In review of the file, it is noted the the Department of Building and Safety noted that all buildings and structures or fences in excess of 6 feet in height would require permits pursuant to Section 301 of the Uniform Build- ing Code. Mr. Bob McCann representinq the County Engineer's Office at the hearing, stated that he was satisfied that the proposal will not encroach upon an,y public right-of-way, and therefore, had no further comments or recommenda- tions. There were no other comments from county departments regarding this application. V. . It is noted that the file does not contain a specific design proposal for the playqround. The applicant stated that they were seeking the approval before commencinq with the actual design work of the playground. The Zoning Adjustor in granting the approval at the hearing, requested that prior to the construct- ion of the playaround, a detailed site plan be submitted to the file in order to complete the public record. VI. The applicant stated that the playqround will be attractively landscaped and would actually be improving sight distances for vehicles entering onto Sprague Avenue. " I • VII. The opportunity.was afforded at the hearing to any interested person to , testify regarding the applicant's proposal. No one appeared nor any written comments were received in opposition. VIII. From these Findinqs of Fact stated hereinabove the Zoning Adjustor writes the following Conclusion: The Zoning Adjustor has concluded that this apolication is reasonable and just and is in keeping with the soirit and intent of the Zoning Ordinance. That the proposal is found not to be materially detrimental to the public welfare or injurious to the property and improvements in the vicinity and under the Commer- cial zone classification. To deny this application would be an act not supported by Findings of Fact and thus depriving a property owner of a basic right to use his property for a permitted use would be an unreasonable use of zoning law. Further, this apolication does not involve the erection of a substantial struct- ure but is a design to provide use of an open space area which will be maintain- ed in an attractive manner while at the same time enhancinq a business. CONDITIONS OF APPROVAL 1. P'r:a!or to the construction of the playground, the applicant shall submit to this file (VE-143-81) a final detailed olan includinq the location nf play equipment. The purpose of submittinq in final plan is to complete the file information and therefore does not require plan approval by.the Zoning Ad,justor. ~ 81.
