VARIANCE
VE-48-79, LOT AREA REQUIREMENT .
ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a Lot Area
Requirement Variance.
A. FINDINGS FOR APPROVAL: Pursuant fio Section 4.25.030 (b) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility
of determining that the granting of a Variance will not be detrimental to the
surrounding properties. In assuring compatibility, the Zoning Adjustor based
his decision on the testimony presented at the April 4, 1979 Zoning Adjustor
Hearing as well as criteria set forth in the Spokane County Zoning Ordinance
for issuance of a Variance. The Zoning Adjustor hereby finds the folfowing:
1. The granting of this Variance, in the opinion of the Zoning Adjustor, is not a
granting of special privileges as evidenced by other properties having the same
rights and privileges in the vicinity and under identical zone classification.
2. After a site inspection, the Zoning Adjustor is of the opinion that the granting
of the Variance will not be materially detrimental to the public welfare or ln-
jurious to the property or improvements in the vicinity.
3. A Variance identical to this application was granted to a parcel of land
immediately south of said parcel.
B. ORDER:
1. Prior to the issuance of a building permit, the applicant shall submit evidence
to the satisfaction of the Short Plat Administrator, which shows compliance with
the Short Plat Ordinance.
2. There shall be no further segregations or divisions of land unless said seg-
regations are in compliance with State and local platting laws.
4. The applicant shall maintain his site design in substantial conformance with the
"plot plan" on fife with this application, and in any case, shall observe all
setback requirements as prescribed by the Spokane County Zoning Ordinance.
C. GENERAL DATA:
a. Location: Section 18, Twn 25N, Range 45, EWM
The N 94 feet of Lot 6, Block 12, Valley View Addition.

c. Site Size: Approximately 10,058 sq. ft.
d. Existing Zoning: Agricultural Suburban, estab 7/30/57
e. Variance Requested : According to Spokane County Zoning
Ordinance, 11,000 sq. ft. of property is required for a duplex,
whereas the applicant only has 10,058 sq. ft.
f. Application of Zoning Provision: Chapter 4.05, Section 4.04.050 (a)

5. State law R.C.W. 36.70 and the Spokane County Zoning Ordinance stipulates that
a Variance shall not be granted as a special privilege inconsistent with the
limitations placed upon other properties in the same zone and vicinity. There-
fore, Variances shall only be granted when the following two criteria are deemA
to be met by the Spokane County Zoning Ad,justor.
(i) Because of special circumstances applicable to subject property
including size, shape, topography, location or surroundings, the
strict application of the Zoning 4rdinance is found to deprive
subject property or rights and privileges enjoyed by other pro-
perties in the vicinity, and
(ii) The granting of the Variance will not be materially detrimental
to the public welfare or injurious to the property or improvements
in the vicinity and zone in which the subject property is situated.
