VE-197-79 ZONING ADJUSTOR FINDINGS & ORDER Hearing : November 14, 1979 Decision Made: November 14, 1979 Findings Written: November 20, 1979 VARIANCE VE-197-79, RELAXATION OF FRONT YARD SETBACK REQUIREMENTS ZON I NG ADJUSTOR DEC ISlON : After publ ic testimony and review, the decision af the Zoning Adjustor is to approve the applicant's request for a Variance. A. FINDINGS: Pursuant to Section 4.25.030 of the Spokane County Zoning 4rdinance, the Zoning Adjustor has the responsibility of determining that the granttng of this application will not be detrimental to the surrounding properties. In assuring compatibility, the Zoning Adjustor based his decision on the testimony presented at the above noted Zoning Adjustor Hearing as well as criteria set forth in the Spokane County Zoning Ordinance for review of this application. The Zoning Adjustor hereby finds the following: 1. The site has been used as a church site for many years prior to applicant's proposal which would not alter the use of the buildi-ag. _ Further, applicant is making substantial repairs and renovations to the structure to update and upgrade it. 2. The Spokane County Engineers and Spokane County Health District had no health or safety concerns associated with applicant's request and applicant had already agreed to participate in any future road improvement projects. 3. Applicant stated that the church's service rites required the existing church be modified but that such modification would not encroach any futher on the right-of-way than existing structures already do. 4. After a site inspection, the Zoning Adjustor is of the opinion that the granting of the Variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. ~ B. The applicant shall maintain his site design in substantial conformance with the "plot plan" on file with this application, and in any case, shall observe all other setback requirements as prescribed by the Spokane County Zoning Ordinance.
