CUE-54-84 ~ ZONIPdG ADJUSTOR SPOKANE COUt~TY , WASH I ~~GTON IN THE MATTER OF CUE-54-~4; TANOEM TRUCK ) FINDINGS OF FACT, SALES - AUTO/TRUCK WRECKING YARD ) DECISION AND CONDITIONS THIS t~1ATTER, Being the consideration by the Zoning Adjustor of Spokane County, in hearing application CUE-54-84, hereinafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County having held a ~ublic I~earing on December 12, 1984, and having fully considered all testimony presented thereat, and further having visited the site and vicinity in question, and having rendered a decision on the 28th day of December, 1984, APPROVING said proposal, does hereby make the following: FINGINGS OF FACT 1. That the proposal is generally located on the northeast corner of Sharp Avenue and Howe Street in Section 14, Township 25, Range 43, Spokane County. 2. That the proposal consists of the establishment of an auto and truck dismantl ing, repair and sell ing of corr~ponent parts facil ity on a 2.3 acre site within the Manufacturing Zone. 3. That the adopted Spokane County Generalized Comprehensive Land Use Plan indicates Industrial usage of the area encompassed by the propcsal. That the proposal generally does conform to the density and use guidelines of the County Land Use Plan. 4. That the site is zoned Manufacturing which would allow this use upon approval of this application. 5. That the existing la nd uses in the area of proposal include generally commercial/industrial activities. ~~1any of the businesszs i~ the area invol~e heavy machinery and trucking operations. 6. Tha t the applicant indicated they could comp'ly with agency recommenda- tions if this action were approved. 7. That this use is desired as an adjunct to the appl icants existing truck sales businESS on Valleyway A.venue. 8. That area owners appeared to oppose the proposal believing the activity would lower area property values and prevent the area from turning to Commercial zoning. 9. Tha t the Zoning Adjustor notes the proposal is consistent with the Spokane County Comprehensive Plan and that much of the area is zoned ~lanufact- uring. 10. From all apparent circumstances, the proposal if properly developed will be compatible with existing uses and not injurious to property values in the area. 11. Tha t the proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane Cou nty have been met. The purpose of such a tJOTICE OF ACTION is to establish a time limitation upon which the environmental determination for this project can be challenged. Alternatively, the applicant may waive the NOTICE OF ACTIOPJ requirements by fil ing the appropriate documents provided by the Spokane County Planning Oepartment. 2) A sight-obscuring fence must be constructed and inspected nrior to the issuance of a certificate of occupancy for use of the yard. 3) The fence sha 11 be a mi nimum of s ix feet i n hei ght. 4) The fence shall be of a single solid color. 5) No automobile or parts thereof, junk or slavage materials or parts thereof shal l be visible from any publ ic right of way. All material s or parts shall be loca ted within the fenced area. 6) Approvai is granted until January 1, 1987 at which time the applicant shal 1 seek an admi ni stra tive revi ew to i nsure conformance wi th condi tions of approval. 7) All buildinqs and structures require building permits as oer Section 301 of the Uniform Buildinq Code. 8) Access nermits for approaches to the Countv Road Svstem shall be obtained from the Spokane County Engineer. 9) Applicant shall improve Railroad Avenue in a manner consistent with Spokane County TYPICAL roadway Section No. 1 minimum paving width access • standards. 10) Applicant shall improve Howe Street in a manner consistent with Spokane Cou nty TYPICAL roadway section No. 1 minimum paving wid th Access Standards. il) Applicant shall improve Sharp Avenue in a manner consistent with Spokane County TYPICAL roadway Section No. 1 minimum paving with Access Standards. 12) Appl icant shall submi t for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. 13) The appl icant shal l submi t for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 14) A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engi neer prior to the i ssuance of a bu i 1 di ng permi t on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the Spokane County Engineer, will be required for any portion of the project which is to be occupied or travelled by vehicles. 15) The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. continued ~ FINDINGS OF FACT, DECISION AND CONDITIONS CUE-54-84 PAGE 3 CONDITIONS OF APPROVAL (CONTINUED) 16) To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolu tion which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improve- ments. 17) As an alterna tive me thod of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Projec t(CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 18) The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 19) Al1 required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other appl i- cable county standards and or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction unless otherwise approved by the County Engineer. 20) Applicant shall construct a paved delineated access aporoach(s) to meet the existing pavement on Nowe Street. 21} Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane County Board of County Commissioners Resolution No. 80-1592, as amended. 22) Subjer.t to specific appl ication approval and issuance of permits by the Health Officer, the use of an individual on-site sewage system may be au thorized. 23) Wa ter service shall be by an existing public vrater supply when approved by the Regional Engineer (Spokane), State Department of Social and Heal th Services. 24) The Owner(s) or Successor(s) i n i nteres t agree to au thori ze the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolu tion method pursuant to RCW Chapter 36.94 which includes the Owner(s) property.
