THIS N1ATT~R, Being the consideration by the Zoning Adjustor af Spokane
County, in hearing the appl ication VE-58-84, for the purpose of allowing a
fron~ yard setback variance for a duplex, hereinafter referred to as the
"Proposal", and the Zoning Adjustor of Spokane Cou.nty having held a public
hearing on May 23, 1984 and having ful ly consi dered al1 testimony presented thereat, and further having visited the site and vicinity in question, and
having rendered a decis~on on the 30th day of May, 1984, APPROUIidG IlU PART

l. That the proposal is generally located on the southeast corner of Glass 'Avenue and Dick Road in Section 6-25-44, Parcel #06543-3028.
2. That the p ropos al consi s ts of a~ 1 owi ng a dupl ex to be 1 ocated on the
prope rty wi th a f ront yard setback of 38' whi ch is general ly cons istent wi th
adjoining resi dences.
3. That the adopted Spokane County General i zed Comp rehens i ve Land Use Plan indicates urban usage of the area encompassed by the proposal.
4. That the si te is zoned Agri cul turai Suburban. .
5. That the existing 1 and uses in the area of proposal incl ude pre-
dominantly single family residences to the north, east and west of the property
and a vacant lot lies irr~ed~at~ly to the south.
6. That the establ i shed f ront yard setback i s approxi mately 38 feet f rom
the centerl ine ri ght of w~y Qf Gl ass Avenue.
7. That the applicant has requested to maintain a sir~ilar 38 foot setback
from the centerline of Glass Avenue in that maintaining the normal setback wou1d
1 eaye the 1 ot wi th a 28 foot r~ar yard wh1 ch the appl i cant ase rts to be smal 1 for this resident~al use.
That the Spokane County Engineers have requested that if the application
i s approved, that the appl i cant dedi cate addi tional ri ght of way for f uture ~
expansi,on of Gl ass Avenue and Di ck Road.
9. That area residents appeared to oppose the proposal generally on the
grQunds that the intersection of Glass Avenue and Dick Road is hazardous and approving the project as proposed woul d create an addi ti onal traffi c hazard.
10. Other residents concerns related to the estab1ishment of a duplex which
the Zoning Adjustor finds to be a permitted use in the Agricultural Suburban
zone on a 1 ot of thi s si ze and wi th thi s f rontag~, and the refore, the Zoni ng
Adj ustor has no j uri s di cti on regardi ng the p roposed dupl ex use.
11. That the p roposed setback i n 1 i eu of a 7 foot dedi cati on woul d 1 eave
only a 14 foot f ront yard setbdck f rom the county ri ~ht of way. The Zoni ng
Adj ustor concl udes that such a setback on a corner 1 ot i s i nsuffi ci ent i n 1 i ght
of the projected expansi.on of Gl ass Avenue and Di ck Road.
12. That sonle rel i ef can be granted to the appl i cant whi ch woul d al 1 ow the
lot to have a larger back yard.
13. That the proper legal requi rements for adverti sing of the hearing
before the Zoning Adjustor of Spokane County have been met.
CONCLUSION
1. The appl i cant i s al 1 owed a 10 foot f ront yard vari ance whi ch the Zoni ng
Adjustor concl udes wi 11 not be detrimental to the publ i c health, safety and
welfare. The proposed structure wili be located no closer than 45 feet from the existi ng centerl i ne of Gl ass Avenue.
