VE-179-82 s• ~ - ~ ZON INr ADJUSTOR SPOK/aNE COUNTY, WASHIPJGTON ~ ~ ti IN THE MATTER OF VE-179-82; MASCO BLDERS. ) FINDINGS OF FACT, DE~ ISION_ ; REQUEST FOR A FRONT YARD SETBACK FOR A ) AfJD CONDITIONS - S INGLE FAM I LY RES I DENCE THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane County, abproving the application (UE-179-82), for the purpose of buildinq a single family residence, hereinafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County havinq held a public hearing on December l, 1982 and havinq fully considered all testimony presented thereat, and further having visited the site and vicinity in question, and having rendered a de- cision on the 3rd day of December, 1982 apqroving said proposal does hereby make the fol lowing : FINDINGS OF FACT 1. That the proposal is qenerally located on the easet side of the intersection of Woodlawn Ave. and 8th Avenue in Section 23-25-43 in Spokane County, Washinqton. 2. That the pronosal con'sists of constructing a home with a 10' front yard setback on Woodlawn Avenue. 3. That the adopted Spokane County Generalized Comprehensive Land Use Plan indicates Urban usage of the area encompassed by the proposal. 4. That the site is zoned Aqricultural Suburban. • 5. That the existing land uses in the area of proposal include single family residences. 6. That the proposal is compatible 4vith existing uses ir the area. 7. That the proposal is not detrimental or otherwise hari»ful to the public health, safety and 4velfare. 8. That public testimony at the hearinq showed no opposition or concern regarding this proposal. 9. That the subject lot is qenerally triangular in shape, and fronted on 3 sides with roads which makes standard development difficult. 10. That the proposal otherwise meets all current standards of the Spokane County Zoning Ordinance for this use. 11. That the proper legal requireiTients for advertising of the hearing be- Fore the Zoninq Ad,justor of Spokane County have been met. DECISION From the foregoing Findings, a review of the Planninq Department File No. VE-179-82, testimony at the public hearinq, and a site visit, the Zoninq Adjustor hereby in approving said proposal iTiakes the following conditions: A. COUNTY PLANN ING DEPARTh1ENT 1) That the site be developed in conformance with the plot plan sub- mitted in con,junction with this application. 2) That the project otherwise conform to all the standards of the Aqricultural Suburban zone. 6. UTILITIES DEPARTMENT 1) Pursuant to the Board of County CoiTimi ss i oners Resol uti on No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and requ- lations of the Spokane County Health District and is further condition- ed and subject to specific application approval and issuance of permits byr the Hea 1 th Di stri ct . 2) The owner, his heirs or successors shall join and participate in any petition or resolution which purpose is the formation of a utility local improvement district (ULID) pursuant to RCW Chapter 36.94, as amended. The owner, his heirs and successors shall further agree not to oppose or protest any legal assessments f or any utility local im- provement district (ULID) established pursuant to RCGJ Chapter 36.94, as amended. 3) Any water service for this projec-t shall be provided in accordance with the Coordinated Water System Plan for Spokane County. 4) The dwelling unit shall be double plumbed f or connection to future area-wide collection systems. D. HEALTH DISTRICT 1) Sub.ject to saecific application approval and issuance of permits bv the Health Officer, the use of individua1 on-site sevrage s,ystem may be authorized. 2) Water service shall be by an existing public water supply wlien approved by the Region al Engineer (Spokane), State Department of Social and Health Services. 3) Use of private wells and water systems is prohibited. E. ENGINEERING DEPARTMENT 1) Applicant should be advised that an approach permit must be obtained from the County Engineer Prior to construction of a driveway approach.
