IN THE MATTER OF VE-37-82; ) FINDINGS OF FACT, DECISION
JAMES WELSH AND ROBERT CARTER ) AND CONDITIONS
THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane
County, approving the application VE-37-82, for the purpose of a rear yard
setback variance, hereinafter referred to as the "Proposal", and the Zoning
Adjustor of Spokane County having held a public hearing on March 8, 1982
and having fully considered all testimony presented thereat, and further
having visited the site and vicinity in question, and having rendered a
decision on the 8th day of March, 1982, approving said proposal does here-
by make the following:
FINDINGS OF FACT
1. That the proposal is generally located on the north side of Mission
Avenue, east of Fancher Road on Parcel #1253301603.
2. That the proposal consists of construction of an industrial building
with a 5 foot rear yard setback in a Manufacturing Zone.
3. That the Spokane County Generalized Comprehensive Land Use Plan in-
dicates Industrial usage of the area encompassed by the proposal.
4. That the site is zoned Manufacturing.
5. That the existing land uses in the area of proposal include industrial
uses, railroad right-of-way and undeveloped la nd.
6. That the proposal is compatible with existing uses in the area.
7. That the proposal is not detrimental or otherwise harmful to the public
health, safety and welfare.
8. That the proposal is totally consistent with the surrounding land use
classification and does not grant a special privilege or rights to the appli-
cant different than those enjoyed by adjacent property owners.
9. That the proper legal requirements for advertizing of the hearing be-
fore the Zoning Adjustor of Spokane County have been met.
10. That Burlington Northern Railroad correspondence dated February 18, 1982
was received stating no objection to the construction as proposed.
DECISION
From the foregoing Findings, a review of the Planning Department File No.
VE-37-82, testimony at the public hearing, and a site visit, the Zoning Adjustor
hereby in approving the proposal makes the following conditions:
A. COUNTY PLANNING DEPARTMENT
1) A recorded agreement for the maintenance of the private road shall be
submitted to the Planning Department for review.
2) A recorded easement consistent with that indicated in the application/
file shall be submitted to the Planning Department.
3) Prior to the issuance of a building permit the Planning Department shall
review and sign the permit to assure that the conditions of this approval
are complied with.
B. COUNTY BUILDING AND SAFETY DEPARTMENT
1) All future buildings and structures require building permit as per
Section 301 of the Uniform Building Code.

C. COUNTY HEALTH DISTRICT
1) Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2) Subject to specific application approval and issuance of permits by
the Health Officer, the use of individual on -site sewage system may
be authorized.
3) Water service must be coordinated through the Director of Utilities,
Spokane County.
4) A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Health District prior to the
issuance of any building permit for this project.
5) Water service shall be by an existing public water supply when approved
by the Regional Engineer (Spokane), State Department of Social and
Health Services.
6) Disposal of sewage effluent beneath paved surfaces is currently pro-
hibited.
E. COUNTY ENINGEERING DEPARTMENT
1) An approach permit must be obtained from the County Engineer for any
new approaches to the County Road system.
