THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane
County, in hearing the application (WUE-2-84), for the purpose of allowing
completion of a structure not meeting fl anking street setback requi rements,
hereinafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County having he1 d a publ i c hearing on February 22, 1984, and havi ng fiul ly ~
consi dered al 1 testi mony presented the reat, and further having vi si ted the
site and vicinity in question, and having rendered a decision on the 29th day
of February, ]984, ~DENYING said proposal, does hereby make the following:
FINDINGS OF FACT
1. Th at the p ropos al i s gene ral 1 y 1 o cate d at th e no rthe as t co rne r of Cement Lane and Empi re Lane in Section 3-25-44. Parcel #03543-0504.
2. That the p ropos al consi sts of app rovi ng footi ngs wh i ch are currentl y
5 feet from Cement Lane whereas the Zoning Administrator has determined a mini-
mum of ZO foot setback is requi red from the road.
3. That the adopted Spokane County General ized Cor~prehensive Land Use Plan indicates Urban usage of the area encompassed by the proposal.
4. That the si te i s zoned Restri cted Industri al .
5. That the existing land uses in the area of proposal include a cement
pl ant to the north, businesses to the west and resi dential uses to the south
of the site.
6. That the appl i cants representati~.ve coul d not speci f i cal ly expl ai n
how the footi ngs we re pou red at the i mp roper 1 ocati on. Publ i c tes ti mony an d
County records i n di cate the appl i cant and o r contracto r was noti f i ed by the
Pl anning Department, Bui 1 ding and Safety Department and area resi dents that
the footings ~vere being 1 ocated too close to the roadway. From al1 appearance
the appl i cant/contractor i gnored these con~ments.
7. That a Engineer's memorandum received by the Zoning Adjustor indicates
that the proposed structure may create a visual problem for traffic at the inter-
secti on i f the bui 1 di ng i s al ] a~wed to be bui 1 t at the pl acen~ent of the footi ngs.
8. That testimony from adjacent residents and business owners indicates
the waiver will have an adverse impact on auto and truck traffic in the area.
The adverse impact upon the trucking operations conducted di rectly west across Cement Lane f rom the proposal was of parti cul ar concern.
9, Waivers of Viol ation in the Spokane County Zoning Ordinance, Section
4.25.030 ~f) refers to buildings and structures which, in part at least, carries
the i mpress ion that a substanti al a~~ount of constructi on woul d be compl eted. In
the present situation, only the footings have been poured. The Zoning Adjustor
finds that the original error can be corrected without great hardship and that sur.h correction wi 11 nromote traffi c stafetv in the area.
CONCLUS IOId
Following review of the Planning Department file, consideration of the
publ ic testimony and ci rcumstances in the area of proposal, the Zoning Adjustor
concludes that the proposal is detrimental and is not compatible to the public
health, safety and welfare.
DECISION
From the foregoing Findings, a review of the Planning Department File No.
WVE-2-84, testimony at the publ i c heari ng and a si te vi si t, the Zoni ng Adjustor
hereby in DENY-ING the proposal establ ishes the fol lowing Order:
