ZONE ~ CONDITIONS THIS MATTER, 6eing the consideration by the Zoning Adjustor of Spokane County, i n heari ng appl i cati on YE-121~-84, herei nafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County having held a public heari ng an September ~ 2, 19~ a„~ ~a~~ ~^y fu~ ~y consi de~ed a i 1 testir~ony presented thereat, and further havi ng vi si ted the si te and vi ci ni ty i n question, and having rendered a decision on the 24th day of September, 1984, APPROVING said proposal, does hereby make the following: FINDINGS OF FACT l, That the proposal is generally located on the southwest corner of Sprague Avenue and Coleman Road in Section 24-25-43. Parcel #24531-0901, ~ 2. That the proposal consists of allowing a 14' high canopy over a gas station pump island to be located 2 feet from the front property line whereas the Spokane County Zoning Ordinance requires a 5 foot setback. 3. That the adopted Spokane County General i zed Comprehensi ve land Use ' Plan indicates Comnercial usage of the area encompassed by the proposal. That the proposal general ly does conform to the densi ty and use gui del i nes of the - County Land Use Plan. 4. That the site is zoned Comnercial which would allow this use upon approval of thi s appl i cati on. 5, iha~ the exi~ting iand uses in tne ar~ea o~ propo~al include an autodealership, auto car wash and gas station and other businesses which do appear compatible with the proposal. 6. That the request i s brought about by the current i ocati on of the gas pumps which are located close to Sprague Avenue and are not coveed. By not being covered there is a definite loss of business at the station when it rai ns or snows. 1. That are businessmen appeared to go on record as opposed to the project as proposed because the canopy woul d detract f rom the vi si bi 1 i ty of thei r si gns and busi ness. 8. That the proposed canopy height of 14'6" will result in some loss of vi si bi 1 i ty to the Li ncol n Mercury deal ershi p si gn immedi ately west of the proposal. Nowever the obstruction appears minimal and is much less than would be a solid sign which the applicant could locate on the property in this zone. 9. That the proposed canopy will have no impact on the auto dealership in regards to east bound traffic because the sign is not obstructed and that the impact to the car wash and service station to the east of Time Oils , r~'v^~~531 wou~ d be ~i ~~~a? ~hw~ ~~:~ro ; ~ C~~S ~ L~~rabl e~; ~~►'C~~° ~2 ~~'~Fr ~~o businesses. . 10. That the applicant by raising the minimum height of the canopy t0 16' wi 11 remove substanti al ly al l objecti on to the proposal. 11. That the recommendation to raise the canopy height 1.5 feet to 16 feet is reasonable and wili reduce impacts on adjoining businesses. CONCLUSION Following review of the Planning Department file, consideration of the public testimony, and circumstances in the area, the Zoning Ad,justor concludes that the proposal as conditioned is not detrimental and is compatible to the publ ic heal th, safety and wel fare.
