VE-194-82 RECEIVED',_ ZONING AGJUSTOR BpOgqqF fqppTY Bi9iiNE6 SPOKANE COUNTY, WASHINGTON JAN07~983 4- ; IN THE MATTER OF E-194-82 KAYO OIL ) FINDINGS OF FACT, DECISION ~ RELAXATION OF FLANKlI~"~iR'EET SETBACK ) AND CONDITIONS THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane County, approving the application (VE-194-82-82), for the purpose of expanding an existing commercial service station, hereinafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County having held a public hearing on January 5, 1983 and having fully considered all testimony presented thereat, and further having visited the site and vicinity in question, and having rendered a decision on the 7th day of January, 1983, APPROVING bJITH ',10DIFICAFIONS, said pi'oposal, does hereby make the following: FINDINGS OF FACT l. That the proposal is generally located adjacent to and north of Sinto Avenue between Argonne and Mullan Road. 2. That the proposal consists of expanding an existing service station totaards the flanking street (Sinto Avenue). 3. That the adopted Spokane County Generalized Comprehensive Land Use Plan indicates Commercial usage of the area encompassed by the proposal. 4. That the site is zoned Local Business. ' 5. That the existing land uses in the area of proposal include some residences, but predominantly commercial uses. 6. The Spokane County Zoning Ordinance requires Commercial buildinqs to observe a 50 foot setback from the centerline of the roadway or a 20 foot set- back.from the existing property line; whichever provides the greater setback. 7. Sinto Avenue at this site has a width of 50 feet which establishes that the minimum setback for this use as 25 feet from the property line. 8. The applicants proposal of an 11 foot setback is at a ooint between two driveways where regular ingress and egress to the site will occur. 9. The site itself shows no physical limitations which make the site difficult to develop, exeept the existing mandmade structures. 10. A review•of the site plan shows that the applicant can obtain much of the desired use of the property and still conform to a setback of 20 feet from the property line. 11. The allowance of a 20 foot setback affords the applicant some relief from existing standards and serves to protect auto and pedestrian traffic along Sinto Avenue. 12. That the proposal otherwise meets all current standards of the Spokane County Zoning Ordinance for this use. 13. That the proper legal requirements for advertising of the hearing be- fore the Zoning Adjustor of Spokane County have been met. DECISION • From the foregoing Findings, a review of the Planning Departinent File No. VE-194-82, testimony at the public hearing, and a site visit, the Zoning Adjustor hereby in approving a minimum 20 foot setback from the oroperty line along Sinto makes the following conditions: A. COUNTY PLANNING DEPARTMENT , 1) Al1 structures located along Sinto shall observe a minimum 20 foot setback. 2) All other standards of the Local Business Zone shall be complied with in the development of the site. ~/f.. DEPARTMENT OF BUILDING AND SAFETY 1) All buildings and structures require a building permit as per Section 301 of the Uniform Building Code. C. ntALTH DISTRICT 1) Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2) Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage system , may be authqi°ized. 3) Use of private wells and water is prohibited. 4) Disposal of sewage effluent beneath paved surfaces is currently oro- hibited. .
