THIS MATTER, Bei nq the consi derati on by the Zon ; nq Adj ustor of Spokane County, approvi nq the appl i cati on (CUE-40-81 for the purpose of a mobi 1 e home for a dependent relative, hereinafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County having held a public hearing on December 16, 1981 and having fully considered all testimony presented there- at, and further havinq visited the site and vicinity in question, and havinq rendered a decision on the 16th day of December, 1981 approving said proposal, does hereby make the following~: FINDINGS OF FACT l. That the proposal is generally located on the east side of Wilbur, north of Mission. ~ 2. That the proposal consists of a mobile home for a dependent rela- tive to be placed on a parcel with an existing single family residence. 3. That the site is zoned Aqricultural. 4. That the existing land uses in the area of proposal include single family residences and undeveloped land. ~ ~ 5. That the proposal is compatible with existing uses in the area. 6. That the proposal is not detrimental or otherwise harmful to the public health, safety, and welfare. 7. That the proposal is not totally inconsistent with the surrounding ~land use classification. 8, That the proper leqal requirements for advertisinq of the hearinq bef ore the Zoning Adjustor of Spokane County have been met, DECISION From the foregoing Findings, a review of the Planninq Department File No. CUE-40-81, testimony at the public hearinq, and a site visit, the Zoning Ad.justor hereby in approving the proposal makes the f ollowing conditions: A. COUNTY PLANNING DEPARTMENT . 1) The manufactured home shall be as defined in Chapter 4.03. Section 4.03.020 (36C) Manufactured Home, Double-Wide: "Manufactured Home, Double-Wide" means a single family dwelling complete and ready for occupancy thirty-five (35) feet or more in length and at least 2/3 of the total length measuring 20 feet in width when assembled, constructed in accordance with State of Washinqton or Federal manu- factured home construction standards as evidenced by the attachment of an insignia,designed for transportation after fabrication in two _ . _ . . . , ~ . ~ • ~ i - - ' -  or more sections on public streets and niqnways on its own cnassis and wheels, and arrivinq at the site where it is placed on a founda- tion, or tied down and skirted with a fire resistant material with towinq-tongue removed including the connection to electric power, water supp1y and sewage disposal facility. { . ~ IfVDING~, OF FAC~ , D EC IS ION AN~ ~ONU ~T IO~lS CU E-40-81 PAG E 2 , Secti on 4. 03. 020 ( 36E ) Manuf actured Home , S i nq 1 e-Wi de :"Manuf actured Home, Sinqle-Wide" means a single family dweilling complete and ready for occupancy thirty-five (35) feet or more in lenqth and at least ~ eight ~8) feet in width constructed in accordance with State of Wash- ington or Federal manufactured home construction standards as evidenced by the attachment of insignia designed for transportation after fabri- cation on public streets and hiqhways on its own chassis and wheels, and arrivinq at the site where it is placed on a foundation or tied down and skirted with a fire resistant material with towina-tongue~ removed including the connection to electric power, water supply and sewage disposal facilities. 2) The manufactured home shall be occupied by either the dependent relative and family, or by the the relative and family providing care to the dependent relative ownina and occupyinq the principal residence. ~ 3~ Upon termination of the need for care or the sale or lease of the property, the applicant shall remove the manufactured home from the site within forty-five (45~ days. 4) A statement shall be attached to the deed and recorded in the County Auditor's Office statinq that the manufactured home is temporary and for the~use of the dependent relative for which the Conditional Use Permit is approved and not considered a permanent structure to be transferred with the property if sold or leased. 5} -The mobility gear shall not be removed, and the unit shall nat be ~ permanently affixed to the 1and, except for temporary connections to utilities. 6) The permit shall be granted for a period of one year and may be re- newed administratively by the Director or his desiqnee upon the recertification by a licensed physician that the medical problem still requires care of person or property. The renewal period shall ~be every year from the date of the original permit. 6. COUNTY UTILITIES DEPARTMENT 1) ~Pursuant to the Board of County Con~mi ssi oners Resol uti on No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regu- ~ lations of the Spokane County Nealth District and is further condition; ed and subject to specific application approval and issuance of permits ~ . by the Health District. . , 2} The owner, hi s hei rs or s uccessors shal 1 j oi n~ and parti ci pate i n any petition or resolution which purpose is the formati~on of a utility local improvement district (ULID) pursuant to RCI~J Chapter 36.94, as ~ amended. The owner, his heirs and successors shall further agree not . to 0 ose or rotest any leqal assessments for any utility local im- pP P provement district (ULID) established pursuant to RCW Chapter 36.94, as amended, 3) Any water service for this project shall be provided in accordance with the Coordin ated Water System Plan for Spokane County. C.
