2. In the opinion of the Zoning Adjustor, the granting of this Variance will not be
detrimental to the surrounding properties, and would point out that there were
no Objectors of Record.
3. Denial of this request would have been injurious to the proposed use of the
property, because if the sign was placed flat against the building, it could not
be seen.
B. ORDER:
1. The sign shall be in substantial conformance to the plot plan on file with this
application and shall be no closer than 20 feet from the front property line,
with a gross area not greater than 44 sq. ft.
2. The sign shall be no higher than 20 feet in height.
C. GENERAL DATA:

exceed a total gross surface area of 30 sq. ft., whereas, the
applicant fails to meet both these requirements.

5. State law R.C.W. 36.70 and the Spokane County Zoning Ordinance stipulates that
a Variance shall not be granted as a special privilege inconsistent with the
limitations placed upon other properties in the same zone and vicinity. There-
fore, Variances shall only be granted when the following two criteria are deemod
to be met by the Spokane County Zoning Adj ustor.
(i) Because of special circumstances applicable to subject property
including size, shape, topography, location or surroundings, the
strict application of the Zoning Ordinance is found to deprive
subject property or rights and privileges enjoyed by other pro-
perties in the vicinity, and
(ii) The granting of the Variance will not be materially detrimental
to the public welfare or injurious to the property or improvements
in the vicinity and zone in which the subject property is situated.
