SUMI~ARY OF APPLICATION:
The applicant is asking a variance of the 45 foot from the centerline of the
roadway right-of-way setback on a flanking street to 33 feet from that
centerline in order to located a detached garage on her property, The reason for the requested variance is to allow the maximum amount of space between the
house and the garage in which to locate a future drainfield, The current
drainfield, which is quite old, actually exists on the neighboring parcel and
wi 11 have to be rel ocated to thi s parcel when that drai nfi el d fai 1 s.
LOCATION:
The southwest corner of Glass Avenue and Dick Road in the Spokane Yalley, in
Section 6, Township 25, Range 44. Assessors Parcel ~06543-3116,
DECISION OF TNE ZONING ADJUSTOR:
Based upon the evidence presented, the Zoning Adjustor APPROVES a variance to approximately 38 feet from the centerl ine of Dick Road at a 1 ocation
approximately 3 feet from the south property line, The garage is to be
approximately 20' ~on its east/west dimension, 14' on its north/south dimension
and one (1) story in height.
PUBLIC NEARIN~:
After examing all available information on file with the application and visit-
ing the subject property and surrounding area, the Zoning Ad~ustor conducted a
public hearing on August 24, 1935, rendered a verbal decision on August 28,
1985, and a written decision on September , 1985.
FINDINGS OF FACT
1, The proposal is generally located on the southwest corner of Glass
Avenue and Dick Road in Section 6, Township 25, Range 44 and is further
described as Assessors Parcel #06543-311fi, being more specifically described
in Zoning Adjustor file VE-74-85,
2. The proposal as set forth by the applicant consists of locating a proposed detached garage 33 feet from the centerline of Dick Road as opposed
to the 45 feet required as a flanking street setback by the County Zoning
Ordinance. The lot is 1,020 square feet.

4. The site is zoned Agricultural Suburban which would allow the
proposed use upon approval of this application.

6. The primary reason for the garage being located as proposed is is
allow the maximum roorn in the back yard area to locate a future drainfield,
The back yard had a large elm tree, which has been removed, The root system
f rom that elm tree apparently prohibited the installation of the original
(existing~ drainfield~in this back yard. It was, at some time in the past,
located in a westerly direction on what was at that time a lot greater than
~ 20,000 square feet. At some time in the past the lot was divided into three smaller lots, the more easterly of which contained the applicant's residence.
Although the septic tank is on the applicant's lot, approximately 85 to 90
percent of the drainfield is located on the lot to the west, including a
location partially under an existing garage and driveway. The Health District
is requiring that the drainfield be located on the applicant's parcel of land
at such.time in the future as the existing drainfield fails. In order to do
that the applicant is attempting to allow as much space as possible to locate that drainfield. By proposing to locate the garage closer to the s~de street,
the applicant would then be allowing more space in the area west of the
garage, in addition to the area between the garage and the house, to locate a
future drainfield,
1. The Health District has required that the applicant gain an easement
for the existing off-site drainfield.
8. The applicant stated that the Nealth District described two alter-
natives with regard to a future drainfield: (a~ a standard sized drainfield
for a residential septic tank; or tb~ a srnaller leach bed ~drainfield~ in the
event that the residual elm tree root system prohibited installation~of a
typi cal drai nfi el d.
9, The applicant has submitted letters f rom Appraisal Services of
Spokane and Star Brokers-Hege Company indicating the desirability for reasons
other than as set-forth by the Nealth District, for locating the garage at the
location proposed by the applicant.
~G, ihe County Engineers i~ave noted that aick Road is a narrow roadway oT
18 feet of improved surface constructed within a 32.5 foot right-of-way. At any future point in time that Dick Road may be widened it will be necessary
for the County to acquire more right-of-way. Hence the Engineers have
recammended that the proposed garage be required to adhere to the
approximately 38' setback from the centerline of the street, said setback
being identical to the residential structure.
11. An inspection of the site indicates that the location of the garage closer to the street would not interfere with any existing vegetation,
overhead electrical wires nor would it create any traffic hazard by its
presence closer to the road.
12. The applicant has submitted, and the Zoning Adjustor has observed and
verified, that there are numerous instances throughout the general vicinity
and zone in which garages appear to be located quite close to the
right-of-way, certainly closer than would be required by the current zoning ordinance.
13. The Zoning Adjustor also notes that the lot is a small lot, barely
exceeding the minimum lot allowed in the Agricultural Suburban zone,

1. VE 87-85 - McGann - Applicant should be advised that no construction will be per-

along Sprague Avenue.

~ 4. VE 14-85 - Mind a - Dick Road is a narrow roadway (18 ft. improved surface)
constructed within a 32, 5 f t. right-of -way. Should the County at some f uture date
undertake a project for the widening of Dick Road, it will be necessary for the County to acquire more road right--of -way. It is recommended that the proposed
garage be required to adhere to a 38 ft. setback f rom the centerline of the street.
This setback would then be the sarne as the residential structure and would permit
right-of -way acquisition at a future date.
5. VS-3-85 - A-F - The easement which provides ~cce8s to the Floch property from Freya Road is also a means of access for two residences which are located to the east of
Freya Street and north of this proposal. A gravel access road has been constructed
~nd speed bumpa installed f or control of traffic on this private road.
On August 23rd, a field inspection of the proposal was undertaken by this office.
During that inspection I had the opportunity to meet with adjoining property owners
who expressed concern about the access road should it be con~etructed northward f rom the Floch property and connected to the existing private road. The concerns were
as follows:
Traffic - If the road were to provide a connection between the Valley Chapel Road
and Freya Road, there is the possibility of the roadway becoming a short cut
route to SRP lb (Palouse Highway). As proposed, the private road would accommo-
date 65 to 80 additional average weekday vehicle trip ends from the Floch devel-
opment. Residents of the area are concerned about the safety of children and f amily pets who have never had to deal with the aspect of traffic passing by
their homes on a regular basis.
Ease~aent Location - The roadway which presently serves the existing residences
may not be constructed within the easement which would provide access to the
F1och property. The described easement may pass through the front yard of a

residence and a horBe corral. Theref ore, constructing the road in the described
easement ~nay not be f easible.
Freya Road - Freya Road is maintained by the County. However, eince it serves
only a few homes and is not an axterial or school bus route it does not get
immediate attention f or the plowing of snow in the winter.
Other - A resident (the Dix Family~ of the area hae a water line which crosses
the proposed easement road. The water line is within 3 f eet of the surfa~e of
the ground and problerns could be experienced duri~g winter ~onths when traffic
over the line could cause downward movement of f rost and potential dam,age to the
water line (traffic over the roadway will tend to compact soils beneath road).
The applicant would have to develop a maintenance agreement for the construction and maintenance of the roadway within and outside of the proposed development.
This may prove to be difficult for that portion of the easement road which connects
to Freya. (I'm not certain as to how the exist,ing res~dences on the northerly ~
easement would be tied into a maintenance agreeaaent or how they would be compen-
sated for improvements already conatructed.)
It is recommended that the principal access for the Flock development be from Valley Chapel Ro~d. That a cul-,de-~ac turnaround be constructed between parcels F
and A and a barrier constructed which will prohibit traffic from ~oving northward
to Freya Road. That the Freya Road SCC~'88 ea8ement be utilized only f or e~ergency
vehicle accese into the Floch property.
The resident~ of the development would thea have direct access to a roadway which
is regularly maintained and t~ue be assured of adequate year round acces~.
See ~ttached comments which relate to the proposed private road. Prior to release
of building permits, applicant shall eubmit to the County Engineer a centerline
profile, typical ro~dway cross--section and drainage plan for the prosed xoad.
These must be approved by the County Engineer.
Applicant ehould note that should an accese permit be denied for either of the par-
cels having frontage on the Valley Chapel Road, the applicant will then be required to provide access to thoee parcels f rom the propo8ed private road.
6. ~TE 117-85 - Crosb~ - The County Engineer hae no comment to make concerning this
application. It should be noted that Spokane County is claiming that portion of
the subject property depicted on the attached map as road. Early road records on
f ile in the Engineer' 8 Off ice indicate that the atrip of land has been used for road purposes for a period in excese of 10 years.
