VE-46-79 ZONING ADJUSTOR FINDINGS & ORDER Hearing: April 4, 1979 Decision : May 4, 1979 Minutes Written: May 29, 1979 VARIANCE VE-46-79, SETBACK REQUIREMENTS, FRONT YARD ZONING ADJUSTOR DECISION: After public testimony and review, the decision of the Zoning Adjustor is to approve - in part, the applicant's request for a setback requirement variance in the Manufacturing Zone. A. FINDINGS FOR APPROVAL: Pursuant to Section 4.25.030 (b) of the Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility of determining that the granting of a Variance will not be detrimental to the surrounding properties. In assuring compatibility, the Zoning Adjustor based his decision on the testimony presented at the April 4, 1979 Zoning Adjustor Hearing as well as criteria set forth in the Spokane County Zoning Ordinance for issuance of a Variance. The Zoning Adjustor hereby finds the following: 1. Through staff analysis and an on-site investigation, it was fiound other variances has been granted in the vicinity. 2. The granting of this Variance, in the opinion of the Zoning Adjustor, is not a granting of special privileges as evidenced by other properties having the same rights and privileges in the vicinity and under identical Zone classification. 3. The Zoning Adjustor noted that there are existing similar uses within the area and that the granting of this Variance would not constitute a granting of special privi leges . 4. Other buildings on Park Road have setbacks less than those prescribed by the Zoning Ordinance, however, other buildings along Park Road are set back farther than that requested by applicant. B. ORDER: 1. The applicant's request for a variance is granted in part, so that the applicant's proposed building may be built to within 10 feet of the property line on Park Road. 2. The applicant shall maintain his site design in substantial conformance with the "plot plan" on file with this application, and in any case, shall observe all other setback requirements as prescribed by the Spokane County Zoning Ordinance. 3. The 10 foot front yard area shall be kept free of litter and other waste materials. C. GENERAL DATA: a.
