TNIS MATTER, Being the consideration by the Zom ng Adjustor of Spokane
County, in heari ng appl icati on VE-8-85, herei nafter referred to as the
"Proposal", and the Zom ng Adjustor of Spokane County having held a public
hearing on February 21, 1985 and having fully considered all testimony
presented thereat, and further having visited the site and vicim ty in
question, and having rendered a decision on the 26th day of February, 1985,
APPROVING the proposal, makes the following
F IND INGS OF FACT
1 That the proposal is general ly 1 ocated north of and fronting on the
intersection of Glenn Court and Nora Avenue in Section 9, Township 25, Range
44 and is further described as Lot 7 of the proposed preliminary plat MISSION
RIDGE SECOND ADDITION, PE-1488-84, heard before the P1 at Heari ng Exami ner
Committee and the Zom ng Adjustor on February 21, 1985
2 That the proposal const sts of a rel axation of 5 feet, to 50 feet from
the centerline, for the westerly portion of Lot 7 with regard to Nora ~
Avenue/Glenn Court, whereas strict application of the Spokane County Zo m ng ,
Ordinance, Section 4 05 110 a 1, woul d requi re 55 feet from the centerl ine of ~
the road right-of-way or 25 feet from the property 1ine, whi chever provi des ~
the greater setback, that larger setback being required to be 55 feet for the
westerly portion of Lot 7
3 That the adopted Spokane County Future Land Use Plan designates the
area of the proposal as URBAN within the PSSA and the proposal is consistent
with the County's entire Comprehensive Plan, including the Future Land Use
Pl an
4 That the site is zoned Agricultural with the ASA Overlay Zone, but
proposed to become R-2 with the ASA Overlay Zone at finaliaation of the plat,
which would allow the proposed use upon approval of this app1ication
5 That the existing land uses in the area of the proposal include
existing duplexes to the east and south and proposed to exist to the immediate
west on Lots 1- 6 af the proposed preliminary plat, all of which are
compatible with the proposal
6 That pursuant to the State Environmental Policy Act the enviroronental
checklist and other data has been reviewed and the project has been found to
not have any probable significant adverse impacts to the physical
environment A Determination of Nonsigm ficance (DNS) was issued on January
189 1985 The agencies reviean ng the checklist neither indicated that a more
detailed environmental review should be provided nor commented that the DNS
should be re-considered Conments regarding environmental matters were not
made at the public hearing There was not sufficient evidence presented
pursuant to WAC 197-11-340 (3) (a) to withdraw the DNS
7. That there were no specific recommendations from other departments,
either individually or as associated with the recommended conditions of
approval associated with the proposed preliminary plat which would affect the

decisi on of the Zom ng Adjustor, except that recommendati on #28 of the Spokane
County heal th 0istrict (appeari ng on page 23 of the February 21, 1985 Staff
Report for PE-1488-84) addressed a need to set the buildings on Lots 6 and 7
considerably northward in order to allow the accommodation of drainfields on
the southern portions of the lot, but that the Health District representative,
in the February 21, 1985 hearing did verbally remove, with the approval of the
Hearing Examiner Committee, the requirement for the buildings to be shifted
northward on Lots 6 and Lot 7
8 That the revised Condition of Approval #28, as described immediately
above, thus allows the placement of the dwelling unit structure on the
southerly portion of Lot 7 with the opinion being offered that the drainfield
can most 1 i kely be acconmodated either on the north portion of the 1 ot
partially utilizing the gentle slope or possibly on Lot 7 to the west of the
dwel l i ng uni tif such space exi sts after pl acement of the dwel 1 ing uni t is
determi ned.
9 That the Health District representative and the applicant concurred
that every effort would be made to locate the structure utilizing the proper
setbacks from the roadway right-of-way and to locate an adequate drainfield
without altering the design of the developers standard duplex um t, and that
upon a determination by the Health District that it is not possible to place
the structure and the drai nfiel d on the si te al 1 properly north of the
standard setback line, a letter would be sent to the Zom ng Ad,justor stating
the same and supporting a 5 foot variance of the setback line to acconanodate
the standard design duplex structure and an adequate drainfield
From the Findings of Fact, the Zom ng Adjustor comes to these
CONCLUSIONS 1) Lot 7 maty be indeed sufficiently disadvantaged by the slope on its
north portion so as to deprive the developer of the privilege of locating the
standard design duplex on the parcel and adequately accommodate a drainfield
arrangement It is most desirable, however, to locate the dwelling um t
behind the standard setback, and it is the intention to require this to be the
case unl ess the Heal th Di strict submits a written commum cation to the Zom ng
Adjustor indicating that a 5 foot variance of the front yard setback is needed
in order to properly accomodate a drainfield
2) The proposal is not detrimental to and is compatible with the public
health, safety and welfare
3) The subject property is deprived of privi 1 eges commonly erU oyed by
other properties in the same vicinity and Zone and the granting of the
variance will remedy the difference in privileges
4) The granting of the variance is not a grant of special privileges
inconsistent wi th privi 1 eges enjoyed by other properties i n the vi cim ty and
zone
5) The strict application of the standards of the Spokane County Zoning
Ordinance deprives the subject property of rights and privileges of other
properties in the area and under identical zones
6) The granting of the variance is not materially detrimental to the
publ ic wel fare or injurious to property or improvements i n the vici m ty or
zone in which the subject property is located
DECISION
From the foregoing Findings of Fact and Conclusions, the Zoning Adjustor
APPROVES the proposal The following CONDITONS OF APPRUVAL are stipulated

Circulation - Access to the site will be f rom University road and
Nora.
Design - The proposed R-2 lots are consistent in size, frontage
and access as the existing duplex development. ~
To o ra h- The site slopes downward between Nora and the
Freeway which will require site design consideration in the location
of building land drainfield sites. County-Health recommendations
indicate that the proposed setbacks on Lot 7 may not be feasible.
Water Supply - Modern Electric Water Go.will provide water. An

Sewage Disposal - On-site systems may be authorized subject to

School - The proposal is in the Central Valley School District
#356. Cultural Resources - None have been identified ~
III. HISTORY/ANALYSIS
The proposal is similar to 14ission Ridge lst Addition immediately to
the south. The development of Lot 8 which comprises 7.5 acres will
not be buildable at this time due to its lack of public f rontage.
Greater than normal building setbacks f rom the road may be required
due to the ridge line that traverses Lots 1 through 7.

IV. ENVIRONMENTAL REVIEW
An Environmental Checklist has been reviewed by the County Planning
Uepartment staff. The review connsidered the specifics of the proposal,
County ordinances and other regulations. County Planning Department has
determined that "No probable significant adverse impacts" would result
from the proposal being developed and has issued a Determination of
Non-Significance ("DNS").
The Hearing Examiner Committee may consider additional environmental
related testimony and the "UNS" at the public hearing.
V. LEAD AGENCY SUMMARY
The proposal appears consistent with the Comprehensive Plan Urban
Category and development in the irrtimmediate vicinity.
YI. CONDITIONS OF APPROVAL
If approval is granted, the following conditions are reconmended.
COUNTY PLANNING DEPARTMENT
1. That the Final Plat be designed substantially in conforniance with
the*preliminary plat of record as legally described and advertised.
No increase of density or lot number shall occur without prior
approval of the Hearing Examiner Committee.
2. That the preliminary plat be given conditional approval for three
(3) years to March 1, 1988.. The applicant may request an Extension
of Time by submitting a written request forty-five (45) days prior
to the above expiration date.
3. The Spokane County Subdivision Administrator shall review any
proposed final plat to insure compliance with the findings and
conditions of the Spokane County Hearing Examiner Comnnittee.
4. That the provisions of SEPA'S NOTICE OF ACTION pursuant to Chapter
43.21C,080 RCW be initiated by the project applicant within thirty
(30) days of final disposition of this application, and prior to any
on-site improvements unless the applicant(s)/sponsor(s) choose to
file a notarized Waiver of Notice of Action with the Spokane County
Planning Department.
5. That a Final Plat name be indicated before the final plat is filed;
such name to be approved by the County Assessor and the Planning
staff.
6. That appropriate names be indicated and approved by the County
Subdivision Administrator. -

7. That appropriate utility easements be indicated on copies of the
approved preliminary plat, for distribution to the County Planning
Department and all applicable utility companies. Written approval
of said utility easements by said utility companies must be received
with the submittal of the final plat.
8. That a current certificate of title be furnished the County Planning
Department prior to filing the final plat.
9. Upon filing the Final Plat the zone change of the Final Plat area
shall be finalized and the existing Agricultural zone classification
shall be changed to R-2 for Lots 1 through 7. Lot 8 shall remain
Agriculturally zoned and be designated non-buildable.
10. That a pl an for water faci 1 i ti es adequate for f i re protecti on be
approved by the water supplier, fire protection district, Spokane
County Building & Safety Department and County Health authorities.
The agencies will certify on said WATER PLAN, prior to the filing of
the final plat or any phase of the preliminary plat that the plan is
in conformance with their respective needs and regulations. The
WATER PLAN and certification will be drafted on a transparency
suitable for reproduction.
The purveyor will also certify that appropriate contractual
arrangements and schedule of improvements have been made with the
plat sponsor for construction of the water system in accordance with
the approved WATER PLAN. The time schedule will provide for
completion of the water system and inspection by the appropriate
health authorities prior to application for building permits within
the final plat. The arrangements or agreements will include a
provision holding Spokane County and the purveyor harmless from
claims by any lot purchaser refused a building permit due to the
failure of the plat sponsor to satisfactorily complete the approved
water system.
The plat sponsor shall also sign said WATER PLAN to conform the
contractual arrangements or agreements.
The final plat dedication will contain the following statement: "the
public water system, pursuant the WATER PLAN approved by County and
State health authorities, the local fire district, County Building &
Safety Department, and water purveyor, will be installed within this
plat, and the subdivider/sponsor will provide for individual
domestic water service as well as fire protection to each lot prior
to sale of each lot and prior to issuance of a building permit for
each lot." -

11. That no building permit will be issued for any lot within the Final
Plat until certified by a Washington State licensed engineer uthat
the water system has been installed pursuant the approved WATER PLAN
for the Flnal Plat", signed and stamped by said engineer. The
ce rtification may be in the form of a letter but is preferred to be
certified on a copy of said WATER PLAN as a schematic map showing
the "As Built" water plan.
COUNTY ENGINEER DEPARTMENT
12. That conditional approval of the plat is given subject to dedication
of Right-of-Way and approval of the road system as indicated in the
preliminary plat of record.
13. A statement must appear in the dedicatory language of the final
plat: "that individual driveway access permits be required prior to
issuance of a building permit for driveway approaches to the County
road system."
14. Dedication of 30 ft. additional Right of Way along University Road.
15. A statment shall be placed in plat dedication that no direct access
be allowed f rom o University Road. ;
6. Existing County roads providing direct access xo the pla shall be

19. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is
created or any Road Improvement Project is sanctioned by Spokane
County, the Improvements required (curb, sidewalk, drainage control
and paving to existing pavement) will be at the sole expense of the
undersigned owner, their heirs, grantees and assigns.

20. As an alternative method of constructing the road improvement stated
herein, the aplicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road project (CRP) to the extent of the
required road improvement. At such time as a RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
Improvements required (curb, sidewalk, drainage control and paving
to existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns.
21 That the following statement be placed in the plat dedication: The
owners, their heirs, grantees and assigns, agree to join in the
formation of a County Road Improvement District pursuant to RCW
36.88 at such time as a Road Improvement District is created or any
Road Improvement Project is sanctioned by Spokane County. The
improvements required (curb, sidewalk, drainage control and paving)
will be at the sole expense of the owner, their heirs, grantees and
assigns.
22. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 8U-1592, as
amended, which establishes regulations for roads, approaches,
drainage, and fees in new construction.
23. That the County Engineer has examined this development proposal and
has determined that the impacts of this proposal upon the existing
County Road System warrants the roadway improvements herein
speci fied.

interest agree to authorize the County to place their name(s) on a
petition for the formation of ULID by petition method pursuant to
RCW 36.94 which the petition includes the Owner(s) property and
further not to object by the signing of a protest petition against
the formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIUED, this condition
shall not prohibit the Owner(s) or Successor(s) from objection to
any assessment(s) on the property as a result of improvements called
for i n conj uncti on wi th the formati on of a UL ID by ei ther peti ti on
or resolution method under RCW Chapter 36.94."
25. Any water service for this project shall be provided in accordance
with the Coordinated Water System Plan for Spokane County, as
amended.
26. The dedication shall state: "Each dwelling unit shall be double
plumbed for connection to future area-wide collection systems."
