VE-46-79, SETBACK REQUIREMENTS, FRONT YARD
ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve - in part, the applicant's request for a setback
requirement variance in the Manufacturing Zone.
A. FINDINGS FOR APPROVAL: Pursuant to Section 4.25.030 (b) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility
of determining that the granting of a Variance will not be detrimental to the
surrounding properties. In assuring compatibility, the Zoning Adjustor based
his decision on the testimony presented at the April 4, 1979 Zoning Adjustor
Hearing as well as criteria set forth in the Spokane County Zoning Ordinance
for issuance of a Variance. The Zoning Adjustor hereby finds the following:
1. Through staff analysis and an on-site investigation, it was fiound other
variances has been granted in the vicinity.
2. The granting of this Variance, in the opinion of the Zoning Adjustor, is not a
granting of special privileges as evidenced by other properties having the same
rights and privileges in the vicinity and under identical Zone classification.
3. The Zoning Adjustor noted that there are existing similar uses within the area
and that the granting of this Variance would not constitute a granting of
special privi leges .
4. Other buildings on Park Road have setbacks less than those prescribed by the
Zoning Ordinance, however, other buildings along Park Road are set back
farther than that requested by applicant.
B. ORDER:
1. The applicant's request for a variance is granted in part, so that the
applicant's proposed building may be built to within 10 feet of the property line
on Park Road.
2. The applicant shall maintain his site design in substantial conformance with the
"plot plan" on file with this application, and in any case, shall observe all
other setback requirements as prescribed by the Spokane County Zoning
Ordinance.
3. The 10 foot front yard area shall be kept free of litter and other waste
materials.

greater from center of the road is required, whereas the applicant is
25 feet short of this requirement.

5. State law R.C.W. 36.70 and the Spokane County Zoning Ordinance stipulates that
a Variance shall not be granted as a special privilege inconsistent with the
limitations placed upon other properties in the same zone and vicinity. There-
fore, Variances shail only be granted when the following two criteria are deemrd
to be met by the Spokane County Zoning Adj ustor.
(0 Because of special circumstances appl icabie to subject pr~operty
including size, shape, topography, location or surroundings, the
strict application of the Zoning Ordinance is found to deprive
subject property or rights and privileges enjoyed by other pro-
perties in the vicinity, and
(ii) The granting of the Variance wiii not be materially detrimental
to the public welfare or injurious to the property or improvemerits
in the vicinity and zane in which the subject property is situated.

(5) Topographic features pertinent to the property (such as rock outcrop,
canyons, hills, etc.)

is filed.
