IN THE MATTER OF ) FIN~INGS FAC , ' CUE-14-82; SHULER ) AND CQNDITIONS ~ THIS I~ATTER, Being the consideration by the Zonin~ Ad~ustor of Spok~ne ' County, approving the application (CUE~14-82~ for the purpose of a mobile home for a dependent relative, hereinafter ~eferred to as the "Proposa~", and the Zoning Adjustor of 5pokane County having hel~ a public hearing or~- September l, 1982 and having fully considered all testimon~r presented thereat, and further having visited the site and vicinity i~ question, anc~ ~ having rendered a decision on the Ist day of September, 1982, approving said proposal, does hereby make the following: FINDINGS OF F 0.3?~~'° ACT 1. That the proposal is generally ~,ocated on the northeast corner of Portland Avenue and Cement Street on Parcel 03543-0204. ' 2. T~at the proposal consists of a mobile home for a dependent re~.ative on a site with an existing residence. 3. That the adopted Spokane County Generalized Comprehensive Land Use Plan indicates Commercial usage of the area encompassed by the proposa]_. 4. That the site is zoned Agricultural. ~ . 5. That the existing land uses in the area of proposal include single family residence, and undeveloped land. , 6. That the.proposal is compatible with existin~ uses in ~.he area. 7. That the proposal is not detrimenta~ or otherwise harmful to the public health, safety and welfare. 8. That the proposal is not totally inconsistent with the surroundin~ ~ land use classification ~n~ does not grant a special privilege or rights to the applicant different than those en~oyed by ad,~acent property owners. 9. That the proper legal requirements for advert~.zing of ~he hearin~ before the Zoning Adjustor of Spokane County have been met. D~CIS70N From the foregoing Findin~s, a review of the Planning Department Fi~.e No. CUE-~4-$2, testimony at the publi.c hearing, and a site visit, ~he ~ Zoning Adjustor hereby in approving the proposal makes the fo~lowing conditions: A. COUNTY PLANN'ING DEPARTMENT 4 1) The manufa~tured home at a minimum be thirty-five (35) ~eet or more in length and at least eight (8) feet in width co~structed in ac~ordance with State of Washington or Fede~ral tnanufactured home construction standards as evidenced by the attachment of an  insignia designed fo~ transportation after fabrication on public streets and highways on its own chassis and wheels, and arriving at the site where it is placed on a foundation or tied down and skirted with a fire resistant material with towing-tongue removed including the connectian to electric power, water supply and sewage disposal facilities. 2) A written statement from a licensed physician stating the nature of the medical problem shall be submitted with the application. 3) The manufactured home shall be occupied by either the dependent relative and family, or by the relative and famYly providing care to the dependent relative owning and occupying the principal residence. y ~ ' ~ . a FIND~NGS OF FACT, DECISION AND CONDZT70N5 CUE-14-82 PAGE 2 i 4) Upon termination of the need for care or the sale or lease of ~ ~ the property, the applic~nt shall remove the manufactured home from the site within forty-five (45) days. . ~ , 5) A statement shall be recorded in the County Auditor's Office stating that the manufactured home is temporary and for the use of the dependent relative for which the Conditional Use Permit. is ~pproved and not considered a permanent structure to be transferred with the property is sold or leased. The statement shall include a legal description or recording information from the deed or sale agreement. b) The placement of the manufactured home shall be in co~npliance with all plat dedi~ations. 7) The temporary residence shall be~f'accessory" only to a parcel, or tract of land under the ownership or l~ase by the applicant for the Conditional Use Permit. 8) The mobility gear shall not be removed, and the unit shall not be permanently affixed to the 1and, except for tempo~ary con- nections to utilities. 9) Only one temporary residence may be permitted on~a lot, parce~ or tract of land under the ownership or lease by the applicant . for the Conditional Use Permit. 10) The permit shall be granted for a period of one year and may be renewed administratively by the Director or his designee upon the recertification by a license~ physican that the medical problem still requires care of person or propert~r. The renecaal period shall be every year from the date of the original permit. 11) Minimum lot size and frontage requiremen~.s for the zone in which the proposal is located shall apply to all applications. B. COUNTY BUILDING AND SAFETY DEPAI~TMENT 1) A11 future buildings and structures require building permits as per Section 301 of the Uniform Building Code. ~ ~ C. COUNTY UTILITIES DEPARTMEVT 1) Pursuant to the Board of County Commissioners Resolution No. ~ 80-0418, the use of on-site sewer diposal systems is hereby authorized. This authorization is conditioned on compliance ~ with all rules and regulations of the Spokane County Healtl~ District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2) The owner, his heirs or successors shall join and participate ~.n ~ any petition or resalution which purpose is the formation of a utility local improvement district (ULID} pursuant to RCW ChaptEr 36.94, as amended. The owner, his heirs and successors shall further agree no~t to oppose or protest any legal assessments for any utility local improvement district (UZID) established pursu.an.~k. to RCW Chapter 3b.94, as amended.  3} Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County. D. COIINTY HEALTH DISTRICT 1) Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage system may be authorized. 2) Sewage disposal method shall be as authoxized by the Director of Utilities, Spokane County. 3) Water service must be coordinated through the Director of Utilities, Spokane County.
