PROJECT DESCRIPTION
The above described application was approved in part by the Zoning Ac~justor. The
Spokane County Zoning Ordinance requires commercial buildings be setback 65 feet
from the centerline of the riqht-of-way. The Zoning Adjustor on August 17, 1983
approved a centerlirie setback of 50 feet, generally in conformance with setbacks
generally along Skipworth. The applicant had requested a 40 foot setback. The
applicant filed an Appeal on August 23, 1983 stating generally that: 1) the
requested variance is necessary for septic tank placement; 2) the variance, if
approved, will improve the visibility of the proposed structure.

THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane County; ,
APPROVING IN PART the application (VE-124-83), for the purpose of relaxing front
yard setback requirements, hereinafter referred to as the "Proposal", and the •
• Zoning Adjustor of Spokane County having held a public hearing.on August 3, 7983
and having fully considered all testimony presented thereat, and further having
visited the site and v.icinity in question, and having rendered a decision on the
' 17th day of August, 1983, APPROVING IN PART said p roposal, does hereby make the
following;
FINDINGS OF FACT
1. That the proposal is generally located adjacent to and west of Skipworth
Street just north of Sprague Avenue; in Section 16-25-44. Parcel #16543-0541.

A. INTRODUCTION
This matter having come before the Examiner Committee on January 8, 1981, and
the members of the Committee present being Jane Myers, Chairperson, Eldori
Thomas and Paul Sceva, Jr.
B. PROPOSAL
7he sponsor, Richard D. Taylor, is requesting approval of a zone reclassifica-
tion, File No. ZE-143-80, Agricultural Suburban to Commercial, f'or the puepose
of develnping retail outlets.
C. FINDINGS OF FACT
1. That [he existing land use in the area is residential, 4cominercial and urban
landscaping.
2. That the Comprehensive Plan designates this area as iappropriate Por resi-
dential development.
3. That the existing zoning of the property described'in tlie application is
Agi-icultural Suburban.
4. That the provisions of RC1N 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the prroper legal requirements for adverCisement of the Agenda Item
Iiave been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the applicant has dernonstrated that concliCions have substantially
changed since the original zoning of tFiis area and accordingly, Lhe pro-
posed rezaie is justified.
8. That the proposed use is compatible with existing uses in the area. '
9. That the owners of ad'}acent lands expressed disapproval of [he proposed
use.
10. 7he Hearing Examiner Gommittee finds the proposed use fo be in harmony

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY PLANNING DEF'ARTMENT•
1. -fhat the provisions of SEPA's NOTICE OF ACTION pursuant to Chap-
ter 43.21C.080 RCtiV and the Board of Spokane County Commissioners
Resolution #77-1392 be initiated by the project applicant within [hirty
(30) days oF final disposition oF this application, and prior to any
on-site improvements.
2. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA _Guide-
lines (WAC 197-10) and the Spokane County Environmental Ordinance
(SCEO), a proposed declaration of non-significance has been issued at
least fifteen (15) days prior- to this date; the officia! Pile, written
comments and/or public testimony contain iniormation regarding assess=
ment oP Che proposal's adverse impacCs to the physical envir-onment; a
finding is hereby made that no poCentialfy significant adverse impacts
upon the physical environment are anCicipaCed as a result of the pro-
jecE; and a final dedaration of non-significance is hereby to be issued:
3. Appr-oval by the Zening Administrator of a specific lighting and sigri-
ing pfan for the described property prior to the release of any build-
ing permits.
4. A specific landscape plan, planting schedule and provisions for mainten-
ance acceptable to the 5pokane Coi.inty Zoning AdminisCrator shall be
submitted with a performance bond for the project prior to i-elease of
building permits.
5. Direct light from any exterior area lighting fixture shall not extend
over Che property boundary.
6. All current standards of the Commercial Zone, as amended, shall be
complied avith in the development of this site.
7. Signs for this project shall conform to standards as set forth in Section
4.09.125 Signs.
8. Landscaping shall be pi-ovided for this site, in conformance with SCand-
ards as identified in Section 4.07A.120 Landscaping.
9. A 6-foot sight-obscuring barrier shall be provided along the north and
west property Iines of this proposal to provide a buffer for the exist-
ing single family use located immediately north and evest of Chis site.
10. Applicant shall comply with '208' reconimendations concerning storm-
water runoPf and provide necessaiy landscaping for runoff.
11, Prior to issuance of building permits a revised site plan considering
the commercial use touth of Che site shall be submitted to t:he Zoning
Administrator for approval. 71ie revised plan shall aiso attempt to
save the existing Meuntain Ash ti°ees on site.

b) COUNTY ENGINEERING DEPARTh9ENT
1. Applicant shall dedicate 5 feet on Skipworth Road.
2. Applicant shall construct cemenC concrete curb and sidewalk and pave
to the existing pavement adjacent to the piroperCy on Slcipworth Road.
3. Applicant shall submit for approval by the Spokane County Enginee'r
road, drainage, and access plans prior to the issuance of a building
permit on the property.
4. The applicant shall submit for approval by the Spol<ane County En-
gineer and the Spokane County 1-iealth DistricC a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project prior, to the issuance oP any building permit on LFie
property.
5. A parking plan and ti•afPic circulation plan shall be submitted and
approved by the Spokahe County Engineer prior to the issuance of a
building permit orti the property. The design, location, and ar-range-
ment of parking stalls shall be in accordance with standard traffic
engineering practices. Paving or surfacing as approved by the County
Engineer, will be required for any portion oP the project which is to
be occupied or traveled.by vehicles.
6. The word "applicant" shall include. the owner, or owners of the prop-
erty, his heirs, assigns, and successors.
7. The construction of the road improvements s[ated herein 5hall be
accomplished as approved by the Spol<ane County Engineer.
8. Ail required improvements shall conform to Che current State of 1Nash°,
ington Standai-d Specifications for Road and Bridge Construction, and
other applicable county standards in effect at the date of construction,
unless otherwise approved by the County Engineer.
c) COUNTY UTIL171E5 DEPARTMENT
1. Pursuant to Board of County Commissioners ResoluCion No. 80-0418;
the use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with ali rules and regulations
of the Spokane County NealCh DistricC and is further conditioned and
subject to specific application approval and issuance of permifs hy the
Health District.
2. The owner, his heirs or successors shall join and parCicipate in any
petition or i-esulution which purpose is Yhe formation of a uCility local
' improvement di,tricC (ULID) pursuant Co RCW, ChapCer 36.94, as
amended. The ownpi-, his Iieirs and successors sliall ft.mCher agree not
to oppose or pro[est any tegal assessmenCS for any utiliCy local improve-
ment district (ULID) established pursuanC to RCW Chaptei- 36.94, as
amended.

3. Any water service for th'is projecC shall be provided in accordance with
the Coordinated Water System Plan for Spokane County.

d) COUNTY HEALTH DISTRICT
1. Fiiidings:
a) This project lies over the Spokane Aquifer.
b) It is within Critical Water Supp(y Service Area #3 and vaithin the
service area of Modern Electric Company. Groundwater resources
appear adequate to support development at this density.
c) The project is inside the 201 Sewer Study Area Zone 3 and inside
the Primary Sanitary Sewer Area recommended in the "208" Study:
The method of sewage disposal is subject Co approval of the
Director oF Utilities pursuant to County Resolution 80-0418 adopted
March 24, 1980. The topography and soils in the area are gen-
eraliy suitable for use of individual on-sile sewage systems. The
lot is not of the proper dimensions to permit use of both an
individual well and sewage system.
2. Recommendations:
a) WaCer service must be coordinated through the Director, oP Utilities,
Spokane County.
b) Water service shall be by an existing pubiic water ,upply.
c) The use of individual Nvefls is not authorized.
d) Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
e) Subjer.t to specific application approval and issuance of permits by
the Health OfFicer, the use of individual on-site sewage disposal
systems may be authorized.
f) The owner, his heirs, and successors shall agree to noC protest
legal assessments and utility focal improvement districCs to provide
central sewerage service to this lot.
g) A combined surface water and 'sewage disposal deCailed plan shall
be approved by the County Engineer and the Hea!Ch OPficer prior
to the issuance of any building permit for this lot.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District 41.
2. Installation of fire hydrants to be in accordance with requirements of
the Spokane County Department of Building and Safety.
f) WATER PURVEYOR
1. _ Purveyor is Modern Electric Water Company, and they will supply the
site with adequate water for domestic, fire and irrigation uses.

IN THE MATTER OF: VE-124-83 ) RELAXATION OF FRONT YARD SETBACK FINDINGS OF FACT, DECISION
REQUIREMENTS - TAYLOR ) AND CONDITIONS
THIS MATTER, Being the consideration by the Zoning Adjustor o` Spokane County,
APPROVING IN PART the application (VE-124-83), fon the purpose of relaxinq front
yard setback requirements, hereinafzer referred to as the "Prooosal", and the
Zoning Adjustor of Spokane County having held a public hearing on August 3, 1983
and having fully considered all testimony presented thereat, and further having
visited the site and vicinity in question, and having rendered a decision on the
17th day of August, 1983, APPROVING IN PART said proposal, does hereby make the
following;
FINDINGS OF FACT
l. That the proposal is generally located adjacent to and west of Skipworth
Street just north of Sprague Avenue, in Section 16-25-44. Parcel #16543-0541.
2. That the proposal consists of a request to locate a commercial building
15 feet from the property line at Skipworth, which is the required front yard
prooerty line on Skipworth, whereas, the Commercial Zone on which the proper±y
is located requires a 45 foot setback in that Skipworth has presently a 45 foot
right-of-way, following the dedication required in ZE-142-80.
3. That the adopted Spokane County Generalized Comprehensive Land Use Plan
indicates Commercial usage of the area encompassed by the proposal.
4. That the site is zoned Commercial.
5. That the existing land uses in the area of proposal include commercial
uses to the south and multi-family and single family residences to the north and
east.
6. That the applicant indicated that a setback variance was in order due to
a 15 foot setback for property immediately to the south, fronting on Sqrague
Avenue.
7. The Zoning Ac~justor notes that the apprnpriate setback for the business
structure on Sprague Avenue would be a flanking yard unless entitled to a reduced
setback under the terms of the Spokane County Zonin9 Ordinance.
8. That the apartment comolex to the east of the proposed structure and the
other residences on the west side of Skipworth appear to maintain a uniform set-
back of approximately 25 to 35 feet from the prooerty line.
9. That the applicant's petition for a rezone of the property occurred in.
1980 indicating ability to maintain a 30 foot setback from Skipworth Street and
that the applicant made no specific indication whether the original plot plan cannot
be generally complied with at this time.
10. The Zoning Adjustor finds that there is an established building line of
approximately 25 foot setback which has been applied to other properties in the
vicinity, and which o-+ill allow for the future expansion and safe traffic control
of Skipworth Street so that it can continue to develop for commercial and urban
residential purposes.
11. That the proposal otherwise meets all current standards of the Spokane
County Zoning Ordinance for this use.
12. That the prooer legal requirements for advertising of the hearing before
the Zoning Adjustor of Spokane Courity have been met.
CONCLUSION
l. That due to the established_setback along Skipworth Street, the granting
of some relief to the applicant is both appropriate and consistent Uiith the
development in the vicinity

2. Zoning Ordinance requirements for a 45 foot setback from the center line
of Skipworth Street appears excessive in line of other developments in the vicinity,
and that by requiring the applicant to r.iaintain the 25 foot setback from the Skip-
, worth prooerty line, after the 5 foot dedication required in the rezoning of the
property, (File ZE-142-30), will both maintain,the general character of the area and
will not be otherwise significantly detrimental to the public health, safety and
wel fare.
DECISION"
From the foregoing Findings, a review of the Planning Department File Dlo.
VE-_124-83, testimony at the_public hearing, and a site visit, the Zoning Adiustor
hereby qrants the applicant a variance to allow his commercial structure to locate
no closer than 25 feet from the front property line, after dedication, at Skipworth
Street subject to the following conditions: A. COUNTY PLANNINr DEPARTMENT
1) That the development and use of the property be in general conformance
with the requirements of Zone Change File No. ZE-142-80 and the specific

PROJECT DESCRIPTION
The above described application was approved in part by the Zoning Adjustor. The
Spokane County Zoning Ordinance requires commercial buildings be setback 65 feet
from the centerline of the right-of-way. The Zoning Adjustor on August 17, 1983
approved a centerline setback of 50 feet, gene'rally in conformance with setbacks
9enerally along Skipworth. The applicant had requested a 40 foot setback. The
applicant filed an Appeal on August 23, 1983 stating generally that: 1) the
requested variance is necessary for septic tank placement;.2) the variance, if
approved, will improve the visibility of the proposed structure.
