The applicant previously received a temporary use permit to allow a non-family

September 9, 1985, The applicants intend to move into a new dental office
complex, but the construction work has been delayed and is not estimated to be
completed for occupancy at least until the end of December, 1985, The appl i cants are requesti ng an extensi on of the temporary use permi t unti 1 March
6, 1986 so as to allow them time to occupy their new quarters and still
maintain the home occupation non-family employee in the interim.

PUBLIC NEARING:
After exarnining all available information on file with the application and
visiting the subject property and surrounding area, the Zoning Ad,justor
conducted a public hearing on August 28, 1985, rendered a verbal decision on August 28, 1985, and a written decision on September , 1985,
FINDINGS OF FACT
1. The proposal is generally located west of and adjacent to Laura Road, approximately 18 feet north of Indiana Avenue in Section 7, Township 25, Range
44 and is further described as Assessors Parcel #01544-0323, being more
accurately and specifically described in Zoning Ad~ustor files SPE-2-85 and
SPE-ZA-85.
2. The proposal consists of extending a permit to allow a non-family
ernployee to participate in a dental laboratory home occupation, The original
6 month permit was issued with an expiration date of September 9, 1985. The present proposal contemplates extending that to March 6, 1986 in order to
al 1 ow addi ti onal time f or the constructl on of permanent dental 1 a~boratory
quarters, which are now under construction,

the proposal as URBAN and the proposal is consistent with the
County's entire Comprehensive Plan, including the Future Land Use Plan.
4. The site is zoned Agricultural which would allow the proposed use
upon approval of this application.

5. The existing land uses in the area of the proposal are residential
and are compatible with the proposal,
fi, The applicant presented information concerning the construction of ~
their necr quarters, including a letter f rom Robert G. Wendel, DMD, P,S., indicating that the building has been delayed in construction, The building
,is currently having its footings and foundation poured and they expect it to
be ready for occupancy by late December. The delays have been caused by the
time-taking approval of permits and financing arrangements.
7. There was no testimony indicating that there were adverse affects to
the neighborhood as a result of a non-family employee. The non-family employee parks his or her automobile off the street adjacent to the
applicants' driveway. The non-family employee maintains regular work hours of
approximately 8 to 5 o'clock.
8. A letter was received from Excel Dental Laboratory. The substance of
this letter concerned itself with the advisability of conducting a dental
laboratory in a residential situation, The letter did not address specifically the extension of the six month permit to allow a non-family
employee to participate in t~e home occupation. The letter from Excel is not
germain from the standpoint that it questioned whether or not a home
occupation of this nature should be carried on, An administrative decision
~ has been made that this home occupation is consistent with the provisions of
the Zoning Ordinance. Therefore, the issues raised in Excel's letter are not pertinent to the renewal of the temporary use permit. That is not to say,
however, that the issues raised in Excel's letter are not germain, only that
they are not the issue before the Zoning Adjustor,
9. The proposal is exempt from the provisions of Chapter 43.21C RCW
pursuant to WAC 191-11-800 (1) (c) and Spokane Environmental Ordinance
11.10.010 {c~.
10. There were no legal requirements f rom the departments or agencies
which would effect the project as proposed by the applicants.
11. There were no written or verbal oppositions to the extension of the
permit, except the communication from Excel Laboratories.
12. The proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met,
13. The use is of a ternporary nature.
14. An extension of the permit does not involve the erection of a
substantial structure.
15, The objective of establishing the temporary use can be achieved in a
six month period of time.
16. Any conclusion hereinafter stated which may be deemed a finding
herein is hereby adopted as such.
From the Findings, the Zoning Ad~ustor comes to these:
CONCLUSIONS
1, The proposal is not detrimental to and is cornpatible with the public
health, safety and welfare,
2. The proposal as set forth by the applicant is the extension of a temporary use, the conclusion of which appears quite certainly to be in early
1986.
3. Any finding hereinbefore stated which may be deemed a conclusion
herein is adopted as such.

DECISION
From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES
the proposal. The following CONOITIONS OF APPR4YAL ARE STIPULATED,

I. GENERAI
1. Approval of the employee of one non-family member in this home occupation
is extended to and shall expire on Feburary 6, 1986,
2. Any extension of this permit cannot be done administratively and must be
sub j ect to anothe,r publ i c heari ng.
3. The hours of business for the non-family member employee shall continue
to be approximately the haurs of 8 a.m, to 5 p,m.
4. The employees auto~obile shall continue to be parked aff the street and
on a location ad,jacent to the driveway of the residential structure.
5. The applicant shall proceed to resolve any conflict or any unissued
permit situation which may exist with the Spokane County Department of
Suildin and Safety.

1. VE 81-85 - McGann - Applicant should be advised that no construction will be per-
mitted in the County road right-of-way. Prior to release of a buildi.ng permit, the
applicant shall verify with the County Engineer the width of the road right-of-way
along Sprague Avenue.
2. SPE-ZA-85 - Diehl (Time extension} - No comment concerning this application.
3. VS 45-85 - Hotrum - See attached comments which pertain to rhe proposed private
road.
4. VE 14-85 - Mindemann - Dick Road f s a narrow roadway (18 f t. improved surf ace)
constructed within a 32. S f t. right-of -way. Should the County at some f uture date
undertake a project for the widening of Dick Road, it will be necessary for the
County to acquire more road right-of-way. It is recommended that the proposed
garage be required to adhere to a 38 f t. setback from the centerline of the street. This setback would then be the same as the residential structure and would permit
right-of -way acquisi tion at a future date.
5. VS-3-85 - A-F - The easement which provides acce8s to the Floch property f rom Freya
Road is also a means of access f or two residences which are located to the east of
Freya Street and north of this proposal. A gravel access road has been coastructed and speed bumps installed f or control of tr~f f ic on this private road.
On August 23rd, a field inspection of the proposal was undertaken by this office.
During that inspection I had the opportunity to meet with ad~oining property owners
who expressed concern about the access road should it be constructed northward f rom
the Floch property and connected to the existing private road. The concerns were
as f ollows:
Traffic - If the road were to provide a connection between the ~alley Chapel Road
and Freya Road, there is the possibility of the roadway becoming a short cut
route to SRP 16 (Palouse Highway). Ae proposed, the private road would accommo-
date 65 to 80 additional average weekday vehicle trip end~ from the Floch devel-
opment. Residents of the area are concerned about the saf ety of children and
f amily pets who have never had to deal with the aspect of traffic passing by
their homes on a regular basis.
Easement Location - The roadway which presently serves the existing residences
may not be constructed within the easement which would provide access to the
Floch property. The described easement may pass through the front yard of a

residence and a horse corral. Theref ore, constructing the road in the described
easement may not be feasible. , '
Freya Road - Freya Road is maintained by the County. However, 8ince it serves
only a few homes and is not an arterial or school bus route it does not get immediate attention f or the plowing of snoW in the winter.
Other - A resident (the Dix Family) of the area hae a water line which crosaes
the proposed easement road. The water line i~ within 3 f eet of the surface of
the ground and problems could be experienced durir~g winter mooths when traffic
over the line could cause downward movement of f rost ~nd potential damage to the
water line (traffic over the roadway will tend to compa~t eoils beneath road).
The applic~nt would have to develop a maintenance agreement for the construction
and maintenance of the roadway within and outside of the proposed development.
This may prove to be difficult for that portion of the easement road which connects
to Freya. (I'rn ~ot certain as to how the exiBting residences on the northerly
easement would be tied into a maintenance agreement or how they would be compen-
sated for improvements already constructed.)
It is recommended that the principal access for the Flock development be from
Va11ey Chapel Raad. That a cul-de-sac turnaround be constructed between parcels F
and A and a barrier constructed Which wil~, prohibit traffic from moving northward
to Freya Road. Tha~ the Freya Road acce$s easement be utilized only foz emergency
vehicle access into the Floch property.
The residents of the developwent would then have direct access to a roadway which
ia regularly maintained ~nd t~us be assured of adequate year round access,
See attached comments which relate to the propos~d private road. Prior to release
of building permits, applicant shall submit to the County Engineer a centerline
profile, typical roadway cross-section and draina~e plan for the prosed road.
These must be approved by the County Engineer.
Applicant should note that should an access permit b~ denied for either of the par-
cels having f rontage on the Valley Chapel ~oad, the applicant will then be xequired
to provide access to those parcels f rom the proposed private ro~d.
6. VE 117-85 - Crosby - The County Engineer has no comment to make concerning this
application. It ehould be noted that Spokane County is claiming that portion of the sub~ect property depicted on the attached map as road. Early road recorde on
file in the Engineer'a Office indicate that the strip of land haB been used for
road purposes for a period in excess of 10 years.
