Ihat the proposal is generally locatea on the west side ot Sargent Road, between First Avenue and Second Avenue and is turther described ds Nssessors Parcel #19541-UbUI, being block b, West Uishman Adaition, Section ly, Township '15N, Range 44 EWM. That the Sargent Road proposal consi5ts of locating the proposed automoti ve service center at a 1 ocati on 1 U feet from the property 1 i ne an Saryent Road, whereas the zoning ordinance for the Gounty requires a setback ot lU teet trom this flanking street property line. FINDINGS UF FACT, GONCLUSIONS, UE(;ISION ANU I;ONUITIONS UF APPItUVAL (SAKUENT RU. SETBACK VA{tIANCE - TNIRU OF FUUR RELATEU ISSUtS; VE-225-84) Page 2 9. That due to the quantity of petroleum hydrocarbons stored on site (more tihan l0U gallons of combined solvents, degreasers, etc.), the proposal was judged to be a Critical Materials Use Activity; that the poposed use was designated a Critical Materials Use Activity; and that the applicant accepted that designatian and waived his rignt of appeal, thereby acknowledging his understanding of and intent to comply with the Aquifer Sensitiv Area Uverlay Zone provisions for a Critical Materials Use Activity outside the Priority Sewer Service Area (Section 4.1bN.00 (1) of the Spokane Gounty Loning Urdi nance ) . lU. That the testimony is true with regard to the location of a former landfill as complicatting the building siting problems on this site; that the landfill materials which most directly affect the instability of the ground upon which this structure could reasonably be expected to be built existed prior to the applicant's purchase of this portion of the ground, that the applicant in this respect, has not "created" the hardship from which he seeks reltef, and in fact is entitled, as a subsequent property awner to those who most likely created the hardship, to be the first to apply for a variance from the zoning regulations, which regulations, when combined wiwth the hardship, makes the deve1opment of the site, very difficult and impractical for the use to which this applicant wishes to put the site as we11 as difficult and impractical for most applicants wishing to construct a contemporary autamotive service center. 11. The the applicant did allow various portions of the site farther to the west to be filled with refuse under his supervision, but that supervised filliny did not create the problem that currently exists at the site and from which the applicant is seeking relief through the variance process. 12. That evidence has been submitted in the form of an engineering report from Budinger and Associates, geotechnical and material enginers, which establishes that a substantial portion of the unstable "refuse" fill would have to be removed and specifically selected new fill brought in and compacted ' to the consistency of the ad,jacent alluvial sana ana gravel in order to establish a firm basis upon which to erect footings and foundations for the new building; that such building compliCations are no different than a hill or a basalt rock outcropping appearing on one's lot or parcel, which hill or rock outcropping is traditiona1ly accepted as a special circumstance of the site for which yard dimension variances are frequently granted. l:i. That numerous praperties in the area in the same zone exist as contrary to the currently required setbacks, many of the buildings having been located priur to the institution of the area's zoning. 14. That the Spokane (:ounty Engineer maintains a long range plan far a new major arterial along the pre5ent Second Avenue aligrment and that this plan includes an important connection between Sprague Avenue and 2nd Avenue via Sargent Roatl. 15. That the County Engineer has recomnended no access to Sargent Road in the event the variance is approved so as to not conflict with the ftow of future traffic on Sargent Road a5 it achieves a higher volume of traffic. 16. That the long range plan for Sargent koad requires acquisition of additional riyht-of-way on the west side and a 25 foot turning radius on the northwest corner of Sargent and 2nd Avenue on its northwest corner; that the l;ounty Engineer expressed the opinion that granting a variance and the subsequent issuing of a builaing permit will constrain the future constructian of the much needed 2nd Avenue to Sprague Avenue connection via Sargent Road. c . FIkUINUS aF FACS, CONGtUSIUNS, DECISIUN AND CUNDITIUNS UF APPROYAL (SAJtGENT Rll. SkTKACK VARIANGE - ThIRU OF FUUk RELATEU ISSUES; VE-225-84) Page 3 17. That it is necessary and appropriate for the County to engage in the long range planning of road systems, particularly arterials, in order to serve the public interest and the general welfare and that striving for the long term objective of a 2nd Avenue arterial and a connecting link on Sargent koaG between the existing 5prague Avenue arterial and the future 2nd Avenue arterial is a legitimate long range goal to be recognized and supported through land use decisions. 16. That the vari arce as proposed i s i ncompati Dle wi th future road demands for the area. 19. That a traditional purpose of a building seCback f rom a road riyht-of-way, as found in all zoning ordinances, is to assure an ample amount af space, li9ht, and air, to provide for a common line of building structures for aesthetic reasons, to provide the space and opportunity for goverrment to acquire additional road right-of-way in the event it is necessary to widen a given thoroughfare and to provide unobstructed views of other vehicles and pedestrians for traffic leaviny and entering private property. 2U. That no Sargent Koad setback variance was sought nor granted for the Pring Corporatian bodyshop inmediately to the east, across Sargent Road, and in fact that structure remains 2U feet from the flanking street property line. 21. That prior to the construction of a Sargent Itoad link to a ma,jor 2nd Avenue arterial, traffic volumes should allow for limited access to a parts delivery door on Sargent Road; but that the County Enqineer may exercise authori ty to requi re ra del i veri es from vehi cl es parki ng i n the ri ght-of-way of Sargent Road. 22. That the Sargent Road property of the applicant should be landscaped as the road system evolves on Sargent koad and it may be necessary to restrict . the future access Lo the applicant's property from Sargent Road. From the Findings of Fact, the Zoning Ndjustor comes to these: CUNCLUSIUNS 1. The need to seek a variety of variances is caused by the presence of the former landfill in the general vicinity of the southwest corner of the proposed building and the landfill is judged to not have been created by the present applicant, although the applicant did purchase the site realizing there was some degree of instability in the underlying soils. 2. That the applicant has had an engineering investigation which has detailed the extent of the unstable soils, and the recomnendations of that consultant are that a substantial portion of the "refuse fillu be removed to the level of the native sand and gravel soils, with a subsequent need to fill and compact with similar soils to provide a firm enginering foundation; and further the loose sand and gravel fill applied over some of the area will need ta be excavated somewhat to provide far gutting same foundatians to be located on them more stable, older undisturbed soils. 3. The Zoning Adjustor has the responsibility to anticipate future needs and demands of the general traveling public and to accomodate to the maximum extent possible those needs insofar as such decisions will not tmpose unreasonable and extraordinary limitations on private properties. 4. The proposal as set forth would restrict the ability of the County to make a practical and efficient road connection between Sprague Avenue and 2nd Avenue in the future and is therefore detrimental to and not compatible with the public health, safety, and welfare. 5. Although the property and the proposal is somewhat deprived of privileges comnonly erjoyed by other properties in the same vicinity and zone, granting of the companion variances accompar~yiny this application will remedy the difference in privileges and at the same time protect the public interest and general welfare. FINUINtiS OF FALT, GUNLLUSIONS, UE(;ISIUN ANU GUNUITIUNS OF APYKUYAL (SpftGLNT ftU. SETBACK YNFtIANCE - 7hIItU UF FUUR RELATEU ISSUtS; VE-225-84) Nage 4 b. The granting of this variance would be a grant of special privileges inconsistent with those enjoyed by ather properties in the vicinity and zone except for a building to the northeast which is built on the Sargent Koad property line and which was constructed prior to zoning which would now restrict such a location. 7. The strict application of the normal ZU foot setback for flanking streets does not deprive the subject property of rights and privileges comnon to ather properties in the area and under identical zones insofar as the companion variances granted equalize arky inequities. The County has a long-range plan for a new major arteri al along the present 2nd Avenue ali gnment (an extensi on of the Old hti lwaukee Rai 1 road ri ght of way corri dor west to interstate 90), Thi s plan i ncl udes an i mpor- tant connection between Sprague Avenue and 2nd Avenue on Sargent Road. Direct access to 2nd Avenue and Sargent Road from i ndi vi dual parcels wi 11 create addi ti onal traffi c safety problems in the future. Therefore, direct access to Sargent Road or 2nd Avenue should be prohibited. From our analysis of both the County's existing and future traffic needs and our understanding of the applicant's present and future access needs, we propose the following alternate proposal for your consideration and approval. Sargent Road: That the variance reyuest for relief of setback requirements alony Sargent Road be deni ed. The long-range plan for Sargent Road requi res acqui si - ti on of addi ti onal ri ght-of-way along the frontage i n questi on and a 25 ft. radius at the corner of Sargent and 2nd Avenue. The granting of a variance and subsequent i ssuance of a bui ldi ng permi t wi 11 constrai n the future constructi on of the much needed 2nd Avenue to Sprague Avenue connection on Sargent. lst Avenue: 22 foot front yard setback from exi sti ng ri ght-of-way li ne as re- quested by the appli cant. 2nd Avenue: 20 foot front yard setback from existing right-of-way line; no access to 2nd Avenue; addi ti onal ri ghts-of-way wi 11 be requi red for future road improvements. A bui ldi ng sli ghtly smal ler i n si ze could be bui lt by the appli cant and sti 1 1 avoid the "fill problem" reported to be at the southwest corner of the site. Both exi sti ng and future traffi c could operate wi thout any si gni fi cant traffi c safety problems. Because of the extra wi de ri yht -of-way and ample vehi cle parki ng area on lst Avenue, no si gni ti cant operati ng problems should occur i n provi di ng the only access to the site along lst Avenue. We beli eve the above proposed alternate provi des suffi ci ent reli ef for both the applicant's stated problems and yet not restrict the County's present and projected future improvernents.
