VE-177-83 • ~ r ~ ~ a BEFORE THE BOARD OF ADJUSTMENT OF SPOI~ANE COUNTY, WASHINGTON IN THE h1ATTER OF REVIEWING TNE ) ADr~1INISTRATIVE ACTION OF THE SPOKA~IE ) COUPJTY ZONI~JG ADJUSTOR IPJ A DECISION ) FINDINGS & ORDER TO DENY VARIANCE #VE-177-83; TREE OF ) LIFE CHRISTIAN SCH~OL ) f THIS h1ATTER, Being the consideration by the Board of Adjustment for Spokane County, is an appeal of an administra~ive action by the Spokane County Zoning Adjustor denying the Variance #VE-177-83, for the purpose of relaxation of lot area requirement to establish a private school on an approximate 1.5 ac re parcel whereas the Spokane County Zoning Ordinance, Section 4.05.065 (a} requires a minimum 4.5 ac re site, hereinafter referred to as the "Proposal", and the Board of Adjustment of Spokane County having held a public hearing on December 5, 1983, and having fully considered all testimony presented thereat, and having rendered a decision on the 5th day of December, 1983, approving said proposal , does hereby make the fo11 owi ng: a FINDINGS OF FACT l. That the proposal is generally located adjacent to and east of Park Road, approximately 1 block north of hlarietta Avenue in Section 7-25-44. Parcel #01542-1804, 1803 and 1~02. 2. That the proposal consists of establishing a private school for up to fif ty (50) children ranging from grades 1- 12 at the West Yalley Kiwanian's Community Center. 3. That the Generalized Comprehensive Plan for Spokane County indicates a Suburban designation for the area encompassed by this proposal. This classification generally is intended to accomodate residential uses with large yards and open spaces along with uses necessary to support residential activities; included is educational facilities. That the site is zoned Agricultural-Suburban. Section 4.05.~65 (a) of the Spokane County Zoning Qrdinance requires that public and parochial schools be located on sites with a minimum 4.5 acres and 200 feet of frontage on a public road. These standards have been established for the adequate siting of schools, including building structures, playground areas, and off-street parking, to provide adequate land development area and buffering to ad j acent us~s . 5. That the existing land uses in the area of the proposal include a public school to the east, commercial grocery store to the west of Park Road, railroad tracks and office to the north and mixed residential/commercial uses. 6. That the Spokane County Zoning Adjustor held a public hearing on October 5, 1983, concerning the proposal, and that on October 14, 1983 the Spokane County Zoning Adjustor, by Conclusions of Law and Findings of Fact did render a decision to deny the proposal. 1. That the requirement of the Spokane County Zoning Ordinance, that schools be located on a minimum 4.5 acre site, was intended for 'major' educational facilities serving a large number of students from a specific geographical neighborhood area. The proposed school is intended to serve a - maximum of only 50 students in grades 1 through 12. The magnitude of this proposal may not be as great as that envisoned by the requirements of the Spokane County Zoning Ordinance. That the 1.5 acre site has ~xisting improvements that 7imit the amount of area available for outside play and recreation activities; specifically, nearly half the site is devoted to a gravel parking area. Fencing exists on three side of the site. However, no area is completely enclosed by fence for a secure playground. The school representative indicated that enclosing a portion of the site ~rith fencing may be possible. 10. That representatives of the Tree of Life Christian School indicated the school has authorization from the Spokane County Parks Department to utilize Orchard Avenue Park for recreational needs. The park is located approximately four blocks north of the proposal on the west side of Park Road. Access f rom the proposal to the park would require the students to travel along Park Road, an arterial, and make a crossing of existing and used railroad tracks. Use of the park during the winter months is questionable. 11. That the existing Orchard Center School to the east has a playground adj oi ni ng thi s}proposal. The appl i cant i ndi cated that the possi bi 1 i ty of ~ o~ nt recreat°ion use of Orchard Center School 's pl ayground i s an a1 ternati ve that hasn't been fully explored. 12. That the Board of Adjustment notes that there was oppasition to the request by an area property owner. The property owner ~~as unabl e to attend the hearing due to medical reasons, but did contact the Planning Department staff by telephone on December 5, 1983 and verbally gave testimony in opposition to the request. Ho~~ever, the Board chose not to accept said testimony as it was not presented in written form and such 'second hand' testimony i s contrary to the Board's operati ng procedures and pol i cy. 13. That the proposal is compatible with existing uses in the area. 14. That the proposal is not, or can be conditioned so as not to be, detrimental or otherwise harmful to the public hea]th, safety and welfare. i5. That the proposal is consistent with the surrounding land use classifications and does not grant a special privilege or rights to the applicant different than those enjoyed by adjacent property owners. 16. That the proper legal requirments for advertising of the hearing before the Board of Adjustment have been met. DECISION From the foregoing Findings, and the staff presentation of File No. VE-177-$3, the Board of Adjustment of Spokane County hereby in approving the proposal does make the folloaring conditions: A. COUNTY PLANNING DEPARTMENT ~ 1) That the maximu~~ number of students be limited to 50 as indicated by the applicant in his variance request. Prior to issuance of permits for the school facility, a minimum five foot high chain link fence of sufficient durable material shall be installed along the west 'property line and north of the existing building from the west to the east property line. Additionally, fence construction shall comply with Spokane County Zoning Ordinance, Section 4.11.040, where appropriate. , ~ ~ FINDI~dGS AND ORDER ~ VE-171-83 PAGE 3 3. That for additional recreation area, the applicant shall seriously investigate and attempt to secure shared playground facilities ~ith the adjacent Orchard Center School. Prior to issuance of permits for the school facility, the applicant shall secure a joint use argreement or provide documentation that shared use is not possible. B. DEPARTh1ENT OF BU I LD I I~G AND SAFETY ~ 1) A71 buildings and structures require building permits as per Section 301 of the Uni form Bui 1 di ng Code. C. HEaLTH DISTRICT 1) Appropriate uti1ity easements shall be indicated. 2) A combined surface water and sewage disposal detailed plan shall be appro ed by the County Engineer and the Spokane County Health ~ . . . . . District pr~or to the ~ssuance of any bu~ld~ng permit for th~s project. 3~ Sewage disposal method shall be as authorized by the Director of ~ Utilities, Spokane County. 4~ Sub j ect to speci f i c appl i cati on approval and i ssuance af permi ts by the Nealth Officer, the property is ~uthorized the use of an individual on-site sewage system. 5) Water service shall be coordinated through the Director of Utilities, Spokane County. fi) Water servi ce shal 1 he by an exi sti ng publ i c water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 7) Disposal of sewage effluent beneath paved surfacs is currently prohibited. D. UTILITIES DEPARTMENT 1) Pursuant to the Board af County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal system is hereby authorized. That the representative of the Tree of Life Chris~ian School indicated the school has aut~orization from the Snokane County Parks ~epartment to utilize Orchard Avenue Park for recreational needs; however, this nark is located a~proximately four (4} blocks from the existin~ site and 1~~ould rec~uire a re~ular means of trans~ortation or supervised travel to the nark an~ ±~~ould not appear to be access~ble for the school durinq winter months. 10.
