VE-49-79 . f ZONING ADJUSTOR FINDINGS & ORDER Hearing: April 4, 1979 Minutes Written : May 2, 1979 VARIANCE VE-49-79, REAR YARD SETBACK ZON I NG ADJUSTOR DECISION : After public testimony and review, the decision of the Zoning Adjustor is to approve the applicant's request for a Rear Yard Setback Variance. A. FINDINGS FOR APPROVAL: Pursuant to Section 4.25.030 (b) of the Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility of determining that the granting of a Variance will not be detrimental to the surrounding properties. In assuring compatibility, the Zoning Adjustor based his decision on the testimony presented at the April 4, 1979 Zoning Adjustor Hearing as well as criteria set forth in the Spokane County Zoning 4rdinance for issuance of a Variance. The Zoning Adjustor hereby finds the following: 1. A recent Special Conditional Use granted to the Valley Eagles showed that a large parking lot is to be located north of this said Variance request. 2. After a site inspection, the Zoning Adjustor is of the opinion that the granting of the Variance will not be materially detrimental to the public welfare or in- jurious to the property or improvements in the vicinity. 3. The Zoning Adjustor noted that there are existing similar uses within the area and that the granting of this Variance would not constitute a granting of specia) privileges. B. ORDER: 1. Prior to the issuance of a building permit, the applicant shall submit evidence to the satisfaction of the Short Plat Administrator, which shows compliance with the Short Plat Ordinance. 2. There shall be no further segregations or divisions of land unless said seg- regations are in compliance with State and local platting laws. 3. The applicant shall maintain his site design in substantial conformance with the "plot plan" on file with this application, and in any case, shall observe all setback requirements as prescribed by the Spokane County Zoning Ordinance.
