INTRODUCTION
This matter being the consideration by the Zoninq Adjustor for Spokane
County and pursuant to Chapter 4.25, Section 4.25.010, the Zoninq Adjustor
has the authori ty to hear -and deci de s uch matters comi nc~ before hi rn. , After ~
conducti nq a publ i c heari ng to recei ve al 1 publ i c testi ~iony and after revi ew- ing the public record and examininy available information, the Zoninq Adjustor
in accordance with Chapter 36.70.810 Revised Code of ~Washington, and Section
4.25.030 of the Zoning Ordinance hereby makes the folloti~vinc~ Findings of Fact
and Concl usi ons of Law hereinbelow stated.
The applicant, Andrew Skinner, filed an applicat~on v~ith the Planninq
Department on June 12, 1981 requesting approval to allo~~ construction of a two- car garage. The subject property is located on Heroy A~~en~e, East of McDonal d
Road in Section 3, Township 25, Range 44.
That on July 22, 1981 a public hearing was held be~ore the Zoning Adjustor.
After concl usi on of testimony, the matter was taken unde~~ advi sement for revi~ew
and decision. A preliminary decision of approval ~~as mad~ on July 23, 1981
after findinq that there are sufficient grounds to support the grantinq of a variance in this instance.
CONCLUSIONS OF LAW ~
I.
That the Zoni~ng Ad,justor of Spokane County has j uri sdi cti on over the issuance of the bui 1 ding permi t for tne project to the appl i cant pursuant to
the provi sions of Chapter 36. 70.810 RCW and Section 4.25.030 of the Spokane
County Zoning Ordinance. That the applicant submitted an application to the
Planning Deaartment requesting a public hearinq before the Zoninq Adjustor,
and that pursuant to Chapter 36.70.840 RCW and Section 4.25.040 of the ZoninQ
Ordinance, no~ice for a public hearing was given through the United States
mai l to~ al l property owners within a radi us of 300 feet ~rom the subject pro- -
perty.
II.
~ That all citizens notified and agencies havina ,jur~sdiction were afforded

III.
The applicant was able to demonstrate to the satisfaction of the Zoninq
Adjustor that there is a unique hardship associated with the property in that
placenient of the garage i s 1 imi ted because of the locati on of the exi sting
residence and the location of the drainfield.
IV.
It is concluded by the Zoning Adjustor that the purpose of setback require-
ments i s to afford adequate 1 i ght, ai r, and aestheti cs to ins ure publ i c safety
and general welfare. In this case, the re1axation of a flanking street setback
does not infringe upon an,y neighboring properties nor public rights to safe
vehicular access.

That pursuant to the above cited provi~sions of law, Findings of Fact
hereinbelow sub~stantiates action taken regarding this app1ication. Any Find-
inq of Fact hereinafter stated which is deemed to be a Conclusion of Law is
adopted as the same. .
FINDINGS OF FACT
I.
The appiicant is pronosing a two-car garaqe to be set back five ~5} feet
from the flanking street property line. The Spokane County Zoninq Ordinance
requires in this instance a 15 foot setback from the property line or 45 feet
as measured from the centerline of Blake Street which is the flankin~ street.
II.
Blake Street at this location has a 50 foot riqht-of-way which dead-ends
125 feet in from the i~ntersectinq street of Heroy avenu~. Blake Street at
this point provides access to the applicant's property ~nd to the property
1ocated on the east side of Blake. The street is not i~~r~roved nor being used
by the public. The County is not currently maintaininq fihis portion of Blake ~ Street. ~
III. ~ .
The applicant testified that the only location on his property to locate
a garage is within the flankinq street setback area. Th~ existing home and
drainfield restricts the placement of a qarage on the property unless a var- iance ~i s approved. ~
IU.
From examination of the plot plan on file with this application,~the Zon-~
inq Adjustor finds that locations for a garage are 1 imi ted. That thi s locati on
offe rs the least amount of impact on ad,joininq properties and does allaw f or
sufficient room for ingress and eqress of vehicles to th~ garaqe. Provided that . access to the garaqe is f rom the South end as proposed by the applicant. .
V. ~
From on-si te revi ew, the Zoning Adj ustor fi nds~ that the request i s reason-
able and justifiable under the laws of the State of Washir~ton and Spokane
County for the review and approval of va riances. That sufficient lot a rea is ~ available for the construction of the gara9e. It is noted that the proaerty does
not contain a garac~e, however, it is found that other properties in the immEdiate
vicinity are enjoyina the ri~ght and privilege of garages. It is further found
by the Zoning Ad,justor that Blake Street cannot be extended through to Wellesle,y ~ . _ . . . , , , .
Nvenue because ot an existing residence located on Wellesley an d in direct aliqn
ment of Blake Street. It is also not feasible for Blake to be extended souther-
ly. Therefore, the qrantinq of this variance is based on a special circumstance
applicable to the subject property and the status of Blake Street.
VI.
Al 1 appl i cations pendinq before the Zoni ng ,Adj ustor are revi ewed by County
Departments havi nq jurisdiction. The County Engi neer' s Off i ce s ubmi tted a memo
dated July 22, 1981 acknowledginq that if constructed°.as shown on the proposed
plot plan, there should not be any probIdms.

Pursuant to these Findings of Fact and Concl usions of Law stated herein-
above, approval of this request and conditions imposed car~ be substantiated.
CONDITIONS
I.
The apalicant shall construct the two-car garage as ~resented in this appli-
cation in accordance with the~approved plot plan on file. That access to the
qarage be from the south end .of the structure.
II.
All required buildinq pe rmits must be obtained.
