VE-133-84 & CUE-35-84 ~ ZONING ADJUSTOR SPOKANE COUNTY, WASHINGTON IN TNE MATTER OF CUE-35-84 ) & VE-133-84; KOPP ) FINDINGS OF FACT, DUPLEX IN THE AGRICULTURAL ZONE AND ) DECISION AND COt1DITI0NS RELAXATION OF FRONTAGE REQUIREh1ENT5 ) THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane County, in hearing the application (CUE-35-84 & VE-133-84), for the purpose of establishing a a duplex in the Agricultural zone hereinafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County having held a public hearing on July 25, 1984 and haviny fully considered all testimony presented tliereat, and further having visited the site and vicinity in question, and having rendered a decision on tiie 6th day of August, 1984, APPROVING said proposal, does }Zereby make the followiny: FINDINGS OF FACT 1, That the proposal is generally 1 ated on the northwest corner of llth Avenue and Clinton Road in Section Township 25, Range 44 E.W.M., Spokane County, PAFCEL: 22549-1112. 2. That the proposal consists of establishing a duplex on a lot having approximately 14,000 sq, ft, and a front yard of 92 feet frontage whereas Spokane County Zoning Ordinance requires 100 feet of frontage and 15,000 sq. ft. with the approval of a Conditional Use Permit. 3, That the adopted Spokane Countyy Generalized Comprehensive Land Ose Plan indicates URBAN usage of the area encompassed by thC proposal. 4. That the site is zoned Agricultural. 5. That the existing land uses in the area of proposal include sinyle family residences and duplexes in the general rea. 6. That the proposal conforms to all setback requirements of the Spokane County Zoning Ordinance and further is consistent with development density in the area and in the County Comprehensive Plan Urban Category, 7. That the County departments reviewing the proposal generally indicate that no adverse impacts are anticipated if the proposal is approved. e. That the proposal does not appear to be detrimental to adjacent properties nor have an adverse impact upon the property an3 improvements in the area. 9. That no one appeared to oppose the proposal nor were any written comments adverse to the proposal received. 10. That the proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane Courlty liave been met. CONCLUSION Following review of the Planing Department file, consideration of the public testimony, and circumstances in the area of proposal, the Zoning Adjustor concludes that the proposal is not detrimental and is compatible to the public health, safety, welfare and consistent with the Spokane County Comprehensive Plan, AA ~ FINDINGS OF FACT, DECZSION AND CONDITIC>NS CUE-35-84 & VE-133-84 PAGE 2 DECISION From the foregoing Findings, a review of the Planning Department File No. CUE-35-84 & VE-133-84, testimony at the public hearing, and a site visit, the Zoning Adjustor hereby in APPROVING the proposal establishes the following conditions: A. CONDITIONS OF APPROVAL 1) The proposal shall be developed consistent with ali building setbacks for this zone (Agricultural). 2) The Owner(s), or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the forniation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, ttiis condition stiall not prohibit ttle Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36,94. 3) Each dwelling unit shall be douUle plumbed for connection to future area-wide collection systems. 4) Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 5) Subject to specific application approval and issuance of permits by the Health Officer, the use of an indivi(jual on-site sewage system may be authorized. 6) Water service shall be by an existiny public water supply when approved by the Regional Engineer (Spokane), State Departlnent of Social and Health Services. 7) Use of private wells and water systems is prohibited. 8) All buildings and structures require building permits as per Section 301 of the Uniform Building Code. ~ DATED THIS ~ DAY OF , 19 .
