Gentlemen: On February 3, 1983, the Hearina Examiner Committee met at 9:00 A.M. to consider one new zone reclassification application. P1embers present: Mrs. Carstens, Chairperson; and Messrs. Skalstad and McVicker. Following is the applica±ion and the action taken by the Committee. If not appealed, this decision will become final on February 18, 1983. The Findings and Order for this hearing were signed on Fe6ruary 8, 1983. 1) ZE-97-82, Aqricultural Suburban to Local Business - and - VE- 2-83, Variance to tlie Front Yard Setback Requirements Alonq Arqonne Road and Mullan Rdad: W.A:M. Enterbrises. Inc. Location: Generally located in the Spokane Valley, betvreen Argonne Road and Mullan Road and lyinq south of Sinto Avenue in Section 17-25-44. Proposal: Furniture Store and other Retail Uses. Action: Approval. (Vote: 3 - 0) The Zoning Ad,justor's decision was for Approval of the Variance request, subject to the conditions, attached to the Zone Change, ZE-97-82, per the Findings of Fact stated in the Findings and ~ Order on file with VE-2-83. WTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on February 3, 1983, and the members of the Committee present being Kathleen M. Carstens, Chairperson, Richard L. Skaistad, and Ronald L. McVicker. B. PROPOSAL 7he sponsor, W.A.M. Enterprises, Inc., is requesting approval of a zone reclassification, File No. ZE-97-82, Agricultural Suburban to Local Business, for the purpose of developing a furniture store and other retail uses. The applicant has also applied for a Variance, VE-2-83, for approval of front yard setbacks along Argonne and Mullan Roads. C. FINDINGS OF FACT 1. That the existing land use in the area is residential, commercial, and vacant. 2. That the Comprehensive Plan designates this area as appropriate for Major Commerciai development. ~ 3. That the existing zoning of the property described in the application is Agricultural Suburban. 4. That the provisions of RCW 43.21C (The StaYe Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of Non-Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for Che proposed use, or uses within the proposed Zone Classification. . 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of: this area and accordingly, the pro- posed rezone is justified. 8. That the proposed use'is compatible with existing uses in the area. 9. That the owner of adjacent land expressed approval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in harmony with the generaf purpose and eviil not be otherwise detrimental to the public health, safety, and welfare. 1 • File No. ZE-97-82 & VE- 2-83 ; C. FINDINGS OF FACT (continued) 11. The following are additional findinqs of fact considered by the Hearing Examiner Committee: a) That control of the property density will be maintained by review of the parking requirements prior to the issuance of any building permits or certificates of occupancy. D. CONDITIONS OR CONTINGENCI.ES APPLIED TO TFiIS APPROVAL a) COUNTY PLANNING DEPARTMENT 1. Approval by the Zoning Administrator of a specific lighting and sign- ing plan for the described property prior to the release of any build- ing permits. 2. A specific landscape plan, planting schedule and provisions for main- tenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. 3. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent,of the develop- ment plans shall be maintained. 4. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 5. AIl current standards of the Local Business Zone, as amended, shall be complied with in the development of this site. 6. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commissioners Resolution #77-1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on-site improvements, or Pile appropriate documents to the effect that the NOTICE OF ACTION is waived in accordance with Spokane County Commissioners' Resolution #82-0458 dated May 4, 1982. 7. Parking requirements as set forth in the Zoning Ordinance shall be complied with should a change in land use or occupancy occur. 2 . File No. ZE-97-82 & VE- 2-83 , a) COUNTY PLANNING DEPARTMENT (continued) 8. That the approval for the proposed project be given for the specific site plan as presented to the Hearing Examlr+er CommiCtee. b) COUNTY ENGINEERING DEPARTMENT Prior to the Issuance of' a Buildinq Permit: 1. Access permits for approaches to the County Road System shall ' be obtained from the Spokane County Engineer. 2. Applicant shall submit for approval by the Spokane County Engineer drainage and access plans prior to the issuance of a building permit on the property. 3. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrange- ment of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, wili be required for any portion of the project which is to be occupied or traveled by vehicles. 5. 7he word' "applicant" shall - include the owner or owners of the property, his heirs, assigns, and successors. 6. The construction of the road improvements stated herein shall be accomp{ished as approved by the Spokane County Engineer. 7. AII required improvements shall conform to the current State of Washington Standard Specifications for Road and 6ridge Construc- tion, and other applicable county standards and/or adopted reso- lutions pertaining to Road Standards and Stormwater Manage- mentin effect at the date of construction, unless otherwise approved by the County Engineer. 8. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commis- sioners' Resolution No. 80-1592 as amended. 9. Applicant shall consult with the County Engineer's Department in order to determine the location of driveway approaches to Sinto Avenue, Argonne Road and Mullan Road. 3 File No. ZE-97-82 & VE- 2-83 , c) COUN7Y UTILITIES DEPARTMENT 1.. Pursuant to Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health D'+strict. 2. The owner, his heirs or successors shall join and participate in any petition or resolution which purpose is the formation of a utility local improvement district. (ULID) pursuant to RCW, Chapter 36.94, as amended. 7he owner, his heirs and successors shall further agree not to oppose or protest any legal assessments for any utility local improvement district (ULID) established pursuant to RCW Chapter 36.94, as amended. 3. Any water service for, this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County. 4. Each unit shall be double plumbed for connection to future area- wide collect+on system. d) CpUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the HeaVth District prior to the issuance of any building permit for this project. 2. Sewage disposal method shall be as authorized by the pirector of Utilities, Spokane County. 3. Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage system may.be authorized. 4. Water service must be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 4 File No. ZE-97-82 & VE- 2-83 e) COUNTY BUILDING AND SAFETY DEPARTMENT 1. The site is located in Fire District #1. 2. Mains and hydrants to be installed, in accordance with the Spokane County Department of Building and Safety. 3. Reclassification of an existing building shall require an applica- tion for change of occupancy permit, and subsequent inspection for approval. 4. Premises Identification. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Said numbers shall contrast with their background. f) WATER PURVEYOR 1. Purveyor is Modern Electric Water Company, and they are a61e to supply the site with adequate water for domestic, fire and irrigation uses. 2. Satisfactory arrangements have not yet been made to serve this proposal by Modern Electric. g) CdUNTY AIR POLLUTION CONTROL AUTHORITY ' 1. No comments received. h) STATE DEPARTMENT OF TRANSPORTATION 1. The Washington State Department of Transportation doe not have any comment on this application. i) '208' STUDY 1. Applicant shall comply with 1208' recommendations concerning stormwater runoff and provide necessary landscaping for runoPf. j) SPOKANE CITY/COUNTY HISTORIC PRESERVATIOM OFFICE 1. ZONING ADJUSTOR DECISION: V E-2-83 Findings of Fact: 1) The Zoning Adjustor finds that Argonne and Mullan Roads are not full 60-foot width roadways, and the Spokane Coun[y Engineer's Office has not asked for additional right of way. 2) That the proposal provides a minimum of 35-foot setbacks from all major roads, and no concern of sight obstruction was expressed by the Spokane County Engineer's. 3) That no concerns or adverse comments to the proposal were raised by adjacent property owners. 4) That the approval of the proposed Variance is not the granting of a special privilege, as other Variances have been approved in the immediate vicinity. 5) The property is adjoined by roads not of standard County width.
