VARIANCE
VE-28-80, RELAXATION OF REAR YARD SETBACK
ZONING ADJUSTOR DECISION: After public testimony and review, the decision of the.
Zoning Adjustor is to approve the applicant's request for a variance.
A. FINDINGS: Pursuant to Section 4.25.030 of the Spokane County Zoning Ordinance
the Zoning Adjustor has the responsibility of determining that the granting of this
application will not be detrimental to the surrounding properties. In assuring com-
patibility, the Zoning Adjustor based his decision on the testimony presented at the
above noted Zoning Adjustor Hearing as well as criteria set forth in the Spokane
County Zoning Ordinance for review of this application. The Zoning Adjustor hereby
finds the following:
1. Applicants parcel is quite narrow which makes normal development of the property
extremely difficult if required front and rear yard setbacks are inforced.
2. Applicants rear property line abuts the Interstate Freeway and as such the pro-
posed setback variation would not represent any hardship to adjoining properties.
3. Applicants proposed use of the property is consistent with the zoning classification
and is otherwise found to be compatible with adjacent uses.
4. From comments received of County Agencies and the general public and after a
site inspection, the Zoning Adjustor is of the opinion that the granting of the
variance will not be materially detrimental to the public welfare or injurious
to the property or improvements in the vicinity.
5. The Zoning Adjustor concurs that the front building line is established at 20 feet
from the public right of way.
B. ORDER:
Applicant's request is hereby approved and with the following stipulations:
1. The applicant shall maintain his site design in substantial conformance with the
"plot plan" on file with this application, and in any case, shall observe all
other requirements as prescribed by the Spokane County Zoning Ordinance.
2. Applicant shall obtain surface water and waste water disposal from the Spokane
County Health District and County Engineers Office.
3. Applicant shall execute Local Improvement District agreement with the County
Utilities Department to provide future sewerage service to this lot.
