VE-157-79, RELAXATION OF LOT AREA REQUIREMENTS
ZON I NG ADJUSTOR DEC I51 ON : After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a Special Permit and
Variance.
A. FINDINGS: Pursuant to Section 4.25.030 of the Spokane County Zoning
Ordinance, the Zoning Adjustor has the responsibility of determining that the
granting of this application will not be detrimental to the surrounding
properties. In assuring compatibility, the Zoning Adjustor based his decision
on the testimony presented at the above noted Zoning Adjustor Hearing as well
as criteria set forth in the Spokane County Zoning Ordinance for review of this
application. The Zoning Adjustor hereby finds the following:
1. Applicant's proposal is consistent with the criteria set forth for the
establishment of duplexes in the Agricultural zone, a duplex is already
established on the lot directly to the south of the applicant's proposal.
2. No parties spoke in opposition to the request nor were any written
comments objecting to this application received.
3. This area is in transition from agricultural to more intensive residential
uses.
Future development in this area could be
facilitated through a change of zone to an appropriate residential classifi-
cation.
4. The applicant's file is in order and no adverse public impacts resulting
from approval of this action are noted.
B. ORDER:
Applicant's request is hereby approved and with the following stipulations;
1. The applicant shall maintain his site design in substantial conformance with
the "plot plan" on file with this application, and in any case, shall observe
all setback requirements as prescribed by the Spokane County Zoning
Ordinance. ~r
2. Applicant will dedicate 10 feet right-of-way along WasFter Road for improve-
ment to County road standards.
3. The subject property will be landscaped to help establish an attracttve
residential area.
4. Applicant will execute a signed and notarized indemnity agreement with
Spokane County.
